Moet Party Moments Competition

1. Information on how to enter and prizes form part of these conditions of entry. Participation in this promotion is deemed to be acceptance of these terms and conditions of entry.

2. Employees of the Promoter and ACP Magazines Ltd and their immediate families, and agencies associated with this promotion are ineligible to enter.

3. The promotion commences on 22nd of December, 2010 and closes 5pm (AEDST) on the 15th of January, 2011. The judging will take place at the Promoter’s premises and will begin on the 17th of January, 2011. The winner will be notified by phone and mail. This is a game of skill; chance plays no part in determining the winner. Each entry will be individually judged, based on literary and creative merit and originality of the answer submitted. The promotion will be judged by a panel of judges, appointed by the Promoter. The winners will be notified by phone and mail using contact details provided in their entry. The judging of entries will take place at 175 Castlereagh Street, Sydney, and will begin on 17th of January, 2011.

4. To enter, individuals must visit http://www.harpersbazaar.com.au/parties.htm, follow the prompts to the competition entry page, input the requested details including their full name, address, email address, daytime telephone number and an answer to the question “What is your best party moment?” in 25 words or less, and submit the fully completed entry form between 22nd December and 5pm AEDST on 15th January 2011.

5. Multiple entries accepted but each entry must be submitted separately and must be unique.

6. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions will be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

7. The best valid entry as determined by the judges will win a MOET & CHANDON prize pack valued at $300. Each pack includes 1 x Magnum of Moët & Chandon Impérial, 6 flutes and an ice bucket.

8. Prize is not transferable, exchangeable or redeemable for cash or other goods and services. 9. If the prize (or part of the prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification.

10. Entries not completed in accordance with the rules and conditions, or received after the closing date, will not be considered. Indecipherable or incomplete entries will be deemed invalid. The judges’ decision in relation to any aspect of the competition is final and binding on every person who enters. No correspondence will be entered into.

11. Nothing in these Terms and Conditions limit, exclude or modify or purports to limit, exclude or modify the statutory implied guarantees/warranties as provided under the Trade Practices Act, ASIC Act, or the Competition and Consumer Act including the statutory consumer guarantees under the Australian Consumer Law or similar laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

12. Except for any liability that cannot be excluded by law, including the Non-Excludable Guarantees, the Promoter and ACP Magazines Ltd (Publisher of Harper’s BAZAAR magazine) (including its officers, employees and agents) excludes all liability (including negligence) for any personal injury; or any loss or damage (including loss of opportunity) whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these conditions of entry; (e) any tax liability incurred by a winner or entrant; (f) redemption of a prize and/or (g) participation in the promotion.

13. If for any reason this competition is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of this competition the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate. The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of entries..

14. All entries become the property of the Promoter. The promoter collects the personal information entered by the entrants on the entry form. This information is used for the purpose of this competition. The information may be disclosed to ACP Magazines Ltd. Individuals can access their personal information held by the Promoter by contacting ACP Magazines on 02 9282 8428. All entries submitted become the property of the Promoter. Entries will not be returned to any entrant. By entering this promotion, each entrant licences the Promoter to use their entry in any media for an unlimited period for any reason including but not limited to future promotional, marketing or publicity purposes. Each entrant warrants to the Promoter that each entry submitted is an original literary work of the entrant which does not infringe the rights of any third party. The entrant agrees to indemnify the Promoter against all claims and costs by third parties arising from a breach of the warranty set out in this condition. Entrants consent to any use of their entry which may otherwise infringe their moral rights pursuant to the Copyright Act 1968 (Cth). The Promoter is entitled to use any of the entries submitted for any purposes at its discretion, including (but not limited to) for any future promotion, marketing and publicity purposes. By entering the competition, the entrant consents to receipt of any email regarding the competition, and other emails which inform the entrant of the Promoter’s other publications, products, services and events and to promote third party goods and services it may be interested in, unless the entrant advises the promoter otherwise. Entrants should direct any request to access, update or correct information to the Promoter.
