TERMS AND CONDITIONS:
1. These terms and Conditions apply to the “FESTIVE SEASON OF GENEROSITY”
Promotion” (“the Promotion”).
2. Information on how to enter the Promotion and information on prizes which may be
mentioned anywhere in messages, advertisements, signs or posters in the Broadway
on the Mall Shopping Centre or elsewhere (“Promotion Information”) form part of these
Terms and Conditions.
3. If there is any inconsistency between these Terms and Conditions and any other
Promotion Information, these Terms and Conditions shall prevail.
4. The Promoter means CENTA COMPANY PTY LTD ACN 010 059 944 as owner of
Broadway on the Mall Shopping Centre, located at 170 Queen Street, Brisbane in the
State of Queensland (“the Centre”).
5. Prize means one of the Weekly Prizes or the Major Prize, as defined elsewhere in these
Conditions and if the context so requires, encompasses both of the Weekly Prizes and
the Major Prize together.
6. The Promotional Period means the period from 9:00am on Wednesday, 17 November
2010 to 4:00pm on Tuesday, 25 January 2011.
7. “Subscriber” means a person that has subscribed to the Promoter’s Website.
8. “Website” and the “Promoter’s Website” means the Promoter’s website located at
www.broadwayonthemall.com.au.
9. By entering into the Promotion or using the Promoter’s Website, a person is deemed
to have accepted these Terms and Conditions.
10. These Terms and Conditions may be amended or varied by the Promoter at any time
in the Promoter’s sole and absolute discretion without prior notice.
11. Any amendments will be posted on the Promoter’s Website and it is the responsibility
of each person entering the Promotion or using the Website to ensure that they review
these Terms and Conditions regularly to ensure familiarity with any changes.
The Promotion
12. In order to enter the Promotion and to be eligible to claim a Prize, a person must:-
(a) Spend a total of $20.00 or more at any participating retailer in the Broadway on
the Mall shopping centre in a single transaction during the Promotional Period
(an “Eligible Transaction”);
(b) Obtain an entry form from the retailer in which the Eligible Transaction was
completed;
(c) Complete all sections on the entry form and place the fully completed original
entry form into the Promotion barrel which is located on the Ground Floor of the
Queen Street entrance to the Broadway on the Mall shopping centre;
NB: The entry form must be fully completed in all sections in order to be a
valid entry.
(d) Consent to the Promoter subscribing the person to the Promoter’s Website, via
the email address provided by the person in their completed entry form. The
Promoter’s Website is located at (www.broadwayonthemall.com.au) and each
person subscribed by the Promoter must remain subscribed to be eligible to
claim a Weekly Prize or the Major Prize; and
(e) Retain their original proof of purchase receipt issued by the retailer in which the
Eligible Transaction was completed.
NB: The purchase receipt must be presented to the Promoter when collecting
the Prizes and must clearly specify the store of purchase, the date of
purchase and the total price of the transaction.13. If a person fully complies with the entry criteria outlined in paragraph 12 (above), subject
to the other provisions of these Terms and Conditions, they will be deemed to have
entered into the Promotion.
14. Payment for services (eg. electricity, gas, telephone), registrations (eg. motor vehicle
registration), premiums (eg. insurance or health fund premiums), rates, fees, charges
levies, subscriptions (eg books, magazine, ambulance etc), deposits or payments to
financial institutions and any similar payments will not qualify as an Eligible Transaction.
15. For each Eligible Transaction between $20.00 and $99.99, a person will receive one
entry form for the Promotion. For example:-
(a) If a person spends $40.00 in one Eligible Transaction, the person is still only
entitled to receive one (1) entry into the Promotion.
(b) If a person spends $87.50 in one Eligible Transaction, the person is still only
entitled to receive one (1) entry into the Promotion.
16. However, if a person spends $100.00 or more at a participating retailer in the Broadway
on the Mall shopping centre in any single Eligible Transaction during the Promotional
Period, the person will receive five (5) entries into the Promotion. For example:-
(a) If a person spends $100.00 in one Eligible Transaction, they will receive five (5)
entries into the Promotion;
(b) If a person spends $200.00 in one Eligible Transaction, they will still only receive
five (5) entries into the Promotion.
17. There are no limits to the number of Eligible Transactions that can be completed by any
one person during the Promotional Period for the purposes of this Promotion.
Conditions of Entry
18. Entry is open to all residents of Australia.
19. Employees of the Centre and their immediate families and their associated agencies
and companies are not eligible to enter. Immediate families includes spouse, child,
defacto or any other family member residing at the same premises as that person.
20. Only original entry forms will be accepted by the Promoter as a valid entry. If any entry
form is not completed properly, appears tampered with or is a copy of an original, the
Promoter reserves the right to refuse entry into the Promotion or to refuse to award a
Weekly Prize or the Major Prize.
21. The Promoter also reserves the right to cancel, void or invalidate any entries that are
not fully completed or otherwise fail to comply with these Terms and Conditions.
22. The Promoter will not be responsible for any entries that are late or not received as an
original, fully completed entry form.
23. The Promoter accepts no responsibility for invalidated, voided, incomplete, incorrectly
submitted, delayed, misdirected or illegible entries. Any entries that are not in
accordance with these Terms and Conditions or the Promotion Information will be
deemed so. The decision of the Promoter in this regard is final and binding.
24. The Promoter does not accept any responsibility to persons, entrants, subscribers or
winners for online or other fees, costs or charges associated with subscribing to the
Promoter’s Website or entering the Promotion.
25. The Promoter reserves the right to ask for proof of identity or residency at any time and
may use any resource available to carry out verification that the Promoter deems
appropriate.
26. In the event that suitable proof is not presented when required or the Promoter, in its
sole and absolute discretion is not satisfied with any proof that is presented, the
Promoter may cancel, void or invalidate any entry form, Website subscription or Prize
award.
27. The Promoter may also void any entry that the Promoter feels may be contrary to the
Promotion or these Terms and Conditions including but not limited to circumstances
where the Promoter has reasonable belief that an entrant may have submitted more
than one entry for a single Eligible Transaction below $99.99.
The Prizes
28. The prizes in this Promotion have been separated into two categories:-
(a) The “Weekly Prizes”; and
(b) The “Major Prize”.

30. Each valid entry form gives the entrant a chance to win one (1) Weekly Prize.
31. The entry form drawn by the Promoter as the Winner of one of the Weekly Prizes
referred to above will not be replaced into the Promotion barrel after it has been drawn.
For example:-
a. If a person has one entry form in the Promotion barrel and is drawn as a Winner
on 19 November 2010, that entry form will not be replaced in the Promotion
Barrel for a chance to win at a later date.
b. However, if a person has five entry forms in the Promotion barrel and one of
those entry forms is drawn on 19 November 2010, that person will still have four
other opportunities to win a Weekly Prize.

33. The Major Prize consists of the following three (3) Prizes jointly, which will all be won by
one person. The Major Prize will be drawn by the Promoter at 9:00am (Queensland

Specific Terms relating to the Prizes
The Car
34. On road costs are limited to stamp duty, dealer delivery, registration for one (1) year and
compulsory third party insurance for one (1) year. Third party comprehensive insurance
is not included.
35. Unless expressly stated herein, all other fees, duties, taxes, levies, charges or expenses
relating to the Car become the responsibility of the Winner.
36. If the Winner of the Car is under the age of 18 as at the date of the draw, the Car will
be transferred into the name of the Winner’s parent or guardian until the Winner turns
18.
37. If the Winner of the Car does not have a valid drivers licence (including a licence that
has been temporarily suspended or revoked), the vehicle will be transferred into the
name of a valid licence holding person nominated by the Winner.
38. The Winner will be required to liaise with the appropriate representative from Nissan
Motor Co. (Australia) (“Nissan”) who will contact the Winner following completion of the
Promotion to make arrangements for collection the car.
39. The Promoter has been advised by Nissan that every attempt will be made for collection
to be arranged from the Nissan dealer that is closest to the Winner’s place of residence.
The Winner hereby releases the Promoter from any liability whatsoever should this not
occur.
40. Nissan has also advised the Promoter that the Car will be delivered to the Winner in or
after February 2011 (the “Delivery Date”).
41. the Winner acknowledges that the Promoter has nothing to do with collection of the Car
and the Winner undertakes to abide by the terms and requirements of Nissan in respect
of collection. The Winner hereby releases the Promoter from all liability in this regard.
42. The Winner must comply with all requirements of Nissan, including the presentation of
and execution of any documentation required, in order for the Car to be registered in the
name of the Winner prior to the Delivery Date.
43. The Winner will receive a manufacturers warranty from Nissan with the Car (“the
Warranty”). This Warranty will be in the usual format provided by Nissan.
44. The Promoter makes no representations, warranties, assurances or guarantees in
respect of the Car and/or the collection of the Car to the extent permitted by law. The
Winner of the Car indemnifies the Promoter from any loss or damage and undertakes
to liaise directly with Nissan in respect of the Car and the Warranty.
45. For clarity, the Winner waives all of its rights to make any claim against the Promoter
in relation to any aspect of the Car whatsoever.
The Broadway on the Mall VIP Carpark
46. Each Winner of the VIP Carpark will be entitled to exclusive use of same for the period
outlined in the corresponding date of the draw ("the term").
47. The VIP Carpark is number 42.
48. As a condition of claiming and using this Prize, each Winner (or assignee thereof) must
provide the registration number, a copy of their Driver's Licence, emergency contact
details and a brief description of their vehicle to the Promoter. This vehicle will be the
only vehicle entitled to the use of the VIP Carpark during the term.
49. Each Winner will receive a swipe card and keys to the Carpark, which will allow 24 hour
access to same. If the card/keys are lost, misplaced or otherwise not returned to the
Broadway on the Mall Centre Management within two (2) days of expiry of the Winner's
term, the Promoter will charge a fee of $100.00 to replace the card and keys. Each
Winner accepts this condition as a fundamental term of claiming this Prize.
50. Each Winner acknowledges that there is only one VIP Carpark available for use and
undertakes to return the car/key in a timely manner. The Winners acknowledge the
Promoter may hold any Winner responsible for loss or damage (however incurred) for
any failure to return the car/key when required or if any winner uses the VIP Carpark
outside the period of their allocated term.
The Rendezvous Hotel, Brisbane Prize
51. The Winner of the Rendezvous Hotel Prize will be required to liaise directly with the
Rendezvous Hotel in Brisbane (the “Hotel”) when claiming their prize.
52. By their collection of this Prize from the Promoter, the Winner acknowledges that this
Prize will be valid for the Winner’s use until 30 June 2011.
53. The Winner will not hold the Promoter responsible in any manner whatsoever if the
Winner fails to use this Prize on or before that date.
54. The Winner will be required to liaise directly with the Hotel staff when arranging a
booking, checking in and checking out of the Hotel.
55. The Promoter makes absolutely no warranties or representations to the Winner in
respect of this Prize.
Prizes Generally
56. The total maximum prize pool for the promotion is valued at $31,386.99.57. Prize values are based upon the recommended retail prices at the time of printing
(inclusive of GST). The Promoter accepts no responsibility for change in Prize value
between now and the ultimate Prize redemption date.
58. The Promoter accepts no responsibility for any malfunction, variation in any of the
Weekly Prizes, or the Major Prize, or the value thereof.
59. If any of the Weekly Prizes or the Major Prize, cannot, in the sole and absolute
discretion of the Promoter, be provided for any reason, then the Promoter reserves the
right to provide an alternative Weekly Prize or Major Prize of equal or greater value,
subject to any directions from a regulatory authority.
60. The Promoter makes no representations, warranties, guarantees or assurances with
respect to any of the Weekly Prizes or the Major Prize.
61. The Promoter will not be responsible for any malfunction, fault, technical or design error
or any other breakdown concerning any of the Prizes whatsoever. The Winners
undertake to liaise directly with the providers of the Prizes in respect of any
manufacturer’s warranties and/or guarantees and hereby release the Promoter from any
liability whatsoever in respect thereto.
62. The Weekly Prizes and the Major Prize are non-transferable and not redeemable for
cash (either wholly or in part) and are not available for use with any other offer or
promotion.
63. To be eligible to claim a Weekly Prize or the Major Prize, each Winner agrees to provide
information and photographs of themselves for marketing and publicity use and
undertakes to comply with any of the Promoter's or the Prize supplier's requirements.
64. The Promoter’s decision is final and binding on all entrants and Winners. No person will
object to the Promoter’s decision in any way whatsoever and the Promoter will not take
responsibility for any substitutions or variations of the Prize.
The Winners
65. Each Winner will be entitled to one of the Weekly Prizes or the Major Prize for any one
Prize draw.
66. The Winners do not need to be present at the draw.
67. Each Winner must claim their Prize within 1 month from the date of the draw.
68. Each Winner must retain and present their original purchase receipt issued by the
retailer in which the Eligible Transaction was completed.
69. The purchase receipt must clearly specify the retailer in which the Eligible Transaction
was completed, the total price and that the purchase was completed during the
Promotional Period.
70. Failure to produce proof of purchase for the Eligible Transaction during the Promotional
Period may, in the sole and absolute discretion of the Promoter, result in invalidation of
one, more or all of the person’s entries and forfeiture of any right to claim a Prize.
71. The Promoter will use reasonable endeavours to notify the Winners by email, telephone
or otherwise.
72. If the Promoter is unable to make contact with one or more Winner within two weeks
from the date of the draw, or one or more of the Winners fails to claim their Prize within
1 month from the date of the draw, then the Prize will be forfeited and the Promoter will
draw an alternative Winner and attempt to make contact with that person for collection
of the Prize.
73. The Promoter will continue in this fashion until a Winner has been notified and has
collected their Prize.
General Terms and Conditions
74. All entry forms remain the property of the Promoter.
75. To be eligible to claim a Weekly Prizes or the Major Prize, Winners must provide
information and a photograph of themselves to the Promoter for marketing and publicity
use. The Winners grant the Promoter a non-transferrable, sub-licensable, royalty free,
worldwide licence to use these photographs in any way that the Promoter wishes.
76. The Promoter accepts no liability for any fees, charges, expenses, costs etc incurred
by any person to participate in this Promotion.
77. The Promoter accepts no liability whatsoever for any loss, damage whatsoever
(including, but not limited to indirect or consequential loss) or any injury to a person or
their property that may arise in any way from the participation in or the conduct of the
Promotion.
78. The Promoter accepts no liability whatsoever for any tax implications (including any
Fringe Benefits or Personal Income Tax) that may arise from Weekly Prize or Major
Prize winnings. Independent financial advice should be sought prior to acceptance of
a Weekly Prize or the Major Prize.
79. Subscribers, Entrants and Winners in/of the Promotion agree to indemnify the Promoter,
its subsidiaries, employees, advisers and agents against all claims, losses, damages,
costs and expenses reasonably or lawfully suffered or incurred by the Promoter by
reason of any loss, damage or injury incurred by the Promoter arising out of this
Promotion.
80. Subject to any restrictions imposed by law, in the case of the intervention of any outside
act, agent or event which prevents or significantly hinders the Promoters ability to
proceed with the Promotion on the dates and in the manner described in these Terms
and Conditions, including but not limited to vandalism, power failures, tempests, natural
disasters, acts of God, civil unrest, strike, war, act of terrorism etc, the Promoter may
in its absolute discretion, suspend or cancel the Promotion and recommence it at a date
in which the Promoter deems appropriate from the start and on these same Terms and
Conditions.
81. Subject to any restrictions imposed by law, if for any reason this Promotion is not
capable of running as planned, due to causes including but not limited to computer
failures or viruses, tampering, unauthorized intervention, fraud, technical failures or any
other causes beyond the control of the Promoter which corrupt or affect the
administration security, fairness, integrity or proper conduct of this Promotion, the
Promoter reserves the right in its sole discretion to cancel, terminate, modify or suspend
the Promotion.
82. The Promoter is not responsible for any problems or technical malfunctions of any
telephone network lines, computers, online computer systems, servers, providers,
equipment, software, traffic congestion on the internet or any website, or any
combination thereof, including but not limited to any injury or damage to any person’s
computer related to or resulting from participation in or downloading any materials in this
Promotion.
83. The Promoter reserves the right to collect and use personal information provided by
Website subscribers, Entrants and Winners for the purpose of carrying out this
Promotion.
84. If a Website Subscriber, Entrant or Winner does not provide the information requested,
the Promoter may, in its sole and absolute discretion, void any entry or entitlement to
claim a Weekly Prize or the Major Prize for that particular person.
85. Each Subscriber’s, Entrant’s and/or Winner’s personal information may be passed to
relevant regulatory bodies, the police or other authorities in the course of any
investigation of any complaints or suspected unlawful activity.
86. The Promoter may use the personal information provided by any person to send
publications or other Promotional material. The Promoter may supply the personal
information to contractors which assist the Promoter to do this, to organisations which
provide special prizes or offers and which are associated with the Promotion and to
selected approved organisations which may use it to inform Subscribers, Entrants or
Winners about other products, services or events.
87. The Promoter may use a Winner’s personal information in any media for publicity
purposes associated with the Promotion without any further payment or other form of
compensation unless the Winner otherwise notifies the Promoter not to use their
personal information in such a manner.
88. If a subscriber, Entrant or Winner prefers that the Promoter does not use and/or retain
their details, they must contact the Promoter on (07) 3229 5233.
89. Any Subscribers, Entrants or Winners have a right to access most personal information
which the Promoter holds. The Promoter may deny a request for access in some
circumstances. If the Promoter does this, it will be required to explain why. If at any
time a subscribers, entrants or Winners details change or they require access to the
personal information, the Promoter may be contacted on (07) 3229 5233.
