TERMS AND CONDITIONS 1. Information on how to enter on our website and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions. Any violation of these terms and conditions may result in disqualification.
2. Entry is only open to legal residents of the Asia Pacific region, as defined by Mr & Mrs Smith, subject to legal travel ages and participation in competition ages in country of residence, and who satisfy the entrance requirements contained herein.
3. Employees (and their immediate families) of Mr & Mrs Smith (Asia Pacific) Pty Ltd ABN 88 134 136 128 (“Promoter”) and Mr & Mrs Smith (global) Spy Publishing Ltd Company registration: 443 8845, registered in the United Kingdom, their subsidiaries and the agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
4. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant whose entry is not in accordance with these Terms and Conditions or who otherwise tampers with the entry process. Manifest errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
5. Incomplete, indecipherable, or illegible entries will be deemed invalid. The Promoter accepts no responsibility for any incorrect, incomplete or lost entries.
6. Only one entry permitted per person. Bonus entries will be awarded for every referral who also enters the competition.7. If there is a dispute as to the identity or details of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity or details of the entrant.
8. Promotion commences 16/11/2010. Entries close 11.00am AEDST 15/12/2010. Entries submitted and received by the Promoter after this time will not be accepted.9. The winner of the Major Prize will be determined by a game of chance. Skill plays no part in determining the Major Prize winner. The Winner will be randomly selected at Mr & Mrs Smith (Asia Pacific) Suite 1C, 205-207 Johnston Street, Fitzroy, Australia on 20/12/2010 at 10:00am AEDST. The Promoter reserves the right to draw additional reserve entries and record them in order, in case an invalid entry or ineligible entrant is drawn and the Promoter elects to draw upon such reserve entries.
10. Winner will be notified by e-mail at the email address provided in the corresponding entry and will also be published on the Promoter’s website

If the Winner does not claim his or her prize within one month of email notification, or he or she is not otherwise contactable, the Major Prize will be randomly selected again, using the same procedure set out in clause 9, on 21/01/2011 This procedure will continue, as the context permits and in The Promoter’s absolute discretion, until a claimable Winner can be contacted..
11. The Promoter’s decision is final and no correspondence or communication will be entered into in relation to such decision or associated process.
Major Prize
12. The winning entry (“The Winner”) will win the following:
(a) (i) a holiday for The Winner and a friend to Chiang Mai, Thailand (three nights) and Bangkok, Thailand (two nights). The trip comprises accommodation. (ii) three (3) nights twin share accommodation at Rachamankha, Chiang Mai, Thailand valued at approximately AU$678 (including taxes, à la carte breakfast and limited minibar drinks and snacks) (iii) two (2) nights twin share accommodation at Ma Du Zi, Bangkok, Thailand valued at approximately AU$398 (including taxes and American style breakfast daily). (iiii) The total value of the Major Prize = AU$1076
(Collectively referred to as “The Major Prize”)
(b) Additional meals, taxes, insurance, passports, visas, vaccinations, transport to and from departure point, transfers, items of a personal nature, in-room charges and all other travel and associated costs, charges, taxes and expenses are not included. The Major Prize must be utilised by 15/12/2011 and is subject to booking and accommodation availability and these Terms and Conditions. The Major Prize cannot be utilised during the relevant school holidays or during peak or black-out periods determined by the above named hotels or otherwise recognized as such in the travel industry, from time to time. All accommodation bookings are made on request via Mr & Mrs Smith (the Promoter) and are subject to availability.
13. For the purposes of the Major Prize, The Winner’s friend will be subject to the same restrictions set out in clause 3 of these Terms and Conditions. The Winner’s friend must be a legal resident of the Asia Pacific region.
14. The approximate retail value of the prizes set out herein are as at the date these Terms and Conditions are published. The Promoter accepts no responsibility for any variation in prize values, which may arise due to a variety of factors, including price and currency fluctuations, seasonal factors and timing. The Winner and companion are responsible for ensuring that they have valid passports, and any requisite visas, vaccinations, travel documentation and any other requirements in order to undertake such travel.
15. The Major Prize is subject to the terms and conditions of each of the relevant individual prizes and corresponding service providers.
16. The Winner may be required to present a credit card at the time of accommodation check in as a bond for any additional costs incurred by the winner and guest, such as but not limited to food and beverage.
17. Subject to the terms and conditions of the participating prize provider(s), if for any reason The Winner does not, once the Major Prize has been booked or confirmed, take or utilise the Major prize or any element(s) of the Major Prize at the time stipulated, then the Major Prize or that element(s) of the Major Prize will be forfeited and will not be redeemable for cash. It is The Winner’s responsibility to honour the bookings for accommodation, and the Promoter shall not be responsible for any delayed, cancelled or postponed bookings or flights.
18. If the Major Prize (or part of the Major Prize) is unavailable, the Promoter, in its absolute discretion, reserves the right to substitute the Major Prize (or that part of the Major Prize) with a prize to a similar value and/or specification, subject to any requirements at law or regulatory authority or otherwise.
19. Prizes, or any unused portion of a prize, or any part thereof, are not transferable, saleable or exchangeable and cannot be taken or redeemed as cash or equivalent.
20. In the event of war, terrorism, state of emergency, disaster, virus, power failure, technical malfunction or other event beyond the Promoter’s control, the Promoter shall not be liable an entrant for any costs or liabilities and The Promoter reserves the right to cancel, terminate, modify or suspend the Promotion, subject to any requirements at law or relevant regulatory authority or otherwise.
21. The Promoter makes no warranties, representations or guarantees, express or implied, in fact or in law, as regards this competition or the merchantability, quality or fitness for a particular purpose regarding any prize or any component of any prize.
