Apia 2011 Summer Competition Conditions of Entry

   1.      Information regarding the prizes and how to enter forms part of these Conditions of Entry. By entering the Apia 2011 Summer Competition (Competition), entrants accept these Conditions of Entry.

   2.      Entry is open only to Australian residents aged 18 years or over. Directors, officers, management or employees (and the immediate family members of directors, officers, management or employees) of the Promoter or of its related bodies corporate (including any company within the Suncorp Group) or of the agencies or companies associated with this Competition are not eligible to enter. Immediate family members means any of the following: spouse, ex-spouse, de-facto, ex-de-facto, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.

   3.      The Competition begins at 12.01am (AEDT) on 01/01/11 and closes at 11.59pm (AEST) on 30/04/11 (Competition Period).

   4.      There are several ways to enter this Competition. An entrant (Entrant) can enter in one or more of the five entry methods explained in the terms below. Please note that Entry Method 2 requires the Entrant to meet Apia's insurance acceptance criteria. One key criteria is demonstrating that the Entrant or their domestic partner is aged over 50 years and is not working full time or is planning to reduce their working hours in the next 12 months. All insurance quotations and policies provided by the Promoter are additionally subject to the Promoter's normal insurance policy terms. The Entrant should first read and consider the relevant Product Disclosure Statement (PDS) for the insurance product they are interested in, to ensure that it suits their individual needs. The Promoter's PDSs can be viewed at its website: www.apia.com.au or Entrants can call 13 50 50 and request a free copy to be posted to them.

Entry method 1: Entry form

   5. To enter via an entry form, Entrants must, during the Competition Period:
         1. obtain an entry form from the Promoter including as available from the Apia Marquee at the Medibank International Tennis Tournament in Sydney between 09/01/11 and 15/01/11 or from a participating Apia branch;
         2. fully compete the entry form, including by providing their name, address, postcode, contact details and the month in which their current home, car, motorhome, landlord, boat and/or caravan insurance policy expires (at least one, as nominated by the Entrant); and
         3. submit the completed entry form as instructed on the entry form.

An Entrant will receive one (1) entry for a submitted valid entry form. An Entrant may enter via this Entry method 1 more than once, by submitting more than one valid entry form, so long as each valid entry form is for a separate home, car, motorhome, landlord, boat or caravan insurance policy which the Entrant owns or has a genuine financial interest in. The Promoter, at its absolute discretion, reserves the right to exclude multiple entry forms from any Entrant for the same or similar subject property.
Entry method 2: Obtain an Apia quote

   6. To receive an entry into the Competition via the Apia quote entry method, Entrants must, during the Competition Period, obtain an Apia quote for their home, car, motorhome, landlord, boat or caravan insurance by one of the following means:
         1. visiting www.apia.com.au and following the links to obtain an online quote;
         2. calling Apia on 13 50 50 and providing all necessary information to obtain a phone quote;
         3. filling out and submitting a paper 'quote form' and subsequently obtaining a phone quote; or
         4. following the links contained in an electronic communication (eDM) or paper communication (DM) received to obtain an online or phone quote.

   7.      As explained in term 4, an entry via Entry method 2 will only be valid if the Entrant meets Apia's insurance acceptance criteria. An Entrant will receive one (1) entry for each valid quote. An Entrant may enter via this Entry method 2 more than once, by obtaining more than one quote, so long as each quote they obtain is for a separate home, car, motorhome, landlord, boat or caravan which the Entrant owns or has a genuine financial interest in. The Promoter, at its absolute discretion, reserves the right to exclude repetitive quotes from any Entrant for the same or similar subject property. Obtain an Apia quote bonus entry by purchasing a policy. If an Entrant who has entered via the Apia quote process described in this Entry method 2 additionally purchases the quoted insurance cover during the Competition Period, that Entrant will receive a bonus entry into the Competition in respect of each different quote they purchase. For the avoidance of doubt, an Entrant will not receive a bonus entry for making a payment to renew their existing Apia insurance policy or for commencing any interim insurance cover (whether referred to as a 'cover note' or similar) or for the purchase of an Apia policy which was originally quoted outside of the Competition Period.

Entry method 3: Guide to the Good Life eNewsletter

   7. To receive one (1) entry into the Competition via the Guide to the Good Life eNewsletter entry method, an Entrant must, during the Competition Period, be prompted via DM or eDM to subscribe to the Guide to the Good Life eNewsletter by fully completing and submitting the subscription form available at www.guidetothegoodlife.com.au. This entry method is only available to an Entrant who is not a current subscriber of the Guide to the Good Life eNewsletter as at the start of the Competition Period. A maximum of one (1) entry via Entry method 3 is permitted per Entrant.

Entry method 4: Survey

   8. To receive one (1) entry into the Competition via the survey entry method, an Entrant must, during the Competition Period, fully complete and submit the survey they receive from Apia via eDM or DM in accordance with Apia's instructions during the Competition Period. A maximum of one (1) entry via Entry method 4 is permitted per Entrant.

Entry method 5: Refer-a-friend

   9. To enter via the refer-a-friend mechanic, an Entrant must, during the Competition Period:
         1. receive a DM or eDM from the Promoter regarding this Competition or access the "Refer-a-friend" form available via www.apia.com.au;
         2. nominate at least one friend (up to 5 friends in total, each of whom must be an Australian resident aged over 50) to be notified about this Competition by providing their friend's valid email address and any other details as requested by the Promoter by way of the instructions provided in the DM, eDM or "Refer-a-friend" form; and
         3. for each valid friend nominated by the Entrant who confirms their interest in Apia during the Competition Period in accordance with the instructions provided in the notification they receive, the Entrant will receive one (1) additional entry into the Competition. A Refer-a-friend Entrant must only provide the email addresses of persons who have given their implied or express consent to receive an email from the Promoter regarding Apia and this Competition.

A Refer-a-friend Entrant may receive up to a maximum of five (5) additional entries by way of Entry method 5, provided that each additional entry relates to a separate valid email address of an eligible friend and is otherwise in accordance with term 9.

   10.      All entries must be received by the Promoter during the Competition Period. Online entries are deemed to be received at the time of receipt into the Promoter's database, not at the time of transmission by the Entrant. Each Entrant is responsible for their own costs associated with accessing the internet. The Promoter is not liable for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, claims or correspondence due to error, omission, alteration, tampering, deletion, theft, destruction, transmission interruption, communications failure or otherwise. The Promoter has no control over telephone communications, the internet, networks or lines and accepts no responsibility for any problems associated with them, whether due to traffic congestion, technical malfunction or otherwise. The Promoter is not liable for any consequences of user error including (without limitation) costs incurred. Any Entrant who enters using multiple email addresses and/or aliases, or otherwise contravenes these Conditions of Entry, may be disqualified.

   11.      The prize draw will take place at 12:00pm (AEST) on 25/05/11 at Contact Management Associates (VIC) Pty Ltd, 92-94 Tope St, South Melbourne VIC 3205. The first valid entry randomly drawn from all entries received during the Competition Period will win the prize. This is not a game of skill.

   12.      The prize will be one of two potential prizes, as explained in this term and the terms below. Only one (1) of the potential prizes will be provided to the winner and the winner must select which of the two potential prizes they want to receive by the date specified by the Promoter. The winner will not be entitled to change their prize selection once the winner has communicated their prize selection to the Promoter.

Trip prize

  13.      The trip prize is a trip for the winner and a companion (who must also be aged 18 years or over) to London, United Kingdom on the dates to be specified by the Promoter (but during December 2011) to coincide with the AEGON Masters Tennis event. The trip consists of return economy flights with South African Airways (or its nominee carrier) for the winner and their companion from the winner's nearest Australian capital city to London, United Kingdom, five (5) nights twin share accommodation for the winner and their companion in a minimum four (4) star hotel in London (of the Promoter's choice), return transfers for the winner and their companion between the airport and the hotel, tickets for the winner and their companion to one (1) day (as selected by the Promoter) of the AEGON Masters Tennis event at Royal Albert Hall, London, and equivalent of $2,000 (AUD) spending money for the winner. The trip prize is valued at up to $14,000 (inc GST), depending on the winner's city of departure.

  14.      Flights and accommodation are subject to booking and availability and are otherwise as specified by the Promoter. The trip prize must be taken on dates to be specified by the Promoter in December 2011. If the winner cannot take the trip prize during December 2011 on the dates specified by the Promoter, they must select the car prize. The winner must make this decision at the time of accepting their prize. All other costs associated with the trip prize, including but not limited to any additional spending money, additional transfer costs, meals, taxes, travel and/or health insurance and other ancillary costs are the responsibility of the winner and their companion, as incurred. The trip prize winner and companion are responsible for ensuring that they have all necessary clearance and documents to travel to the United Kingdom (including passports and any visas that may be required). All elements of the trip prize are subject to any additional terms and conditions specified by the trip prize suppliers, including conditions of carriage with the participating airline(s).

Car prize

  15.      A 2010 Nissan Micra 5 door hatch with automatic transmission, standard factory inclusions (only) and Barcelona Red paint valued at up to $17,542 (inc GST). The car prize includes all statutory and on road costs for the first year.

  16.      The car prize does not include property insurance (neither comprehensive or third party property damage) or any other accessories not specified. The prize winner, should they elect to receive the car prize, will be contacted by a representative of Nissan Motor Co. (Australia) Pty Ltd (Nissan) who will liaise with the winner regarding registration and collection of the prize vehicle. The car prize will be made available for collection by the winner from the winner's nearest Nissan Dealership (as determined by Nissan) on a date agreed between the winner and Nissan. The winner must provide all information and sign all documentation necessary to enable the Promoter and Nissan to register the vehicle in the name of the winner prior to collection. To be eligible to claim the vehicle, the car prize winner must be capable of obtaining registration of the vehicle in his or her name in accordance with the applicable legislation in the state or territory in which the vehicle is collected. If the winner is, through any legal incapacity or otherwise, unable to register the vehicle in his or her name then he or she may, notwithstanding any other term of these Conditions of Entry, assign the vehicle to another person with legal capacity for the purpose of registration of the vehicle.

  17.      The total prize pool is valued at up to $17,542 (inc GST), depending on the winner's prize selection.

  18.      The winner will be notified by phone and in writing and will have their name and state/territory of residence published in The Australian newspaper on 31/05/11. By entering this Competition, each Entrant requests that his or her full residential address not be published.

  19.      The winner must, at the Promoter's request, participate in all promotional activity (such as publicity and photography) surrounding the winning of any prize, free of charge, and they consent to the Promoter using their name and image in any promotional material with no limit as to time. The Promoter agrees to pay any reasonable travel and/or accommodation costs of the winner should their attendance be required more than 100km away from their usual place of residence.

  20.      If a winning entry is deemed not to comply with these Conditions of Entry, that entry will be discarded and a new winner of the prize will be determined by drawing a further valid entry in accordance with term 11. The judges' decision is final and no correspondence will be entered into.

  21.      Neither the trip prize or the car prize are transferable, exchangeable or redeemable for cash. The Promoter accepts no responsibility for any variation in prize value. If for any reason a winner or their companion do not take an element of the trip prize at the time stipulated by the Promoter then that element of the trip prize will be forfeited and cash will not be supplied in lieu. If a prize, or an element of the trip prize, is unavailable for any reason, the Promoter may substitute for that prize, or that element of the trip prize, another item of equal or higher value as reasonably determined by the Promoter, subject to the approval of the relevant gaming authority in the state or territory where the winner resides, if required.

  22.      The Promoter accepts no responsibility for any delay, postponement or cancellation of the relevant day of the AEGON Masters Tennis event for any reason whatsoever. If the relevant day of the AEGON Masters Tennis event is abandoned, called off or postponed for any reason then, at the Promoter's discretion, the prize winner forfeits all rights to attend the relevant day of the AEGON Masters Tennis event and no cash or alternative tickets will be substituted in lieu. The trip prize winner will still receive all other components of the trip prize including the flights, accommodation and transfers provided that the trip is still taken on the original trip dates as specified by the Promoter.

  23.      The Promoter, its related bodies corporate, as well as its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person's negligence) in connection with this Competition or accepting or using any prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law). For the avoidance of doubt, the Promoter shall not be liable to the winner or to any other person for any cost or liability arising in any way out of one or more of the following:
         1. any motor vehicle accident;
         2. any road traffic offence or penalty;
         3. any civil or criminal offence or penalty; or
         4. any theft or attempted theft of the Nissan (the car prize) once the winner (or their assignee) has taken possession of it.

  24.      Without limiting the previous term, the Promoter and its associated agencies and companies will not be liable for any damage or delay in transit to the prize.

  25.      If the prize has not been accepted or claimed within 3 months of the draw, the relevant winner's entry will be deemed invalid and the Promoter will conduct such further draws on 31/08/11 at the same time of day and at the same location as the original draw as are necessary to distribute the prize, subject to any requirement of any gaming authority. Any winner in this draw will be notified by phone and in writing and will have their name and state/territory of residence published in The Australian newspaper on 07/09/11.

  26.      The Promoter may require Entrants to provide proof of identity, proof of age and proof of residency. Identification considered suitable for verification is at the Promoter's discretion.

  27.      The Promoter may, in its sole discretion, disqualify all entries from, and prohibit further participation in this Competition by, any person who tampers with or benefits from any tampering with the entry process or with the operation of the Competition or acts in violation of these Conditions of Entry, acts in a disruptive manner or acts with the intent to annoy, abuse, threaten or harass any other person. The Promoter may in its absolute discretion cancel the trip prize or otherwise cease to provide any benefit of the trip prize to any trip prize winner or companion if that person, in the opinion of the Promoter, is under the influence of alcohol or any other drug, behaves aggressively or offensively, or behaves in a manner which may diminish the good name or reputation of the Promoter or any of its related bodies corporate or the agencies or companies associated with this Competition, or behaves otherwise in contravention of the law or inappropriately.

  28.      If for any reason any aspect of this Competition is not capable of running as planned, including by reason of computer virus, communications network failure, bugs, tampering, unauthorised intervention, fraud, technical failure or any cause beyond the control of the Promoter, the Promoter may in its sole discretion cancel, terminate, modify or suspend the Competition, or invalidate any affected entries, subject to the approval of the relevant gaming authorities, if required.

  29.      The Promoter is not liable for any tax implications arising from the prize winnings. Independent financial advice should be sought. Where the operation of this Competition results in, for GST purposes, supplies being made for non-monetary consideration, the Entrant agrees to follow the Australian Taxation Office's stated view that where the parties are at arm's length, goods and services exchanged are of equal GST inclusive market values.

  30.      All entries will be the property of the Promoter. Privacy Statement - The information an Entrant provides will be used by the Promoter for the purpose of conducting this Competition as well as providing insurance quotations and/or products to meet the Entrant's requested insurance needs. The Entrant additionally agrees that they must provide their consent to receive marketing communications from the Promoter at the time of submitting their entry (through any entry method). An Entrant can opt out of receiving Apia's marketing communications at a later time, by contacting Apia via the details below. An Entrant's personal information will otherwise be handled in accordance with the Promoter's privacy policy, available at http://www.apia.com.au/apia/website-terms-and-privacy. The Promoter may disclose an Entrant's personal information to its contractors and agents to assist in conducting this Competition or communicating with the Entrant. If the Entrant has marked the box on the entry form opting-in to receive further communications from Nissan and/or South African Airways, the Entrant consents to the storage of their personal information on Nissan's/South African Airways' database (as applicable) and Nissan/South African Airways (as applicable) may use this information for future promotional and marketing purposes regarding their respective products and/or services, including contacting the Entrant via electronic messaging. The Promoter, Nissan and South African Airways may use and disclose an Entrant's personal information in accordance with any consent provided by the Entrant. The Promoter, Nissan and South African Airways are bound by the National Privacy Principles within the Privacy Act 1988. An Entrant can request access to the personal information the Promoter holds about them, or request to stop receiving any of the Promoter's marketing materials, by contacting the Promoter at the address below or by calling 13 50 50. This entry method is only available to an Entrant who is not a current subscriber of the Guide to the Good Life eNewsletter as at the start of the Competition Period. A maximum of one (1) entry via Entry method 3 is permitted per Entrant.
Entry method 4: Survey

To receive one (1) entry into the Competition via the survey entry method, an Entrant must, during the Competition Period, fully complete and submit the survey they receive from Apia via eDM or DM in accordance with Apia's instructions during the Competition Period. A maximum of one (1) entry via Entry method 4 is permitted per Entrant.
Entry method 5: Refer-a-friend

To enter via the refer-a-friend mechanic, an Entrant must, during the Competition Period:
receive a DM or eDM from the Promoter regarding this Competition or access the "Refer-a-friend" form available via www.apia.com.au;
nominate at least one friend (up to 5 friends in total, each of whom must be an Australian resident aged over 50) to be notified about this Competition by providing their friend's valid email address and any other details as requested by the Promoter by way of the instructions provided in the DM, eDM or "Refer-a-friend" form; and
for each valid friend nominated by the Entrant who confirms their interest in Apia during the Competition Period in accordance with the instructions provided in the notification they receive, the Entrant will receive one (1) additional entry into the Competition. A Refer-a-friend Entrant must only provide the email addresses of persons who have given their implied or express consent to receive an email from the Promoter regarding Apia and this Competition.
A Refer-a-friend Entrant may receive up to a maximum of five (5) additional entries by way of Entry method 5, provided that each additional entry relates to a separate valid email address of an eligible friend and is otherwise in accordance with term 9.

All entries must be received by the Promoter during the Competition Period. Online entries are deemed to be received at the time of receipt into the Promoter's database, not at the time of transmission by the Entrant. Each Entrant is responsible for their own costs associated with accessing the internet. The Promoter is not liable for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, claims or correspondence due to error, omission, alteration, tampering, deletion, theft, destruction, transmission interruption, communications failure or otherwise. The Promoter has no control over telephone communications, the internet, networks or lines and accepts no responsibility for any problems associated with them, whether due to traffic congestion, technical malfunction or otherwise. The Promoter is not liable for any consequences of user error including (without limitation) costs incurred. Any Entrant who enters using multiple email addresses and/or aliases, or otherwise contravenes these Conditions of Entry, may be disqualified.

The prize draw will take place at 12:00pm (AEST) on 25/05/11 at Contact Management Associates (VIC) Pty Ltd, 92-94 Tope St, South Melbourne VIC 3205. The first valid entry randomly drawn from all entries received during the Competition Period will win the prize. This is not a game of skill.

The prize will be one of two potential prizes, as explained in this term and the terms below. Only one (1) of the potential prizes will be provided to the winner and the winner must select which of the two potential prizes they want to receive by the date specified by the Promoter. The winner will not be entitled to change their prize selection once the winner has communicated their prize selection to the Promoter.

Trip prize

The trip prize is a trip for the winner and a companion (who must also be aged 18 years or over) to London, United Kingdom on the dates to be specified by the Promoter (but during December 2011) to coincide with the AEGON Masters Tennis event. The trip consists of return economy flights with South African Airways (or its nominee carrier) for the winner and their companion from the winner's nearest Australian capital city to London, United Kingdom, five (5) nights twin share accommodation for the winner and their companion in a minimum four (4) star hotel in London (of the Promoter's choice), return transfers for the winner and their companion between the airport and the hotel, tickets for the winner and their companion to one (1) day (as selected by the Promoter) of the AEGON Masters Tennis event at Royal Albert Hall, London, and equivalent of $2,000 (AUD) spending money for the winner. The trip prize is valued at up to $14,000 (inc GST), depending on the winner's city of departure.

Flights and accommodation are subject to booking and availability and are otherwise as specified by the Promoter. The trip prize must be taken on dates to be specified by the Promoter in December 2011. If the winner cannot take the trip prize during December 2011 on the dates specified by the Promoter, they must select the car prize. The winner must make this decision at the time of accepting their prize. All other costs associated with the trip prize, including but not limited to any additional spending money, additional transfer costs, meals, taxes, travel and/or health insurance and other ancillary costs are the responsibility of the winner and their companion, as incurred. The trip prize winner and companion are responsible for ensuring that they have all necessary clearance and documents to travel to the United Kingdom (including passports and any visas that may be required). All elements of the trip prize are subject to any additional terms and conditions specified by the trip prize suppliers, including conditions of carriage with the participating airline(s).

Car prize

A 2010 Nissan Micra 5 door hatch with automatic transmission, standard factory inclusions (only) and Barcelona Red paint valued at up to $17,542 (inc GST). The car prize includes all statutory and on road costs for the first year.

The car prize does not include property insurance (neither comprehensive or third party property damage) or any other accessories not specified. The prize winner, should they elect to receive the car prize, will be contacted by a representative of Nissan Motor Co. (Australia) Pty Ltd (Nissan) who will liaise with the winner regarding registration and collection of the prize vehicle. The car prize will be made available for collection by the winner from the winner's nearest Nissan Dealership (as determined by Nissan) on a date agreed between the winner and Nissan. The winner must provide all information and sign all documentation necessary to enable the Promoter and Nissan to register the vehicle in the name of the winner prior to collection. To be eligible to claim the vehicle, the car prize winner must be capable of obtaining registration of the vehicle in his or her name in accordance with the applicable legislation in the state or territory in which the vehicle is collected. If the winner is, through any legal incapacity or otherwise, unable to register the vehicle in his or her name then he or she may, notwithstanding any other term of these Conditions of Entry, assign the vehicle to another person with legal capacity for the purpose of registration of the vehicle.

The total prize pool is valued at up to $17,542 (inc GST), depending on the winner's prize selection.

The winner will be notified by phone and in writing and will have their name and state/territory of residence published in The Australian newspaper on 31/05/11. By entering this Competition, each Entrant requests that his or her full residential address not be published.

The winner must, at the Promoter's request, participate in all promotional activity (such as publicity and photography) surrounding the winning of any prize, free of charge, and they consent to the Promoter using their name and image in any promotional material with no limit as to time. The Promoter agrees to pay any reasonable travel and/or accommodation costs of the winner should their attendance be required more than 100km away from their usual place of residence.

If a winning entry is deemed not to comply with these Conditions of Entry, that entry will be discarded and a new winner of the prize will be determined by drawing a further valid entry in accordance with term 11. The judges' decision is final and no correspondence will be entered into.

Neither the trip prize or the car prize are transferable, exchangeable or redeemable for cash. The Promoter accepts no responsibility for any variation in prize value. If for any reason a winner or their companion do not take an element of the trip prize at the time stipulated by the Promoter then that element of the trip prize will be forfeited and cash will not be supplied in lieu. If a prize, or an element of the trip prize, is unavailable for any reason, the Promoter may substitute for that prize, or that element of the trip prize, another item of equal or higher value as reasonably determined by the Promoter, subject to the approval of the relevant gaming authority in the state or territory where the winner resides, if required.

The Promoter accepts no responsibility for any delay, postponement or cancellation of the relevant day of the AEGON Masters Tennis event for any reason whatsoever. If the relevant day of the AEGON Masters Tennis event is abandoned, called off or postponed for any reason then, at the Promoter's discretion, the prize winner forfeits all rights to attend the relevant day of the AEGON Masters Tennis event and no cash or alternative tickets will be substituted in lieu. The trip prize winner will still receive all other components of the trip prize including the flights, accommodation and transfers provided that the trip is still taken on the original trip dates as specified by the Promoter.

The Promoter, its related bodies corporate, as well as its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person's negligence) in connection with this Competition or accepting or using any prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law). For the avoidance of doubt, the Promoter shall not be liable to the winner or to any other person for any cost or liability arising in any way out of one or more of the following:

any motor vehicle accident;
any road traffic offence or penalty;
any civil or criminal offence or penalty; or
any theft or attempted theft of the Nissan (the car prize) once the winner (or their assignee) has taken possession of it.
Without limiting the previous term, the Promoter and its associated agencies and companies will not be liable for any damage or delay in transit to the prize.

If the prize has not been accepted or claimed within 3 months of the draw, the relevant winner's entry will be deemed invalid and the Promoter will conduct such further draws on 31/08/11 at the same time of day and at the same location as the original draw as are necessary to distribute the prize, subject to any requirement of any gaming authority. Any winner in this draw will be notified by phone and in writing and will have their name and state/territory of residence published in The Australian newspaper on 07/09/11.

The Promoter may require Entrants to provide proof of identity, proof of age and proof of residency. Identification considered suitable for verification is at the Promoter's discretion.

The Promoter may, in its sole discretion, disqualify all entries from, and prohibit further participation in this Competition by, any person who tampers with or benefits from any tampering with the entry process or with the operation of the Competition or acts in violation of these Conditions of Entry, acts in a disruptive manner or acts with the intent to annoy, abuse, threaten or harass any other person. The Promoter may in its absolute discretion cancel the trip prize or otherwise cease to provide any benefit of the trip prize to any trip prize winner or companion if that person, in the opinion of the Promoter, is under the influence of alcohol or any other drug, behaves aggressively or offensively, or behaves in a manner which may diminish the good name or reputation of the Promoter or any of its related bodies corporate or the agencies or companies associated with this Competition, or behaves otherwise in contravention of the law or inappropriately.

If for any reason any aspect of this Competition is not capable of running as planned, including by reason of computer virus, communications network failure, bugs, tampering, unauthorised intervention, fraud, technical failure or any cause beyond the control of the Promoter, the Promoter may in its sole discretion cancel, terminate, modify or suspend the Competition, or invalidate any affected entries, subject to the approval of the relevant gaming authorities, if required.

The Promoter is not liable for any tax implications arising from the prize winnings. Independent financial advice should be sought. Where the operation of this Competition results in, for GST purposes, supplies being made for non-monetary consideration, the Entrant agrees to follow the Australian Taxation Office's stated view that where the parties are at arm's length, goods and services exchanged are of equal GST inclusive market values.

All entries will be the property of the Promoter. Privacy Statement - The information an Entrant provides will be used by the Promoter for the purpose of conducting this Competition as well as providing insurance quotations and/or products to meet the Entrant's requested insurance needs. The Entrant additionally agrees that they must provide their consent to receive marketing communications from the Promoter at the time of submitting their entry (through any entry method). An Entrant can opt out of receiving Apia's marketing communications at a later time, by contacting Apia via the details below. An Entrant's personal information will otherwise be handled in accordance with the Promoter's privacy policy, available at http://www.apia.com.au/apia/website-terms-and-privacy. The Promoter may disclose an Entrant's personal information to its contractors and agents to assist in conducting this Competition or communicating with the Entrant. If the Entrant has marked the box on the entry form opting-in to receive further communications from Nissan and/or South African Airways, the Entrant consents to the storage of their personal information on Nissan's/South African Airways' database (as applicable) and Nissan/South African Airways (as applicable) may use this information for future promotional and marketing purposes regarding their respective products and/or services, including contacting the Entrant via electronic messaging. The Promoter, Nissan and South African Airways may use and disclose an Entrant's personal information in accordance with any consent provided by the Entrant. The Promoter, Nissan and South African Airways are bound by the National Privacy Principles within the Privacy Act 1988. An Entrant can request access to the personal information the Promoter holds about them, or request to stop receiving any of the Promoter's marketing materials, by contacting the Promoter at the address below or by calling 13 50 50.
