SCHWEPPES NATURAL MINERAL WATER “CHRISTMAS ENTERTAINING” PROMOTION

TERMS AND CONDITIONS OF ENTRY


1.   Information on how to enter and prizes form part of these terms and conditions. Participation in this promotion is deemed acceptance of these terms and conditions.

2.   This promotion is open to residents of Australia aged 18 years and over. Directors, management and employees of the Promoter or the agencies or companies associated with this promotion and the immediate families of these persons are ineligible to enter.

3.   The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these terms and conditions or who tampers with the entry process including but not limited to tampering by way of use of techniques designed to avoid the payment of SMS. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

4.   Incomplete, indecipherable, or illegible entries will be deemed invalid.

5.   Promotional period commences at 6.00AM AEDST on 24th November 2010 and closes  at 5.00PM AEDST on 20th December 2010 (“Promotional Period”). 

6.   To enter, eligible entrants must, during the Promotional Period, purchase any product from the Schweppes Natural Mineral Range and either: (i) SMS the last five digits of the product barcode to 19 955 444 including their full name, address and postcode (Premium SMS cost is 55c); or (ii) go online to <a href="http://www.entertainmentlounge.com.au>www.entertainmentlounge.com.au[/url] follow the prompts to the competition entry page and submit all requested details.

7.   Multiple entries permitted, subject to the following: (a) only one (1) entry permitted per specified purchase requirement; and (b) each entry must be submitted separately and in accordance with entry requirements.

8.   Entrants must have premium service access. SMS helpline: 1300 464 866 SMS winners will be contacted by SMS and/or phone and the Promoter (ACP Magazines) will record their address details so that the prize may be awarded. SMS entries via the Internet are ineligible. Entries are deemed to be received at the time of receipt into the promotion database and NOT at the time of transmission by the entrant.


9.   The draw will take place at 10.00AM AEDST on 21st December 2010 at ACP Magazines, 102-108 Toorak Road, South Yarra Victoria 3141.  The major winner will be notified by telephone, in writing using contact details provided in their entry and their name will be published in the public notices section of The Australian on 30 December 2010.  The forty (40) runner-up winner’s will be notified in writing using contact details provided in their entry.

10.   There will be one (1) major winner and forty (40) runners up winners. The first valid entry drawn will be the major winner and will receive $5,000 awarded in the form of a cheque made in favour of the winner.  The next ten (10) validly drawn entrants will receive “The Australian Women’s Weekly Entertainment Cookbook” valued at $49.95.  The next thirty (30) validly drawn entrants will receive “The Australian Women’s Weekly 12 Days of Christmas Cookbook” valued at $12.95.

11.   Total prize pool is valued at $5,888.00.


12.   Prizes, or any unused portion of the prizes, are not transferable or exchangeable.


13.   If any runner up prize  is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize  with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.

14.   The Promoter may contact an entrant at any time after receiving an entry, including without limitation, during or after the Promotional Period or after the prize draw, for the purpose of determining whether the entrant meets the eligibility requirements.

15.   The Promoter may conduct such further draws, if any prizes remain unclaimed and still valid, at the same time and place as the original draw as are necessary at 11am AEDST on the 4th April 2011 in order to distribute any prizes which remain unclaimed by that date subject to all relevant state and territory authorities and any written directions given. Winners (if any) will be contacted in writing and by telephone and in the event of a prize over $250, their name will be published in The Australian on 7th  April 2011.

16.   The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.

17.   The Promoter and Schweppes Australia Pty Ltd are not responsible for any incorrect or inaccurate information, either caused by website users or by any of the equipment or programming associated with or utilised in this competition, or by any technical error that may occur in the course of the administration of this competition.  The Promoter and Schweppes Australia Pty Ltd assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to or alteration of entries.

18.   Any costs associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.  Any contact details entered incorrectly on the website will be deemed invalid.

19.   If for any reason this promotion is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupts or affects the administration security, fairness or integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion (subject to all relevant state and territory regulations) to cease the promotion with fair notification to the entrants. The form of such notification is at the complete discretion of the Promoter.

20.   Except for any liability that cannot be excluded by law, the Promoter and Schweppes Australia Pty Ltd (including its officers, employees and agents) exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorized access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these terms and conditions; (e) any tax liability incurred by a winner or entrant; or (f) redemption of the prize and/or participation in the promotion.

21.   All entries become the property of the Promoter. The collection use and disclosure of personal information provided in connection with this competition is governed by the Privacy Statement located within the contents page of all ACP Magazine Titles.

22.   The Promoter collects entrants’ personal information in order to conduct the promotion. If the information requested is not provided, the entrant may not participate in the promotion. Entrants’ personal information may also be disclosed to Schweppes Australia Pty Ltd for marketing purposes and to State and Territory lottery departments and winners’ names published as required under the relevant lottery legislation. A request to access, update or correct any information should be directed to the Promoter at the address set out below.

23.   By entering the promotion, the entrant consents to receipt of any email regarding the promotion, and other emails which inform the entrant of the Promoters’ other publications, products, services and events and to promote third party goods and services it may be interested in, including emails from Schweppes Australia Pty Ltd to promote, market and publicise Schweppes Australia Pty Ltd products.
