SUNDAY FOOD –THE MERCHANT DINNER WITH 10 FRIENDS COMPETITION
TERMS AND CONDITIONS

1.   The promoter is The Herald & Weekly Times Pty Ltd (ABN 49 004 113 937) of 40 City Road Southbank, Victoria 3006.

2.   Instructions on how to enter form part of the conditions of entry.  Entry into the competition is deemed acceptance of these terms and conditions.

3.   Entry is only open to residents of Victoria 18 years or older. Employees of the Promoter and their immediate families, directors, management, related companies, and their agencies associated with this promotion are ineligible.  Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether by natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin

4.   To enter, readers must SMS 19777969 with their name, address and phone number.  Competition SMS cost 55 cents including GST. 

5.   Competition starts at 00.01am (AEDT) on 21/11/2010 and closes at 23.59pm (AEDT) on 4/12/2010. 

6.   Multiple entries are accepted. SMS entries via internet or computer generation are invalid and will not be accepted.

7.   The SMS entry mechanic is only open to readers with an SMS compatible mobile phone connected to a service provider which permits text messaging to the promotional SMS number. It is recommended that entrants check with their individual service provider in this regard.  For SMS help call 1300 131 276.
8.   The time of entry will, in each case, be the time that the SMS is received by Salmat Interactive.

9.   The winner will be the first valid entry drawn at random from the pool of entrants.  The draw will take place at 10.00 am (AEDT) on 7/12/2011 at Salmat Interactive Pty Ltd, Level 17, Innovation Place 100 Arthur Street North Sydney NSW 2060.  The winners will be notified by phone and mail and their name published in the public notices section of the Sunday Herald Sun on 12/12/2010.

10.   The winner will receive a dinner for themselves and 10 friends in the luxurious private dining room at The Merchant, hosted by head chef Guy Grossi, including three-courses and wine. The winner and their 10 guests will also receive a Mil Lel gift hamper. Prize valued at $1600.

11.   The prize is not exchangeable or transferable and cannot be taken as cash. Prize must be taken at the time and date during the month of February 2011 agreed to by the winner and the Promoter. Subject to availability. Prize must be taken at the location stipulated by the Promoter. The Promoter accepts no responsibility for any variation in the prize value.

12.   The Promoter, their agents, affiliates or representatives will not be liable for any late, lost or misdirected entries.

13.   If the prize or any part of the prize becomes unavailable for reasons beyond the Promoter’s control, the Promoter will endeavour but is not obliged to provide a substitute prize of equivalent value.

14.   The Promoter and their associated agencies and companies will take no responsibility for the prize being damaged or lost in transit, or late, lost or misdirected mail.

15.   To the full extent permitted by the law, The Herald & Weekly Times Pty Ltd exclude liability for any loss, damage or injury whatsoever suffered or sustained (including, but not limited to direct, indirect, special or consequential loss or damage, loss of opportunity revenue or profit) arising directly or indirectly out of or in connection with this promotion.

16.   HWT collects entrants’ personal information in order to conduct the promotion. If the information requested is not provided, the entrant may not participate in the promotion. HWT may share entrants’ information with persons or entities assisting in the conduct of the promotion and with companies who are prize partners. HWT for publicity purposes may use the name and if applicable, image of the winners and persons accompanying the winners.
