TERMS AND CONDITIONS
 

Acceptance of conditions
1.  Information regarding prizes and how to enter forms part of these conditions. By entering, entrants accept these conditions.


Restrictions on entry
2.  Entry is open only to Australian residents aged 16 or over, except directors, management and employees (and the immediate families of directors, management and employees) of Mazda Australia Pty Limited (and its related corporations) and Mazda Australia Pty Limited's advertising and sales promotion agencies.

3.  By entering, all entrants confirm that they are:

(a) capable of riding in a group and are adequately experienced in doing so regularly for distances of at least 60km; and

(b) of a high level of fitness (as the training ride will be at least 60km in duration)


Prize details
4.  The four best ’25 words or less’ statements, as chosen by the Promoter, will win an training ride with Mark Renshaw. There are two training ride days – one in Melbourne and one in Sydney. Two winners will be assigned to both of the training rides according to the preference indicated by the entrant on the entry form. The training rides will take place on Friday 7 January 2011 in Melbourne (Melbourne Major Prize) and on Wednesday 26 January 2011 in Sydney (Sydney Major Prize).

5.  No travel costs or expenses are covered in the prize; entrants must cover their own costs in reaching and attending the training ride locations for both the Melbourne Major Prize and Sydney Major Prize.

6.  All four winners will also receive a prize pack including a Mazda and Columbia HTC cycling kit.

7.  Each Major Prize is valued at approximately $500.00 (inc GST) each for a total prize pool of $2000.00 (inc GST).

8.  The Promoter has absolute discretion to alter when and where this event is held .


Duration of competition
9.  The Melbourne Major Prize competition begins at 17.30pm AEST on 02 December 2010 and closes at 12:00am AEST on Wednesday 22 December 2010.

10.  The Sydney Major Prize competition begins at 17.00pm AEST on 02 December 2010 and closes at 12:00am AEST on Friday 14 January 2011 (Sydney).

11.  Together, this is the Competition Period.


Method of Entry
12.  To enter, consumers must visit www.mazda.com.au and click on the ‘Community’ tab at the top of the page. There is a topic titled ‘Competitions’ in the drop down menu. After selecting this, customers click on ‘enter the competition.’ Then, consumers must answer the following question in 25 words or less

‘Tell us in 25 words or less your favourite place to ride and why.’

13.  Entries must be received during the Competition Period.

14.  Consumers may enter this competition multiple times, but may only submit one entry per day during the Competition Period.

15.  The Promoter accepts no responsibility for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, claims or correspondence whether due to error, omission, alteration, tampering, deletion, theft, destruction, transmission interruption, communications failure or otherwise. The Promoter has no control over mobile telephone, email or internet communications, networks or lines and accepts no responsibility for any problems associated with them, whether due to traffic congestion, technical malfunction or otherwise. The Promoter is not liable for any consequences of user error including (without limitation) costs incurred.


Judging of entries
16.  Entries not fully complying with these conditions of entry may be deemed invalid at the Promoter’s discretion. This is a game of skill; chance plays no part in determining the winners. Each valid entry will be individually judged (by representatives of the Promoter) based on, among other things, creative merit and capturing the essence of the Mazda brand. The judges' decisions are final and no correspondence will be entered into.


Intellectual property
17.    All entries become the property of the Promoter and will not be returned to the entrant. Each entry must be the entrant’s original idea . By entering this competition entrants:

(a) consent to the Promoter publishing their entry and otherwise exploiting the entry and any rights in relation to the entry, to publicise this competition or for any other purposes; and

(b) undertake to the Promoter that their entry is not, and its use by the Promoter will not be, in breach of any third party intellectual property rights.
 

Publicity
18.  The winners must, at the Promoter’s request, participate in all promotional activity (such as publicity and photography) surrounding the winning of the prize, free of charge, and the Promoter may use their name and image in promotional material.


Notification of winners & Unclaimed Prizes
19.  The Major Prize winners will be announced on http://www.mazda.com.au/ on Wednesday 22 December 2010 (Melbourne Major Prize) and 14 January 2010 (Sydney Major Prize) and notified privately by phone and email provided in entry form.

20.  If the winners of the Melbourne Major Prize is unable to be located by 12:00am AEST on 26 December 2011 and 16 January 2011 for the Sydney Major Prize winners, or the prize remains unclaimed by 12:00am AEST on 26 December 2011 (Melbourne Major Prize) and 16 January 2011 (Sydney Major Prize), that winner’s entry will be deemed invalid and the Promoter reserves the right to distribute the prize to the next best valid entry.

21.  The entrant acknowledges that these dates and timelines are crucial to ensure that tickets and attendance lists can be finalised before the event.


Awarding prizes
22.  The Promoter may require winners to provide proof of identity, proof of age and proof of residency at the nominated prize delivery address. Identification considered suitable for verification is at the Promoter’s discretion.


Disqualification of entries
23.  The Promoter may, in its sole discretion, disqualify all entries from, and prohibit further participation in this competition by, any person who tampers with or benefits from any tampering with the entry process or with the operation of the competition or acts in violation of these conditions, acts in a disruptive manner or acts with the intent to annoy, abuse, threaten or harass any other person.

24.  This Promotion is in no way sponsored, endorsed or administered by, or associated with Facebook. You understand that you are providing your information to the Promoter and its partners and not to Facebook.


Changes in prize value
25.  The Major Prize is not transferable or exchangeable (without express written permission of the Promoter) and cannot be redeemed for cash. In the event, for any reason, the Major Prize winners do not or cannot take an element of the prize at the time stipulated by the Promoter then that element of the prize will be forfeited by the winners and cash will not be supplied in lieu of that element of the prize. The Promoter accepts no responsibility for any variation in prize value. Where a prize is unavailable for any reason, the Promoter may substitute for that prize another item of equal or higher value as determined by the Promoter.


Exclusion of liability
26.  The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this competition or accepting or using any prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).

27.  Without limiting the previous paragraph, the Promoter and its associated agencies and companies will not be liable for any damage in transit to prizes.

28.  All Participants, as a condition of participation in this Promotion, agree to release the Promoter and Facebook from and against any and all liability, claims or actions of any kind whatsoever for injuries, damages, or losses to persons or property which may be sustained in connection with: (a) accessing the promotion (b) submitting an entry or participating in the promotion (c) the receipt, ownership or use of any prize awarded (d) any download (e) while preparing for, participating in or travelling to or from any prize-related activity, or (f) any typographical or other error in these terms and conditions or the announcement of offering of any prize.


Problems affecting competition
29.  If for any reason the event that is the subject of the Major Prize is cancelled or can’t run, the Promoter may, in its sole discretion, terminate, modify or suspend the competition or the awarding of the Major Prize or offer an alternative prize of equal or greater value.

30.  If for any reason any aspect of this competition is not capable of running as planned, including by reason of infection by computer virus, mobile network failure, bugs, tampering, unauthorised intervention, fraud, technical failures or any cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this competition, the Promoter may in its sole discretion cancel, terminate, modify or suspend the competition, or invalidate any affected entries.


Tax statement
31.  The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought. Where the operation of this competition results in, for GST purposes, supplies being made for non-monetary consideration, entrants agree to follow the Australian Taxation Office’s stated view that where the parties are at arm’s length, goods and services exchanged are of equal GST inclusive market values.


Privacy statement
32.  All entries will be the property of the Promoter. The information entrants provide will be used by the Promoter for the purpose of conducting this competition. The Promoter may disclose entrants’ personal information to its contractors and agents to assist in conducting this competition or communicating with entrants.

33.  The Promoter is bound by the National Privacy Principles in the Privacy Act 1988. Entrants can request access to the personal information the Promoter holds about them by contacting the Promoter at the below address.

34.  By entering this competition, the entrant consents to the storage of their personal information on the Promoter’s database and the Promoter may use this information for future promotional and marketing purposes regarding the Promoter’s products including contacting the entrant via electronic messaging. The Promoter may disclose personal information to contractors (such as mailing houses and IT providers) who require access to that information to perform services for the Promoter.
