Sportscover „Kick for Cash‟ Promotion
WIN $50,000 for you and $50,000 for your Hyundai A-League Club
1. Information on how to enter and the Prize form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
2. The competition is open to Australian & New Zealand residents who fulfill the entry requirements. Employees of the Promoter (“The Promoter”) and their Immediate Family Members (see clause 26) and agencies directly associated with this promotion are ineligible to enter. To be eligible for the prize, entrants must be able to participate in the prize on the date, time and venue specified by the Promoter (see Paragraphs 8 and 9).
3. To enter, participants must:
i. Be a current member of one or more of the Hyundai A-League Clubs, being Sydney FC, Melbourne Victory, Melbourne Heart, Central Coast Mariners, Brisbane Roar, Gold Coast United, North Queensland Fury, Newcastle Jets, Perth Glory, Adelaide United and Wellington Phoenix;
ii. Complete the form online with details including name, contact details, Club supported and membership number;
iii. Refer a minimum of one (1) friend for Hyundai A-League Club membership who are not members of any other Hyundai A-league Clubs; and
iv. In 25 words or less, submit an answer to the following question: “What is the best thing about being a Member of your Hyundai A-League Club?”4. Promotion commences 1 October 2010 and concludes on the 23 January 2011. (Promotion Period)
5. Entries that are, or include, obscene, offensive, defamatory, inappropriate, unsuitable, or infringing content as determined by the Promoter at its sole discretion will be deemed invalid and are not eligible to win. Incomplete or incomprehensible entries will also be deemed invalid and disregarded.
6. This is a game of skill and chance plays no part in determining the winner. Each valid entry will be individually judged by a panel of judges (made up of representatives of the Promoter) based on literary and creative merit, brevity and originality as determined by the panel of judges. The Promoter's decision in this matter is final and no correspondence will be entered into.
7. Judging will take place at 11:00am (EDST) on 24 January 2011 at the premises of Football Federation Australia, Level 22, 1 Oxford St, Darlinghurst, NSW, 2010. The major winners will be notified by phone and/or email within two (2) days.
8. There will be eleven (11) Prizes made up of one (1) Prize for each Hyundai A-League Club. Each prize winner will receive the following:
i. The opportunity to kick a ball at a target (”the Game”) at the Prize Winner‟s corresponding Club home match (the match which corresponds to their Hyundai A-League Club membership) with a chance to win $50,000 for themselves and a further $50,000 for their corresponding Hyundai A-League Club. The selected Club home matches are listed below;

ii. One Club supporter kit consisting of the Prize Winner‟s corresponding Club‟s cap, scarf and bag
iii. Four (4) category A match tickets to the Prize Winners corresponding Club home match as outlined in Paragraph 8 (i)
9. The conditions of the Game will be determined at the sole discretion of the Promoter and include, without limitation, the following;
i. Ball and target supplied by the Promoter. The ball shall be of regulation size and weight. (The weight being between 420 grams and 445 grams. The circumference being between 68 cms and 70 cms and the target hole size will be 25cm in diameter and 78.57cm in circumference.
ii. Only one attempt allowed to kick the ball to the target;
iii. No practice attempts will be permitted;
iv. Once the Game has started any contact by the winner or their Proxy (see 9viii below) with the ball is the kick;
v. Ball must pass completely through the target without bouncing or hitting any other object from the origin of the kick. The kick will be taken from the equivalent distance as the penalty spot is to the goal (11 metres). At the time of the kick the ball must be on the ground and stationary;
vi. The position of the hole in the target will be determined by Sportscover;
vii. Unless previously arranged with the Promoter under Paragraph 9 (vii) of these conditions, the winner cannot nominate a replacement to participate in the Game
viii. Current and former professional or semi-professional players (including State Premier League), and current and former coaches at an Olympic, international or national level (in the last 5 years) are ineligible to play the Game;
ix. If the winner is excluded from the Game on the basis of a physical disability or are not otherwise physically being able to participate in the Game they may nominate another person who is an Immediate Family Member (see clause 26) as their Proxy (“Proxy”) to participate in the Game but only by prior arrangement with the Promoter, and at the Promoter‟s sole discretion. The Substitute nominated must satisfy the conditions of the Game as determined at the sole discretion of the Promoter, including without limitation conditions 9 (i) – (viii)
10. The total prize pool is valued at up to $1,130,250 depending on each prize winner‟s home Club. Prize values are the recommended retail value and are correct at time of printing. All prize values are in Australian dollars unless otherwise stated. The Promoter is neither responsible nor liable for any change in the value of a prize occurring between the publishing date and the date the prize is claimed.
11. The Prize winners are responsible for all costs not expressly listed in paragraph 9, including without limitation, entertainment, gratuities, travel, ground transportation to
activities, visas, passports, travel insurance, extra meals and drinks, items of a personal nature, hotel incidentals such as telephone, internet, mini bar, laundry, fax and room service, freights, excess baggage, government taxes, any tax liabilities, airline and airport charges, any applicable surcharges and any other related costs.
12. Prize winners may be required to sign an indemnity in a form approved by the Promoter in favour of the Promoter and all involved parties prior to participating in the prize. If they do not sign that indemnity form, they will not be able to participate in the Game.
13. It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and the Promoters reasonable requirements including Football Federation Australia‟s match day Terms of Admission and Spectator Code of Conduct (available at
www.footballaustralia.com.au).
14. If for any reason a winner does not take a prize or an element of a prize at the time stipulated by the Promoter, then the prize or that element of the prize will be forfeited and will not be redeemable for cash. The Promoter‟s decision is final and binding – no correspondence will be entered into.
15. Subject to the terms and conditions of the participating prize provider(s), if for any reason a winner does not, once the prize has been booked, take the prize or an element of the prize at the time stipulated, then the prize or that element of the prize will be forfeited and will not be redeemable for cash.
16. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
17. In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion, subject to any written directions from a relevant regulatory authority.
18. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
19. The Promoter reserves the right to request verification of age, identity, residential address of winners and any other information relevant to entry into or participation in
this promotion. Verification is at the discretion of the Promoter, whose decision is final. If the documentation required by the Promoter is not received by the Promoter (or its nominated agent) or the winning entrant has not been verified or validated to the Promoter‟s satisfaction within the time requested, that winner‟s entry will become invalid. The prizes will only be awarded following any winner validation and verification that the Promoter requires at its sole discretion. The Promoter reserves the right to disqualify any individual who is involved in any way in interfering or tampering with the conduct of this promotion, who submits an entry that is not in accordance with these Terms and Conditions or if the entrant is engaged in any unlawful or other improper misconduct, calculated to jeopardize the fair and proper conduct of the promotion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
20. The Promoter (including its officers, employees and agents) excludes all liability (including any liability on the part of the Promoter), for any personal injury or any loss or damage (including loss of opportunity) whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter‟s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize. By entering this promotion, entrants agree not to bring any claim or proceeding against Promoter for any damage, loss, injury or liability they may suffer in participating in this competition or otherwise connected with accepting and performing the major prize.
21. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event that they are a winner in any media for an unlimited period of time without remuneration for the purpose of promoting this promotion (including any outcome) and/or promoting any products, events, or services of the Promoter.
22. All entries submitted become the property of the Promoter. As a condition of entering into this promotion, entrants agree to assign all of their rights, and interest (including copyright) in and to their entry to the Promoter and consent to the Promoter using the entry in any manner the Promoter wishes (including modifying, adapting or publishing the entry in whole or in part or not at all), by way of all media,
including, without limitation, posting their entry (whether in original form or a modified or adapted by the Promoter as permitted under this paragraph) on the Promoter‟s website without payment to the entrant (of royalties, compensation or otherwise). Each entrant warrants to the Promoter that each entry submitted is an original creative work of the entrant, which does not infringe the rights of any third party. Entrants agree to indemnify the Promoter against all costs and claims by third parties arising from a breach of this warranty and consents to any use of their entry which may otherwise infringe their moral rights pursuant to the Copyright Act 1968 (Cth).
23. The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including, but not limited to, prize suppliers, promotional partners, and as required, to Australian regulatory authorities. Entry is conditional on providing this information. Unless otherwise advised, the Promoter may also use the information for promotional, marketing and publicity purposes including sending electronic messages. Entrants should direct any request to access, update or correct information to the Promoter. All personal information collected will be subject the Promoter's Privacy Policy, which is available at
www.footballaustralia.com.au. All entries become the property of the Promoter.
24. Any term in these Terms and Conditions that is either wholly or partly unenforceable will be severed to the extent necessary to make the remaining terms of these Terms and Conditions enforceable.
25. The “Promoter” as defined in these terms & conditions is Football Federation Australia Limited (ABN 28 106 478 068) of Level 22, 1 Oxford St, Darlinghurst, NSW, 2010.
26. For the purposes of clauses 2 and 9 vii, the term “immediate family” means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grand parent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister.
