"WIN AN OCCY SIGNED SURFBOARD" Game of Chance Competition CONDITIONS OF ENTRY
1. Competition
1.1. By entering the "Win an Occy Signed Surfboard" Game of Chance Competition (Competition) and in consideration for the opportunity to participate in the Competition, each entrant agrees to be bound by and observe these Conditions of Entry. Information on how to enter and prize details form part of the Conditions of Entry.
1.2 The promoter of the Competition is Premier Media Group Pty Limited ABN 16 065 445 418 of 55 Pyrmont Bridge Road, Pyrmont NSW 2009 (Promoter).
2. Who may enter
2.1. Entry into the Competition is open to all permanent residents of Australia aged 18 years or over.
2.2. Each participant may only submit one entry in the Competition.2.3. The officers, management and employees (and immediate family members of officers, management and employees) of the Promoter, its related corporations and associated agencies are not eligible to enter the Competition.
3. Competition Period
3.1 The Competition commences at 12:00pm Australian Eastern Daylight Time (AEDT) on 6 December 2010 and closes at 9am AEDT on 6 January 2011 (Competition Period).
3.2 Entries not received during the Competition Period or not completed in accordance with these Conditions of Entry will not be eligible to win.
4. How to enter
Eligible participants must, during the Competition Period:
(a) be or become a fan of the official Fuel TV Australia page on Facebook by clicking the "Like" button on the page, and continue to be a fan until the Draw Date (defined below); and
(b) go to the FOX SPORTS website (
www.foxsports.com.au/win), follow the link to the Competition and enter the details requested.
5. Draw, prize and notification
5.1. The Competition is a game of chance. All valid entries will be entered into the random draw.
5.2. The random computerised draw will be conducted by a representative of the Promoter at 55 Pyrmont Bridge Road, Pyrmont NSW 2009 at 12:00pm AEDT on 6 January 2011 (Draw Date).
5.3. The participant with the first valid entry drawn will win:
(a) one FUEL TV surfboard signed by Mark "Occy" Occhilupo (valued at $800);
(b) one FUEL TV towel (valued at $50);
(c) one FUEL TV stubby holder (valued at $15);
(d) one cap (valued at $30); and
(e) one t-shirt (valued at $40).
5.4. The total prize value is A$935 (including GST).
5.5. The prize winner will be notified via telephone and in writing on 6 January 2011. If the prize winner wins over $250 in prizes, the prize winner"s name will be published in the Public Notices section of The Australian newspaper on 13 January 2011.
5.6. The Promoter accepts no responsibility for any variation in the value of a prize. Prizes are not transferable or exchangeable. Prizes are not redeemable for cash or kind and must be taken as offered. In the event that any element of the prize is not available, the Promoter reserves the rights to substitute a prize of equal or greater value, subject to written directions from State regulatory bodies.
5.6. The prize winner is responsible for all expenses not specified in these Conditions of Entry.
5.7. The prize winner acknowledges that the prize may be subject to additional terms and conditions imposed by third party prize suppliers. The prize winner must become acquainted with any such additional terms and conditions prior to taking the prize. The Promoter does not accept responsibility and is not liable for any additional conditions imposed on the taking of the prize or the breach of those conditions by any person.
5.8. If for any reason the prize winner does not take an element of the prize during the stated period and on the conditions stipulated by the Promoter or any third parties, then that element of the prize will be forfeited and cash will not be awarded in lieu of that element of the prize.
5.9. No single prize will be valued at over AUD$1,000 and the total prize value of the promotion will not exceed AUD$100,000.
6. Unclaimed prizes
6.1 If a prize is unclaimed by 5:00pm Australian Eastern Standard Time (AEST) on 6 April 2011, a random computerised second chance draw will be conducted for all unclaimed prizes by a representative of the Promoter at 55 Pyrmont Bridge Road, Pyrmont NSW 2009 at 9:00am AEST on 7 April 2011, subject to written directions from State regulatory bodies.
6.2 The winner of the second chance draw, if any, will be notified by telephone and in writing on 7 April 2011. If the prize winner wins over $250 in prizes, the prize winner"s name will be published in the Public Notices section of The Australian newspaper on 14 April 2011.
7. Information for prize winner
All entrants agree to provide the Promoter or the Promoter"s authorised agent with identification and/or proof of age if selected as a prize winner. By accepting a prize, the prize winner agrees to the release set out below. The form of identification and/or proof of age are at the discretion of the Promoter.
8. Release
To the full extent permitted by law, the Promoter and its associated companies and agencies and any of their personnel exclude all liability for any loss (including any damage, claim, injury, cost or expense) which is suffered or incurred by any entrant in connection with the Competition or prizes, including, without limitation: (i) any indirect, economic or consequential loss; (ii) any loss arising from the negligence of the Promoter and their associated companies and agencies and any of their personnel; (iii) any liability for personal injury or death.
9. Limitation of Liability
9.1 The Promoter makes no representation or warranties as to the quality, suitability or merchantability of any of the goods or services offered as the prize. If the Promoter is liable for any claim by a prize winner, including a claim arising from the Promoter"s negligence, the Promoter"s liability for any such claim will not exceed the value of the prize won as set out in these Conditions of Entry.
9.2 The Promoter is not liable for the cancellation of all or any part of the prize, for any reason.
10 Privacy
By entering the Competition, the entrant understands and agrees that the Promoter may use and disclose the entrant"s personal information to assist in conducting the Competition or communicating with the entrant regarding special offers from the Promoter. Entrants in the Competition acknowledge that the Promoter may share an entrant"s personal information with the Promoter"s Australian related entities which may contact the entrant with special offers. If an entrant elects to receive information from third parties, the Promoter may also disclose the entrant"s personal information for that purpose. The Promoter is bound by the National Privacy Principles in the Privacy Act 1988 (Cth). The Promoter"s Privacy Policy is available at

Entrants can access the personal information the Promoter holds about them, notify the Promoter that they do not wish the information to be disclosed or notify the Promoter that they do no wish to receive further promotional material by writing to the Promoter at 55 Pyrmont Bridge Road, Pyrmont NSW 2009.
11 General
11.1 All entries must be original to and created solely by the entrant. All entries into the Competition and all copyright and other rights in such entries and/or other materials become the property of the Promoter and will not be returned. Each participant agrees to provide a written assignment of all rights to the Promoter if requested. By submitting an entry into the Competition and any other materials (other than any personal information) to Promoter in connection with the Competition, each participant:
(a) specifically authorises Promoter to use and/or license third parties to use such entry in whole or in part, throughout the universe, in perpetuity in or on any and all media, whether currently in existence or developed in the future, and alone or together or as part of other information, content and/or material of any kind or nature; and
(b) represents and warrants that all elements contained in the Competition entry or other material:
(i) are original to the participant and fully cleared for use as contemplated in these Conditions of Entry;
(ii) do and will not, in any way, violate or breach any of the terms of any other agreement the participant may be a party to;
(iii) do not contain defamatory, tortious, or otherwise unlawful, untrue or inaccurate information, infringe or violate any copyright or other right, or contain any matter the publication or sale of which will violate any federal or state statute or regulation;
(iv) are not obscene or in any other manner unlawful or likely to cause offence;
(v) are not in any way cruel nor abusive; and
(vi) will not require the Promoter to pay or incur any sums to any person or entity as a result of the Promoter"s use or exploitation of the same; and
(c) unconditionally and irrevocably consents to any act or omission which would otherwise infringe any of their moral rights in the entry and waives all moral rights in the entry that arise outside Australia.
11.2 Acceptance of the prize constitutes consent on the prize winner"s part to allow the use of the prize winner"s name, image, voice and/or likeness by Promoter for editorial, advertising, promotional, marketing and/or other purposes without further compensation except where prohibited by law.
11.3 The Promoter"s decision is final and binding. No correspondence will be entered into.
11.4 The prize remains the property of the Promoter until it is collected by the selected prize winner or unclaimed prize winner as the case may be.
11.5 If for any reason the Competition is not capable of running as planned due to any causes beyond the Promoter"s control, including infection by computer virus or bugs, tampering, technical failure, emergency or disaster, the Promoter reserves the right in its sole discretion to cancel, modify, terminate or suspend the Competition, subject to written directions from State regulatory bodies.
11.6 The Promoter reserves the right to disqualify any individual who conspires with others to gain an unfair advantage or who is otherwise involved in manipulating, interfering or tampering with the entry process or any other element of the Competition. The use of any automated entry software or any mechanical, electronic or other means which allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
11.7 Neither the Promoter nor its authorised agents will take responsibility for lost, ineligible, misdirected or late entries due to technical reasons, telecommunications issues or any other reason. Entries that are not genuine, are incomplete or late or are in any way fraudulent will be declared void.
11.8 Prize winners are responsible for all taxes (excluding GST) which may be payable as a consequence of receiving a prize.

12.1 It is the entrant"s responsibility to inform the Promoter of any change to the entrant"s contact details, including their email address.
