Information on how to enter forms part of these conditions of entry. Participation in this Promotion constitutes acceptance of these conditions of entry.

Entry to the Promotion is open to all Australian residents aged 21 years and over who have a current passport which is valid for at least 6 months from 28/02/2011, who are able to take the prize on the specified dates (see condition 11) and who fulfil the entry requirements. Directors, management, employees, officers and contractors (and their immediate families) of the Promoter or of the agencies or companies associated with this Promotion are ineligible. “Immediate families” means spouse, parent, natural or adopted child, and sibling (whether natural or adopted by a parent), whether or not they live in the same household as the director, manager, employee, officer or contractor.

The Promotion begins on 6/12/2010 and closes (internet entries): 11:59:59pm (Melbourne time) on 03/01/2011; and mail: last mail received 07/01/2011 (Promotion Period).

To enter, entrants must purchase TWO bottles of FIJI Water (1L or 500mL) (Qualifying Purchase) from a participating Woolworths/Safeway store in Queensland, NSW or Victoria only (excluding Woolworths online and Woolworths Petrol) during the Promotion Period, and either:
visit the Promotion page www.fijiwater.com.au to complete the online entry form including full name, address, daytime contact number, unique code from Woolworths/Safeway purchase receipt, as well as the section “In 25 words or less, describe your ultimate New York Fashion Week experience with FIJI Water "; OR
fully complete the entry form, including full name, address, daytime contact number, unique code from Woolworths/Safeway purchase receipt, as well as the section “In 25 words or less, describe your ultimate New York Fashion Week experience with FIJI Water", then mail in a stamped, business sized envelope to ‘FIJI Water NY Fashion Week Promotion’, 25 Nott Street Port Melbourne Victoria 3207.
Entries must be received during the Promotion Period.


Entrants must retain photocopies of ALL purchase receipts for ALL entries.

Multiple entries are allowed but each 25 words or less answer must be different. Each entry must relate to a separate Qualifying Purchase.


The Promoter accepts no responsibility for any late, lost, incomplete, misdirected, incorrectly submitted, delayed or illegible entries, claims or correspondence whether due to error, omission, alteration, tampering, theft, destruction or otherwise.

Entries not fully complying with these conditions of entry may be deemed invalid at the Promoter’s discretion. This is a game of skill; chance plays no part in determining the winners. Each valid entry will be individually judged (by representatives of the Promoter) based on creative merit. The judges' decisions are final and no correspondence will be entered into.

All entries become the property of the Promoter and will not be returned to the entrant. Each “25 words or less” answer must be the entrant’s original work. By entering this Promotion entrants:
consent to the Promoter making copies of or publishing the whole or any part of their entry (including the “25 words or less” response) and otherwise exploiting the entry and any rights in relation to the entry, to publicise this Promotion or for any other purposes; and
undertake to the Promoter that their entry is not, and its use by the Promoter will not be, in breach of any third party intellectual property rights.


Judging will be conducted at noon (Melbourne time) on 10/01/2011 at L5, 111 Cecil Street, South Melbourne 3205.

The prize will be awarded to the best valid entry, as determined by the judges at their sole discretion.

The prize is a trip for two (2) to New York to coincide with Fashion Week (New York Fashion Week dates are 10/02/2011 – 17/02/2011; the winner’s trip dates are likely to be between 10/02/2011 and 16/02/2011, however this will be confirmed when the winner is determined on 10/01/2011), and comprises:
two (2) return business class airfares to New York from the winner’s nearest capital city (carrier selected by the Promoter);
return transfers between airport/hotel;
4 nights accommodation at a 4 star hotel (standard room, twin share);
standard admission for two (2) to three (3) fashion shows (selected by Promoter);
return transfers between each event/hotel; and
dinner for two at a selected restaurant to the value of AU$300.


The winner will be notified immediately by telephone. The winner must confirm their availability to take the prize on the specified dates by 5:00pm (Melbourne time) 14/01/2011. In the event that the winner is unable to take the prize on the specified dates, or has not claimed the prize by 5:00pm 14/01/2011, or has not confirmed their availability to take the prize on the specified dates by 5:00pm (Melbourne time) on 14/01/2011, then the winner’s entry will be deemed invalid and the Promoter reserves the right to award the prize at 10:00am on 17/01/2011 at the same location as the original draw to distribute the prize. The prize is valued at up to $41,600 (inc GST) depending on the winner’s location of residence.

The person selected to participate by the winner must be aged 21 years or over.

The winner and participant taking the trip must depart and return at the same time using the same air carrier. The winner is responsible for ensuring that all necessary documentation to travel is obtained (including valid passports and required visas), otherwise the winner’s entry will be deemed invalid. Any alterations to the confirmed prize details, including but not limited to alterations in the flight itinerary, will be at the expense of the winner and will only be permitted with the Promoter’s prior consent. The winner and participant are not eligible to earn any Frequent Flyer points from the prize.

All spending money, additional meals, taxes, insurance, transfers and all other ancillary costs, including any costs associated with passports and visas and costs associated with transport etc from the winner’s place or places of residence to the winner’s nearest airport are the responsibility of the winner.

It is strongly recommended that the winner and participant in the prize acquire adequate travel insurance (this is not provided as part of the prize). The Promoter also strongly recommends that the winner and participant acquaint themselves with travel information/recommendations provided on the Australian government website www.smartraveller.gov.au.

The winner and participant are required to sign an indemnity in a form approved by the Promoter in favour of the Promoter and all involved parties prior to participating. If they do not sign that indemnity form, they will not be able to participate. The prize winner and participant agree to comply with any reasonable directions or guidelines notified to them by the Promoter or its agents.

The prize is subject to booking and flight availability and must be taken to coincide with New York Fashion Week (10/02/2011 – 17/02/2011). No extension will be permitted. Any alterations to confirmed prize details will be at the expense of the winner and will only be permitted with the Promoter's prior consent.

The winner’s name and state will be published on www.schweppesaustralia.com.au (and www.fijiwater.com.au) on 20/01/11.

At the Promoter’s request, the winners must, and where relevant, must procure that their companion, participate in all promotional activity (such as publicity and photography) surrounding the winning of the prize, free of charge, and they consent to the Promoter using their name and image in promotional material.

The Promoter may require winner to provide proof of identity, proof of age, proof of residency at the nominated prize delivery address, or any proof of other eligibility and entry criteria. Identification/other verification material considered suitable for verification is at the Promoter’s discretion.

The Promoter may, in its sole discretion, disqualify entries from, and prohibit further participation in this Promotion by, any person who tampers with or benefits from any tampering with the entry process or with the operation of the Promotion or acts in violation of these conditions, acts in a disruptive manner or acts with the intent to annoy, abuse, threaten or harass any other person.

Prize is not transferable or exchangeable and cannot be redeemed for cash or any other form of compensation. In the event for any reason the prize winner does not take an element of a prize at the time stipulated by the Promoter, then that element of the prize will be forfeited by the winner and neither cash nor any other form of compensation will be supplied in lieu of that element of the prize. The value of the prize is accurate as at the commencement of this promotion. The Promoter accepts no responsibility for any variation in the value of a prize after that date. If for any reason a prize is not available, the Promoter reserves the right to substitute another item for it, in its sole discretion, of equal or higher value.

If a winning entry is deemed not to comply with these conditions of entry, that winner’s entry will be deemed invalid and the Promoter reserves the right to distribute the prize to the next best valid entry.

The Promoter’s decision not to enforce a specific condition does not constitute a waiver of that condition or of the Conditions of Entry in general.

The Promoter, its associated agencies and companies and the agencies and companies associated with this promotion will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence) by any person in connection with this Promotion or accepting or using a prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).

If for any reason any aspect of this Promotion is not capable of running as planned, including by reason of tampering, unauthorised intervention, fraud, technical failures or any cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this Promotion, the Promoter may in its sole discretion cancel, terminate, modify or suspend the Promotion, or invalidate any affected entries, subject to the approval of State/Territory gaming regulators (if required).

The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought. Where the operation of this Promotion results in, for GST purposes, supplies being made for non-monetary consideration, entrants agree to follow the Australian Taxation Office’s stated view that where the parties are at arm’s length, goods and services exchanged are of equal GST inclusive market values.

All entries will be the property of the Promoter. The information entrants provide will be used by the Promoter for the purpose of conducting this promotion and for the other purposes of collection as set out in the Promoter’s privacy policy. The Promoter may disclose entrants’ personal information to its contractors and agents to assist in conducting this promotion or communicating with entrants and to State and Territory lottery departments and winners’ names may be published as required under the relevant legislation. The Promoter is bound by the National Privacy Principles in the Privacy Act 1988. Entrants can request access to the personal information the Promoter holds about them by contacting Consumer Services on 1800 244 054.
