Terms and Conditions
By entering the Sunrise/The Morning Show/Weekend Sunrise ‘Accor Hotels’ Summer Competition (the “Competition”), you are agreeing to the following terms and conditions:
STANDARD TERMS
Information on how to enter forms part of the terms of entry.
WHO CAN ENTER?
Subject to clause 2.2, entry is open to all residents of Australia, who are 18 years of age at the time of entry, where the Channel Seven and affiliate broadcasting signals are received.
Employees and their immediate families of Seven Network (Operations) Limited, AAPC Limited, MNET Group Ltd and their associated agencies and companies are not eligible to enter.
HOW TO ENTER
The Competition commences on Sunday 28 November 2010 at 6.00am (AEDT) and concludes on Friday 3 December 2010 at 4.30pm (AEDT) (“the Competition Period”).
In order to enter the Competition, viewers must watch Sunrise (“the Program”) on the Seven Network during the Competition Period. Each morning in Weekend Sunrise on Sunday 28 November, Sunrise and The Morning Show from Monday 29 November 2010 to Friday 3 December 2010, there will be a Competition segment aired during the Programs (or any replacement program broadcast in the Sunrise, The Morning Show or Weekend Sunrise timeslots).
In order to enter, viewers must log into the Sunrise website (
www.yahoo7.com.au/sunrise) or The Morning Show website (
www.yahoo7.com.au/morning) between Sunday 28 November 2010 at 6.00am (AEDT) and Friday 3 December 2010 at 4.30pm (AEDT) and register the competition codeword and their entry details (name, address, telephone number) online to enter.
Only one entry per person per day will be accepted from entrants online. No scripting is allowed for online entries (which will be deemed invalid).
The time of entry for online entrants will be the time at which the completed online entry form is received by the Competition online database. Online entrants will be presented with a confirmation page once the completed email entry is submitted by the entrant.
Entries remain the property of the Promoter and will not be returned to the entrant. Entrants agree to grant the Promoter a perpetual and non-exclusive licence to use their entries in all media worldwide and acknowledge that they will not be entitled to any fee for such use.
PRIZES
There will be three (3) major winner of the Competition. The major prize winners will receive:
1 x $5,000 Accor Gift Card – value $5,000
TOTAL VALUE OF MAJOR PRIZE = $15,000
Total Combined Prize Value is: AU$15,000 (including GST). Prize value is correct as of 12 November 2010. The winner is not entitled to receive any money from any party if there is a difference between the maximum prize value and the actual prize value at the time of the draw.
It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and prize Sponsor’s requirements. Unless otherwise stated in these terms and conditions, prizes cannot be transferred or exchanged and all non-cash prizes cannot be redeemed for cash
All components of the prize, including accommodation are subject to availability, based on a limited allocation of rooms and may not be available during school holidays, holiday weekends or special events. In the event that any component of a Prize is unavailable for any reason, subject to State legislation, the Promoter reserves the right to substitute that prize component with another prize of equal value and the prize winner will be notified accordingly.
A Prize can be transferred to a person 18 years or over at the absolute discretion of the Promoter. However, it cannot be exchanged or redeemed for cash. If for any reason, a Prize Winner cannot take any component of the Prize and he/she does not wish to transfer the Prize, then the Prize will be forfeited. Each Accor gift card Prize is subject to the complete list of terms and conditions, as listed on the Sponsor’s website:
www.accorgiftcards.com.auAll transport, spending money, insurances, service charges, taxes, transfers and ancillary costs, including cost of travel to and from the airport and the property are not included. Gift Card credit can be used as payment towards accommodation and incidental food and beverage charges only.
If a Prize or receipt of it incurs a tax liability, the Prize Winner is liable for payment of such tax.
The Prize carries 12 months’ validity, and allows the Prize Winner to redeem the gift card credit from a list of 150 participating Accor hotels throughout Australia, New Zealand and Fiji. Accor brands include Sofitel; Pullman; MGallery; Grand Mercure; Novotel; Mercure; All Seasons and Ibis. Participating hotels may change from time to time.
The Accor Gift Cards will be valid for 12 months from date of draw.
In participating in the prizes, the winners agree to participate and co-operate as required in all editorial activities relating to the Competition, including but not limited to being interviewed and photographed. The winners grant the promoter a perpetual and non-exclusive licence to use such footage and photographs in all media worldwide and the winners will not be entitled to any fee for such use.
The winners agree that they will not and will ensure that their companions do not sell or otherwise make available their story and/or photographs to any media or other organisation.
Once accommodation is booked, any changes made to the booking may incur a cancellation fee or amendment fee, at the cost of the winner.
The prize cannot be altered in any way, is non refundable and cannot be redeemed for cash.
If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize of equal value and/or specification, subject to any written directions from a regulatory authority.
The Promoter accepts no responsibility for any variations in the value of the prize as quoted in the terms and conditions and the ultimate travel date.
Winners should seek independent financial advice about any tax implications that may arise from the prize winnings.
It is a condition of accepting the prize that the winners must comply with all the conditions of use of the prize and the prize supplier’s requirements.

HOW TO WIN
There will be three (3) winners of the Competition. Each entrant who has entered the Competition over the Competition Period and registered all details in accordance with clause 3 (“Qualifying Entrant”) will be entered into the prize draw.
The draw will take place at MNET Group Ltd, Level 2, 8 Leigh Street, Adelaide SA 5000 on Monday 6 December 2010 at 4.00pm (AEDT).
5.3 The winners may be announced in the Programs following the prize draw (subject to programming and Executive Producer’s decision). Winner will be notified by phone call within 2 days of the draw, their name published in the Public Notes section of The Australian Newspaper on Monday 13 December 2010 and a letter advising winners of their prize will also be mailed out upon acknowledgement of the prize.
5.4 The Promoter’s decision is final and the Promoter will not enter into correspondence regarding the result.
5.5 It is a condition of accepting the prize that the winners may be required to sign a legal release in a form determined by the promoters in its absolute discretion.
5.6 Subject to State legislation an unclaimed prize draw will take place at MNET Group Ltd at Level 2, 8 Leigh Street, Adelaide SA 5000 on Monday 21 March 2011 at 10.00am (AEDT) and the winner will be notified by phone call within 2 days of the draw, their name published in the Public Notes section of The Australian Newspaper of The Australian newspaper on Monday 28 March 2011.
NO LIABILITY
In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the Competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the Competition and recommence it from the start on the same conditions, subject to State Legislation.
Seven Network (Operations) Limited & affiliates, MNET Group Ltd, AAPC Limited and their associated agencies and companies will take no responsibility for prizes damaged or lost in transit, or late, lost or misdirected mail.
Seven Network (Operations) Limited & affiliates, MNET Group Ltd, AAPC Limited and their associated agencies and companies will not be liable for any misadventure, accident, injury, loss (including but not limited to consequential loss) or claim that may occur:
during the draw;
whilst undertaking any travel won on or connected with their entry into the draw; or
in the participation in any prize;
as a consequence of late, lost or misdirected mail;
due to the broadcast of any program relating to the Competition or the publication of any material, including any statements made by any compere, staff member, journalist, other entrants or any other person;
in relation to failure of an entry to be received by the promoter on account of technical problems or traffic congestion;
arising from or related to any problem or technical malfunction of any computer equipment, software, internet connection, any injury or damage to entrant's or any other person's computer software related to or resulting from participation in this Promotion;
if any flight is cancelled or rescheduled for any reason beyond the reasonable control of the Promoter; or
due to circumstances outside the Promoter’s reasonable control.
6.4 The Promoter reserves the right to reasonably amend or vary these terms and conditions at its sole discretion, orally or in writing, for the purpose of Seven’s programming, scheduling or production requirements, subject to State legislation.
6.5 The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the Promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
6.6 Seven Network (Operations) Limited and the Sponsors assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries, and reserves the right to take any action that may be available.
6.7 If for any reason this Competition is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of this Competition, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the Competition, subject to State legislation.
