HOW TO ENTER
To enter, eligible entrants must:

Fully complete in the manner required the official entry form (available in store and online); and During the promotional period, hand the completed and validated entry form along with proof of purchase to store staff in the store the eligible purchase was made.
TERMS AND CONDITIONS
Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
Entry is free and open to residents of Australia only. Employees (and their immediate families) of the Promoter, or agencies or companies associated with this Promotion, are ineligible to enter.
The promotion commences at 9.00am (AEST) on 29 November 2010 and closes at 11.59pm (AEST) on 13 December 2010.
To enter, Eligible Entrants must, during the promotional period, purchase product valued over $80 (Surf Dive’n Ski gift cards are excluded from this promotion) from any participating Surf Dive’n Ski store in NSW, Australia (“eligible purchase”) and obtain and fully complete in the manner required the official entry form (available in store). Eligible Entrants will be required to provide their full name and current and valid email address in order to fully complete their entry. Eligible entrants must then, during the promotional period, hand the completed and validated entry form along with proof of purchase to store staff in the store where the eligible purchase was made.
The entry form and purchase receipt must be an original and photocopies or images of entry forms and receipts will not be accepted. Incomplete, ineligible or incomprehensible entries will be deemed invalid. Entries must be received by the Promoter during the promotional period. The Promoter accepts no responsibility for late, lost or misdirected entries.
There will be one weekly prize draw, which will take place at General Pants Group HQ at 12:00pm (AEST) on 3 December 2010 (draw 1), 10 December 2010 (draw 2), 17 December 2010 (draw 3). It is the responsibility of the marketing coordinator to draw the winner of each weekly prize. Store listings available at
www.sds.com.au. All reasonable steps to notify the winner of the results of the draw will be taken by the Promoter. Judges' decision is final and no correspondence will be entered into.
There are up to 14 participating stores in one NSW, Australia. The first eligible entry randomly drawn from all eligible entries received by each participating store in each weekly draw will win one (1) Surf Dive ’n Ski voucher at the value of $1000. The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought.
Maximum total prize pool $3,000 (incl. GST).
In the event that any prize is unavailable, the Promoter reserves the right to award a similar prize of equivalent value subject to the approval of the required legal authorities.
The winner(s) will be notified by telephone and email and their name will be published in The Australian on 20 December 2010 (Draw 1,2,3). Except with the written consent of the Promoter, the prize is not transferable or exchangeable and cannot be taken as cash. The Promoter has absolute discretion as to whether it will provide such consent and need not provide any reasons to any person for providing or withholding consent.
Entrants can only enter in their own name. The Promoter reserves the right to request the winner to produce (within the requested time) appropriate photo identification or other documentation (to the Promoter’s satisfaction, at its sole discretion) in order to confirm their identity, age, residential or email address, eligibility to enter and claim a prize and any information submitted by the winner in entering the promotion before issuing a prize. If the documentation required by the Promoter is not received by the Promoter (or its nominated agent) or the winning entry has not been verified or validated to the Promoter’s satisfaction within the time requested, the winner’s entry will become invalid.
To the extent permitted by law, the Promoter, its employees and agents shall not be liable for any claims, losses, damages, injuries, costs and expenses suffered, sustained or incurred (including but not limited to indirect or consequential loss) (including but not limited to that arising from any person’s negligence) as a result of, or arising out of, or in any way connected with this promotion and/or its prizes including choice of or use of prizes.
The winner indemnifies the Promoter against any loss, claim, damage or expense suffered by any other party in any way arising from this promotion and its prizes or the use thereof. Subject, where relevant, to any directions given under the legislation regulating this promotion including Reg 37 of the Lottery and Gaming Regulations 1993 (SA) or other State or Territory legislation, if the prize is unclaimed, it will be awarded in a further draw to be held at the same time and place as the original draw on 3/12/10 and the name of the winner will be published in The Australian on 20/12/10.
If for any reason the promotion is not capable of running as planned, including tampering, unauthorised intervention, fraud, technical failures, or any other causes beyond the control of Promoter which corrupt or affect the administration security, fairness, integrity, or proper conduct of the promotion, the Promoter reserves the right in its sole discretion, to disqualify any individual who tampers with the entry process, or may benefit from such tampering, and, subject to the approval of those authorities that have issued permits for the conduct of the promotion, to cancel, terminate, modify or suspend the promotion.
The Promoter will not be liable for any loss suffered by any party which is connected with or arises from such cancellation, termination, modification, suspension or invalidation.
The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of, or non-receipt of, entries.
All entries and any copyright subsisting in the entries become and remain the property of the Promoter. The Promoter collects personal information about entrants to include entrants in the promotion and where appropriate award prizes. If the personal information requested is not provided, the entrant may not participate in the promotion. By participating in the promotion, each entrant also acknowledges that a further primary purpose for collection of entrants’ personal information by the Promoter is to enable the Promoter to use the information to assist the Promoter in improving goods and services and to contact entrants in the future with information on special offers or provide entrants with marketing materials via any medium including mail, telephone and commercial electronic messages. Each entrant also agrees that the Promoter may publish or cause to be published the winner’s name, and locality in any media as required under the relevant lottery legislation. Entrants can also gain access to, update or correct any personal information by contacting the Promoter by mail at the address below. All personal information will be stored at the office of the Promoter. A copy of the Promoter’s Privacy Policy in relation to the treatment of personal information collected may be obtained by contacting the Promoter.
