Ten Days on the Island 2011 Competition
TERMS AND CONDITIONS
1.Information on how to enter forms part of the terms of entry. Entry into the competition is deemed acceptance of these terms and conditions.
Method of Entry
2.Subject to the following terms and conditions, entry is only open to New South Wales residents aged 18 years or over (“Eligible Entrants”). All employees and their immediate families of the Promoter and related corporations and agencies associated with this promotion are ineligible to enter.
3.The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
4.To enter the competition, participants must register onto
www.tendaysontheisland.com/competition and complete the entry form found on the website. All Eligible Entrants must provide their details, including (but not limited to) name, address, postcode, phone number and e-mail address.
5.All entries must comply with all applicable laws and become and remain the property of the Promoter. Entries including infringing, offensive or inappropriate material will be deemed invalid.
The Competition
6.The competition commences on 24 November 2010 at 10am (AEST) and concludes 7 February 2011 at 5pm (AEST).
7.All valid entries will be entered into the competition. The draw will take place on 9 February 2011 at Ten Days on the Island’s Hobart Office, Level 5, 147 Macquarie Street, Hobart, 7000 at 10am (AEST). The Promoter’s decision in relation to any aspects of the competition is final and no correspondence will be entered into.
8.Online entries are limited to one entry per email address and must be in accordance with the entry requirements and there will only be one prize package provided.
9.Entries will be deemed to be accepted at the time of receipt and not at the time of transmission. Incomplete or incomprehensible entries will be deemed invalid.
10.The winner will be advised by phone and email on the 9 February 2011 at 12noon. The name of the winner will be published on the
www.tendaysontheisland.com/competition on 10 February 2011. In the event that the winner cannot accept the prize (for whatever reason) the prize will be forfeited by that winner and an unclaimed prize draw will be conducted. The prize cannot be transferred to another person unless agreed by the Promoter.
11.If the Prize remains unclaimed, the Promoter shall conduct such further draws as may be deemed necessary at 5pm (AEST) on 16 February 2011 at Ten Days on the Island’s Hobart Office, Level 2, 22 Elizabeth Street, Hobart, 7000, in order to distribute the prize unclaimed by that date, subject to approval of any relevant gaming authority.
12.The winner’s name will be published on the
www.tendaysontheisland.com/competition on 17 February 2011. No responsibility will be taken for lost, incomplete, incorrectly submitted, delayed, corrupted or misdirected entries, claims or correspondence destruction, transmission interruption, communications failure or otherwise. The promoter has no control over communication networks or lines and accepts no responsibility for any problems associated with them, whether due to traffic congestion, technical malfunction or otherwise. The Promoter is not liable for any consequences of user error including (without limitation) cost occurred.
Grand Prize
13.The first valid entry drawn, as determined by the Promoter in its absolute discretion, will win a holiday to Tasmania for 2 adults (“The Prize”).
14.The Prize comprises of 3 day/2 night weekend package (“the Package”) for 2 adults. The Package includes: 2 nights twin share at The Henry Jones Art Hotel, including continental breakfast each morning checkin 25 March 2011 checkout 27 March 2011; 2 VIP tickets to Animal Farm at the Theatre Royal on Friday 25 March 2011 at 7.30pm; 2 tickets to VIP drinks reception at City Hall Hobart on Friday 25 March 2011 at 9pm; 2 VIP tickets to DBR & DJ Scientific with Emeline Michel at City Hall Hobart on Friday 25 March 2011 at 9.30pm; 2 VIP tickets to Power Plant at the Royal Tasmanian Botanical Gardens on Saturday 26 March 2011 at 8pm; a choice of either 2 VIP tickets to Mimotaur on Bruny Island on Sunday 27 March 2011 at 12.30pm or Ringing the Changes at Port Arthur Historic Site on Sunday March 2011 at 2.30pm; car hire for 3 days pick up Hobart Airport 25 March 2001, drop off Hobart Airport 27 March 2011 and 2 return economy flights for 2 adults from Sydney to Hobart, departing Sydney 25 March 2011 and returning 27 March 2011.
15.Car hire prize is subject to standard rental conditions. Petrol is the responsibility of the winner. One of the winning party must be 21 years of age or over and hold a current Australian driver’s licence (which is not under suspension or cancellation) as at the date on which the driver is to drive the vehicle.
16.Unless expressly stated in these terms and conditions the Prize Winners are responsible for all other expenses including but not limited to spending money, meals, drinks, transfers, laundry charges, activities, incidentals, taxes, energy surcharges, gratuities, services charges, travel insurance and all other ancillary costs. Travel insurance is highly recommended to protect against the additional costs incurred in the event of unforeseen circumstances.
17.The Holiday Prize winner and travelling companion (“the Prize Winners”) must travel from the same place and at the same time. The Prize Winners are responsible for arranging at their own cost and expense all transport to and from their principal place of residence to Sydney airport.
18.The Prize is only valid for travel the weekend commencing Friday 25 March and concluding Sunday 27 March 2011 and is not valid for any travel other than the dates specified above. If travel has not been redeemed within this time period, tickets shall be deemed null and void. The prize must be booked through Tourism Tasmania with advanced notice of a minimum of two weeks.
19.The prize cannot be changed once the booking has been confirmed by the Promoter or its agents with the prize winner. The prize must be taken as offered and cannot be varied. In the event for any reason a winner does not take an element of the prize at the time stipulated by the Promoter then that element of the prize will be forfeited by the winner and cash will not be supplied in lieu of that element of the prize. Where a prize is unavailable for any reason, the Promoter may substitute for that prize another item of equal or higher value as determined by the Promoter, subject to the approval of the gaming authorities, where required. The total prize package is valued at $3000. Prize values are GST inclusive and are in Australian dollars. Prize values are the recommended retail value as provide by the supplier and are correct at time of printing. The Promoter accepts no responsibility for any variation in prize value. The prize does not include insurance, spending money, incidental costs or any other costs of a personal nature not stated.
Release from Liability
20.The Promoter and its associated agencies shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect, special or consequential loss or loss of profits), expense, damage or for any personal injury or death suffered or sustained (whether or not arising from any persons negligence) in connection with this competition or accepting or using any prize/s, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
Personal Information
21.The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including but not limited to prize suppliers and Australian regulatory authorities (where required). Entry is conditional on providing this information. Unless otherwise advised, the Promoter may also use the information for promotional, marketing and publicity purposes including sending electronic messages. Entrants should direct any requests to access update or correct information to the Promoter.
