1.Information on how to enter and prize details form part of these Conditions of Entry. Entry into the "Help Santa Find a Home" promotion is deemed to be an acceptance of these Conditions of Entry. Entries not completed in accordance with these Terms and Conditions are ineligible.
2.The Promoter is realestateVIEW.com.au Pty Ltd (ABN 31 064 397 351) 335 Camberwell Road, Camberwell, VIC 3124, Australia.
3.Promotion commences November 15th 2010, 10am (AESDT). Promotion closes December 19th, 11.59am (AESDT).
4.Entry is open to Australian residents only over the age of 18 years. The employees, directors, management, officers and contractors (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Entrants must also have not any known connection to or relationship with any staff member of REIV or Realestateview.com.au Ltd (and associated websites) - (Complete details of digital agency i.e. Citrus) - ( or any real estate agency). "Immediate families" means spouse, parent, natural or adopted child, and sibling (whether natural or adopted by a parent) whether or not they live in the same household as the director, manager, employee, officer or contractor.
5.The prizes consists of: 5 weekly prizes of 1 x Coles Group & Myer gift cards to the value of AUD$500 (incl GST) each.
6.The total prize value is AUD$2,500 (incl GST). 7.The prize value is accurate at the date of commencement of the Promotion. The Promoter accepts no responsibility for any variation in the value of a prize after that date. A prize cannot be transferred, exchanged or redeemed for cash. Where a prize, or part of a prize, is unavailable, the Promoter retains the right to substitute the prize (or part) with a prize (or part) of equal or greater value. The sharing of prizes is not permitted.
8.How to Enter
•Entry is available via a property details page on realestateVIEW.com.au or through the website realestateVIEW.com.au/SantaPromotion.
•It is a mandatory requirement for entrants to search the website realestateVIEW.com.au the site for properties that meet Santa's criteria by using the daily clues posted on realestateVIEW.com.au twitter page and Facebook page.
•Entries are limited to 1 per day per person but each submitted forward to a friend gets the originator an extra entry. The competition runs from Monday to Sunday weekly, with the weekly prize drawn at 11 am each Monday mornings for the 5 week campaign. Entries close at 11.59pm each Sunday night for the 5 week campaign.
9.Competition Draw
•The competition will be drawn: at Citrus Internet Pty Ltd. Level 8, 100 Albert Road, South Melbourne Victoria at as close as possible to 11am 22nd November, 11am 29th November, 11am 6th December, 11am 13th December, 11am 20th December 2010, all AESDT.
•Winners will be notified by phone & email on the day of each prize draw and the names of all winners will be published in The Australian newspaper on the 23rd of December 2010.
•The prize will be sent to the winner by registered mail to their nominated address. The winner will be contacted at as close as possible to 11.30am 22nd November, 11.30am 29th November, 11.30am 6th December, 11.30am 13th December, 11.30am 20th December 2010, all AESDT, for notification of their winnings and confirmation of their postal address.
•An unclaimed prizes draw will be conducted from all correctly received entries for all unclaimed prizes (e.g. if all 5 are unclaimed then a draw for all 5 vouchers will be undertaken) and will be held at 11am (AESDT) 28th March 2011 at Citrus Internet Pty Ltd. Level 8, 100 Albert Road, South Melbourne, Victoria.
•The winners from the unclaimed prize draw will be notified by phone and email at 11:30am (AESDT) 1st April 2011. The names of all winners will be published in The Australian newspaper on the 4th of April 2011.
•The winner will be determined by a random computer generated electronic drawing procedure of the participants that have correctly submitted their details on the competition entry form.
10.All entries are the property of the Promoter. By entering this Promotion, you understand and agree that the Promoter may use and disclose the information provided by you on the terms and for the purpose set out in the Promoter's Privacy Statement available at
http://www.realestateview.com.au/Privacy-Policy.html. Each entrant consents to the Promoter using the entrant's personal information to administer the Promotion and announce the winner and disclosing the entrant's personal information to organisations that assist the Promoter with administering the Promotion and announcing the winner, and to third parties as required by law (including authorities that regulate this Promotion). The Promoter may use this information, in any media for all future promotion, marketing and publicity purposes without any further reference, payment or other compensation to the Entrant, including sending the Entrant electronic messages. Access to personal information may be requested by contacting the Promoter. Entrant should direct any request to access, update or collect information to the Promoter.
11.Any tax liability arising, as a result of accepting any of the prizes is the responsibility of the winner.
12.To the fullest extent permitted by law, the Promoter will not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss, or for any personal injury suffered or sustained as a result of entering this promotion or receiving, taking or using any prize except for any liability which cannot be excluded by law).
13.The Promoter's decisions are final, and no correspondence will be entered into.
14.The costs associated with accessing the Promoter's website is the Entrants responsibility and is dependent on the internet service provider used. The Promoter reserves the right to refuse any entries that are deemed to be submitted via any form of computer programming or automatically generated entries.
15.If for any reason this Promotion is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures, or any other causes beyond the control of Promoter which corrupt or affect the administration security, fairness, integrity, or proper conduct of this Promotion the Promoter reserves the right to cancel, terminate, modify or suspend the Promotion subject to approval of the gaming authorities in each State and Territory (where relevant). The Promoter reserves the right and may in its absolute discretion, to disqualify any individual who tampers with the entry process, or may benefit from such tampering.
16.Except for any liability which cannot be excluded by law the Promoter and any of its employees, contractors and agents or employees of their contractors and agents:
(1) are not responsible for any problems or technical malfunction of any telephone network or lines, computer on line systems, servers, or providers, computer equipment, software, technical problems or traffic congestion on the Internet or at any website, or any combination thereof, including (but not limited to) any injury or damage to participants or any other person's computer or mobile handset related to or resulting from participating in this Promotion;
(2) accepts no responsibility for any incorrect or inaccurate information caused by any of the equipment or programming associated with or utilized in connection with this Promotion, or by any technical error that may occur in the course of this Promotion, including (but not limited to) any failure of the computer system or other equipment to determine winners in accordance with these Conditions of Entry; and
(3) accepts no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to or alteration of entries or entrant's details.
17.The Promoter, and any of its employees, contractors and agents or employees of their contractors and agents, accept no responsibility for late, lost or misdirected entries. All entries are deemed to be received at the time of receipt in a promotional database and NOT at the time of transmission by the Entrant.
