1. Information on how to enter and the prizes form part of these Terms and Conditions. By participating in this Promotion you accept these Terms and Conditions. This offer is not valid in conjunction with any other offer.
 
2. Entry is open to all residents of Australia aged 18 years or over who satisfy the entry requirements stated in these Terms and Conditions.
 
3. Employees (and their immediate families) of the Promoter and their respective agencies and subagents are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
 
4. Promotion commences 12:01am (AEDT) Friday 5th November 2010 and closes 11.59 pm (AEDT) on Friday 31st December 2010 (“Promotional Period”). The winners will be drawn by a computerised system at 12:00pm (AEDT) Monday 10th January 2011 at The Consortium Centre, 87 Egerton Street, Silverwater, NSW 2128. Winners will be notified by writing and phone. The prize winners will be published in the Public Notices section of The Australian newspaper on Friday 14th January 2011.  The Promoter’s decision is final and no correspondence will be entered into.
 
5. There are 3 prizes of a masterclass for 2 with Tobie Puttock in Sydney in February 2011 and a copy of his book “Cook Like an Italian”. Each of the 3 winners will also receive a travel voucher to the value of $1,000 to be used for travel and accommodation to the masterclass.Each prize is valued at a total of $3,000 each.  There will be no more than one winner within each State or Territory.
 
6. Winners must be able to attend the masterclass on any date nominated by the Promoter in February 2011
. If the winner is unable to attend the masterclass then this part of the prize will be forfeited and no recompense will be made.
 
7. The total prize pool is valued at $9,000.  The prize value is in Australian dollars. As there can only be a maximum of one winner per State or Territory and 3 prizes are available nationally, the maximum total prize pool per State or Territory is $3,000.The prize or any unused portion of a prize is not transferable or exchangeable and is not redeemable for cash.
 
8. To enter, during the Promotional Period entrants must purchase at least one Ferrero® Rocher gift box from www.ferreroboutique.com.au (“Website’) and follow the promotion links on the Website to fill in their details along with the promotional code from a participating magazine to be eligible to win a prize. The Website may not be available for access from time to time during the Promotional Period and all access to the Website is at the entrant’s risk.
 
9. The Promoter is not responsible if a participating product is unavailable for purchase on the Website.
 
10. All ancillary costs unless stated above are the winner’s responsibility.
 
11. Any cost associated with accessing the Website is the entrant’s responsibility and is dependent upon the Internet service provider used.
 
12. An entry without the required information as stated in these Terms and Conditions will be deemed incomplete and will not count towards an entry into the Promotion.
 
13. Only one entry per customer is permitted for the Promotion regardless of the number of gift boxes purchased. Multiple entries are not accepted.  As a result, only one prize will be awarded to any entrant whose valid entry is drawn. 
 
14. Any form of automated electronic entry that does not meet the entry requirements as per these Terms and Conditions will be deemed invalid and not counted as a valid entry.
 
15. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not properly completed or not in accordance with these Terms and Conditions or who tampers with the entry process.  Errors and omissions may be accepted at the Promoter’s discretion.  Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
 
16. All entry times are considered as the time the entry is received by the Promoter’s database.
 
17. Drawn entries will be checked for validity against these Terms and Conditions as they are drawn. Any entries deemed not valid will be discarded and the draw will continue until all prizes are allocated. In particular, if a winner is drawn from one State or Territory any further entries drawn from the same winning State or Territory will be discarded and the draw will continue until an entry is drawn from a non-winning State or Territory. This is to ensure that all 3 winners are from different States or Territories.
 
18. The Promoter reserves the right to substitute any part of the prize with a prize of equal or greater value if the prize is for some reason unavailable subject to gaming authority approval.
 
19. It is the entrant’s responsibility to advise the Promoter of any change of personal details.
 
20. Winners must take the prize as offered. Once any part of the prize has left the Promoter’s premises the Promoter is not  responsible for any late or misdirected prizes.
 
21. If a prize is unclaimed by 5pm AEDT on Friday 28th January 2011, a second draw by a computerised system will be held at 12:00pm (AEDT) on Monday31st January 2011 at the office of The Consortium Centre, 87 Egerton Street, Silverwater, NSW 2128 subject to any written directions given by the relevant state lottery and gaming regulators.  Winners of the second draw will be notified by writing and phone. The names of winners of the second draw will be published in the public notices section of The Australian newspaper on Wednesday 2nd February 2011.
 
22. The Promoter is not responsible for any incorrect or inaccurate information, either caused by an entrant or for any of the equipment or programming associated with or utilised in the Promotion, or for any technical error, or any combination thereof that may occur in the course of the administration of the Promotion including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.
 
23. The Promoter is not responsible for lost, late, incomplete, indecipherable, illegible or incorrect entries in the Promotion. The Promoter also accepts no responsibility for any tax implications that may arise from prize winnings in the Promotion.  An entrant should seek Independent financial advice about such matters.
 
24. If the Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law; (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to cancel, terminate, modify or suspend the Promotion.
 
(1) Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including for negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising out of, or related to, or in any way connected to the Promoter, the Promotion or the prize.  Winners consent to the Promoter using the winner’s name, likeness, image and/or voice in any media (including photograph, film and/or recording of the same) for an unlimited period without remuneration for the purpose of promoting www.ferreroboutique.com.au or any products manufactured, distributed and/or supplied by the Promoter. The winner agrees to participate in any news media activities surrounding the Promotion.
 
(2) The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, reward suppliers and, as required, to Australian regulatory authorities. It is condition of entry that an entrant provide the personal information requested and consent to the use of their  personal  information as specified in these Terms and Conditions. If an entrant does not provide the personal information and consent required, that entrant’s entry form will be invalid.
