OfficeMax® Christmas in January Competition Terms & Conditions

HOW TO ENTER

To be eligible to enter into the judging, individuals must enter the Christmas in January competition within the allotted time between 1/12/10 and 11:59pm on 5/01/11.  Only individuals from NSW, VIC, SA, ACT, QLD, TAS, NT and WA will be eligible to enter.

To enter the competition, individuals must:

   1. Visit the OfficeMax® Facebook fan page
   2. “Like” the page to unlock the entry form on the Christmas Party tab
   3. Complete all required fields within the entry form including:
          a. Name
          b. Email address
          c. Office postcode
          d. Favourite Christmas party story
          e. Confirm that they are over 18 years of age and accept the competition Terms & Conditions by checking the box

COMPETITION JUDGING

   1. This competition is a game of skill and chance plays no part in determining the winner. The winner will be judged based upon the Christmas party story submitted via the entry form.
   2. Judging will take place at Next Digital, Level 4, 241 Castlereagh Street, Sydney, NSW 2000 on 6/01/11 at 12 noon. The Promoter’s decision is final and no correspondence will be entered into.

TERMS AND CONDITIONS

   1. Information on how to enter and the prize form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
   2. Entry is only open to Australian residents who are currently employed at an Australian address, and are able to take the prize on the 25/01/2011.
   3. The maximum number of party attendees for the party will be no greater than 50.
   4. The winner must be at least 18 years of age
   5. Employees (and their immediate families) of the Promoter, and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
   6. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
   7. Multiple entries are not permitted. There is a limit of one entry per person. If an entrant is found to enter more than once into the competition all of their entries may be deemed invalid at the Promoter’s discretion.
   8. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
   9. The Promoter will record entrants’ address details so that the prize may be awarded. Entries are deemed to be received at the time of receipt into the promotion database and NOT at the time of transmission by the entrant.
  10. Promotion commences on 1/12/10. Entries for the prize judging close at 11.59pm AEST on 05/01/11.
  11. The prize judging will take place at Next Digital, Level 4, 241 Castlereagh Street, Sydney, NSW 2000 on 06/01/11 at 12 noon. The Promoter reserves the right to judge additional reserve entries and record them in order in case the entrant’s data is insufficient.
  12. The prize winner will be notified in writing and their name will be published in The Australian on 15/01/11.
  13. The Promoter’s decision is final and no correspondence will be entered into.
  14. The competition will be promoted via online display advertising. All advertising will include access to view a link to the full terms and conditions.

PRIZE

   1. The winner will win an OfficeMax® Christmas Party in January to the value $5,000. The winner will be able to choose from the following party options: a) Wii party b) Karaoke c) Winery tour  d) Cocktail party e) BBQ masterclass. The specific party venue will be nominated at the discretion of the promoter
   2. Subject to the discretion of the Promoter, if for any reason the winner does not take the prize or an element of the prize at the time stipulated, then the prize or that element of the prize will be forfeited and will not be redeemable for cash.
   3. In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion, subject to any written directions from a relevant regulatory authority.
   4. If the prize remains unclaimed by 9am AEST on 12/01/11 an unclaimed prize judging will take place at 12 noon on 12/02/11. The valid entry judged and successfully contacted by phone and in writing will win the prize. If the unclaimed prize judged winner cannot be contacted within 24 hours, this condition will apply to subsequent judging until a prize winner is determined. Results will be published in The Australian on 4/02/11.
   5. Subject to the unclaimed prize judging clause, if for any reason a winner does not take the prize or an element of the prize by the time stipulated by the Promoter, then the prize or that element of the prize will be forfeited.
   6. If the prize (or part of the prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
   7. The prize, or any unused portion of the prize, is not transferable or exchangeable and cannot be taken as cash.
   8. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
   9. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
  10. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
  11. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use/taking of the prize.
  12. As a condition of accepting the prize, the winner may be required to sign legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
  13. The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter by using the Promoter’s details as specified in clause 14 below. All entries become the property of the Promoter.
