Terms & Conditions
1. Instructions on how to enter, prize details and other information
contained within the promotional advertisements form part of these
terms and conditions. To the extent that there is any inconsistency,
these terms and conditions will prevail. The Promoter is The West
Australian Newspapers Limited (ACN 008 667 632) and the Swan
Bells Inc.
2. Entry into the promotion commences 12:01am WST Wednesday 10
November 2010 and closes 12:00pm WST Tuesday 30 November
2010. Public voting takes place between 6:00pm WST Wednesday
01 December 2010 and closes 7:00pm WST Tuesday 07 December
2010.
3. The only persons who may enter and be awarded the prize are
residents of Western Australia aged 16 years or older.
4. To enter, visit www.thewest.com.au/thebelltower. Once you have
completed the entry form, click on the “I have read and agree to the
terms and conditions” box which indicates the entrant's agreement
to these conditions:, and click the “Submit” button to enter.
Entrants can only enter once.
5. Each valid entry will be entered into the judging competition. The
judging date is Wednesday 01 December 2010. The winner will be
selected by a professional panel judges.
6. Each valid entry will be considered as a finalist for the people’s
choice award. The panel of judges will select 25 images as finalists
to be voted on by the public. The winner will be determined by the
image that has the most number of public votes. Each IP address is
only allowed one vote.
7. One Judge’s Selection prize: Canon Digital SLR camera with two
lenses, [valued at $2,099] and framed winning picture to be
displayed in the Bell Tower for 12 months. The winner will be
notified by telephone on Thursday December 02, 2010.
8. One People’s Choice prize: Canon Digital SLR camera with two
lenses, [valued at $2,099] and framed winning picture to be
displayed in the Bell Tower for 12 months. The winner will be
notified by telephone on Wednesday December 08, 2010.
9. Ten voter prizes: 12 month double pass to The Bell Tower [valued
at $264.00]. The winners will be notified by email on Thursday
December 09, 2010.

10. Prizes are not transferable or exchangeable or redeemable for cash.
In the event that the prize is unavailable, the Promoter reserves the
right to substitute a prize of equal value, subject to any written
directions of any relevant authority.
11. The Promoter makes no representations or warranties as to the quality,
suitability or merchantability of any of the goods/services offered as
prizes. To the extent permitted by law, the Promoter is not liable and
liability is excluded (whether for breach of contract, negligence or
otherwise) for any loss or damage suffered or sustained by the winner,
the winner's companion or any other person travelling with the
winner, including, but not limited to, consequential (including
economic) loss by reason of any act or omission, deliberate or
negligent, by the Promoter, or its servants or agents, in connection with
the arrangement for supply, or the supply, of any goods or services by
any person to the prize winner and, where applicable, to any
family/persons accompanying the winner. This clause does not affect,
and is not intended to affect, any rights a consumer might have, which
are not able to be excluded under applicable Australian consumer
protection laws. The Promoter's liability and the any person's remedy
for breach of these terms and conditions or for any right or remedy
implied or conferred by law which cannot be excluded, is limited to, at
the Promoter's option, the following: In the case of any goods: (a)
replacement of the goods or supply of equivalent goods; (b) repair of
the goods; (c) payment of the cost of replacing the goods or acquiring
equivalent goods; or (d) payment of the cost of repairing the goods. In
the case of any services: (a) supplying the services again; or (b)
payment of the cost of having the services supplied again.
12 .Entries become and remain the property of the Promoter. The
information entrants provide will be used by the Promoter for the
purpose of conducting this competition. The Promoter may disclose
entrants' personal information to its contractors and agents to assist in
conducting this competition or communicating with entrants, subject
to compliance with the Promoter's privacy policy. If the entrant would
like to receive information on The West Australian, and the entrant has
marked the "opt-in" box on the entry form, the entrant consents to the
storage of their personal information on the Promoter's database and
the Promoter may use this information for future promotional and
marketing purposes subject to and in accordance with its privacy
policy.
13. If for any reason this competition is not capable or running as planned,
including infection by computer virus, bugs, tampering, unauthorised
intervention, fraud, technical failures or any other causes beyond the
control of the Promoter which corrupt or affect the administration,
security, fairness, integrity or proper conduct of this competition, the
Promoter reserves the right in its sole discretion to cancel, terminate,
modify or suspend the competition, subject to any written directions of
any relevant authority where required.
The Promoter assumes no responsibility for any error, omission,
interruption, deletion, defect, delay in operation or transmission,
communications line failure, theft or destruction or unauthorised
access to, or alteration of, entries. The Promoter is not responsible for
any problems or technical malfunction of any telephone network or
lines, computer online systems, servers or providers, computer
equipment, software, failure of any email or entry to be received by the
Promoter on account of technical problems or traffic congestion on the
Internet or at any website, or any combination thereof, including any
injury or damage to entrant's or any other person's computer related to
or resulting from participation or downloading any materials in this
competition. The Promoter is not liable for any consequences of user
error including (without limitation) costs incurred. CAUTION: ANY
ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR THE
INFORMATION ON A WEBSITE, OR TO OTHERWISE UNDERMINE
THE LEGITIMATE OPERATION OF THIS COMPETITION, MAY BE
A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD
SUCH AN ATTEMPT BE MADE, WHETHER SUCCESSFUL OR NOT,
THE PROMOTER RESERVES THE RIGHT TO TAKE WHATEVER
ACTION IT CONSIDERS NECESSARY AGAINST ANY PERSON
WHO IS PARTY TO THE SAID CONDUCT.
14. If a winning entry is deemed not to comply with these conditions of
entry, the entry will be discarded and a new winner of the prize will be
determined by drawing a further valid entry. The judges' decision is
final and no correspondence will be entered into.
15. The Promoter may, in its sole discretion, disqualify all entries from,
and prohibit further participation in this competition by, any person
who tampers with or benefits from any tampering with the entry
process or with the operation of the competition or acts in violation of
these conditions, acts in a disruptive manner or acts with the intent to
annoy, abuse, threaten or harass any other person.
16. The Promoter shall not be liable for and liability is excluded (whether
for breach of contract, negligence or otherwise) for any loss or damage
whatsoever which is suffered (including but not limited to direct or
consequential loss) or for any personal injury suffered or sustained in
connection with any prize/s except for any liability, which cannot be
excluded by law. The winner may be required to sign a legal release in
a form determined by the Promoter in its absolute discretion. The
Promoter reserves the right to refuse to allow the winner to take part in
any or all aspects of the prize, if the Promoter determines, in its
absolute discretion, that the winner is not in the mental or physical
condition necessary to safely participate in the prize.
17. It is a condition of entry that prize winners agree to have their name
and suburb published for publicity purposes if required. By
participating in this competition, participants signify their acceptance
of all conditions and the requirement to participate in promotional
activity if required.
18. Employees of the Promoter, promotional partners, panel judges,
contractors, their subsidiaries and immediate family are ineligible to
enter.
19. All personal details kept will be used only for the purpose of the
promoter to distribute marketing materials. Your details will not be
given to a third party or used in any other way without your express
permission. The promoter will take all reasonable steps to ensure the
security of your personal information.
20. To access personal information kept on you by the promoter, please

Osborne Park WA 6017. Please note that information will only be
provided to the person detailed and current photographic
identification may be required prior to the release of any personal
information.
21. Caution: Any ATTEMPT TO DELIBERATELY DAMAGE ANY
WEBSITE OR THE INFORMATION ON A WEBSITE, OR TO
OTHERWISE UNDERMINE THE LEGITIMATE OPERATION OF
THIS COMPETITION, MAY BE A VIOLATION OF CRIMINAL AND
CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE,
WHETHER SUCCESSFUL OR NOT, THE PROMOTER RESERVES
