TERMS & CONDITIONS OF ENTRY
Wipeout and Win a Custom Hawaii Five–O Surfboard competition


1. Instructions on how to enter and prizes form part of these Terms &
Conditions of Entry.
2. The Promotion is only open to residents from Sydney.
3. The promotion commences on Monday 17th January 2011 00:01 and closes
Monday 31st January 2011 23:59.

4. Employees of the Promoter, agencies or companies associated with this
Promotion and their immediate families are ineligible to enter.
5. The Promotion will be advertised on ten.com.au. Online entry is exclusive to
Ten website members only (existing and new during the Promotion Period). It
is free to become a member.
6. To register, entrants will be required to provide the Promoter with various
personal details which may include full name, phone number, email address,
geographic location, date of birth and gender. Any contact details entered
incorrectly shall invalidate the entry. Any incomplete or incomprehensible
entries will also be deemed invalid and as such disregarded.
7. The cost of accessing the promotional website will be dependent on the
entrant’s individual Internet Service Provider.
8. To enter, participants are required to upload a picture of you in front of one of
the Hawaii Five O posters or surfing at one of Network TEN’s special bus
shelters from Jan 17th - Jan 31 at the following locations:
- Hurstville (Outside Westfield shopping centre)
- Urunga Parade
- Miranda Howard Ave, Dee Why

9. Participants must visit http://ten.com.au/hawaii50.htm ‘wipe out with a custom
made surfboard’ competition page to upload their photograph in a compatible
file format. Participants may enter once a day as long as each entry
comprises a different photograph and creation.

10. A photograph of the creation must be uploaded to the
http://ten.com.au/hawaii50.htm competition page. It is a mandatory
requirement to use either one of the Hawaii Five O Posters or one of the
Network TEN Hawaii-50 specially wrapped bus shelters.
11. The photograph must be submitted in a jpg, pdf or gif file format.
12. In the event that the winner cannot provide suitable proof of name and
address the prize in whole will be forfeited and no substitute will be offered.
13. Entries that are or include obscene, offensive, defamatory, inappropriate,
unsuitable, or infringing content as determined by the Promoter at its sole
discretion will be deemed invalid, are not acceptable and not eligible to win.
14. Entries must be the entrant’s original picture and not wholly graphically
created. The Promoter reserves the right to verify the validity of entries.
Entries not fully complying with these conditions of entry will be deemed
invalid and are not acceptable and not eligible to win.
15. In the case where there are multiple people featured in a photograph the
entrant who has submitted the photo acknowledges that he/she has received
permission from all peoples in the photo to use their likeness for the purpose
of this promotion and waive all rights in accordance with these terms and
conditions. Only 1 person within the image can be nominated as the prize
winner which is the account holder of the registered member who submitted
the entry.
16. All judging of eligible entrants will be undertaken by the Promoter at the
premises of Network Ten, 1 Saunders Street, Pyrmont, NSW 2009. The
judge’s decision is final and no correspondence will be entered into.
17. This is a game of skill and chance plays no part in determining the winners.
18. All valid entries received will be eligible for the major prize. Judging for the
major prize will be undertaken on Tuesday 1st February 2011 at 10:00 (EDT).
19. All entrants will be judged on their creativity, originality, entertainment value,
visual integration of the Hawaii Five-O poster and bus shelter.
20. The Major winner will be notified by Wednesday 2nd February 2011.
21. The winners will be notified by phone and in writing.
22. One (1) major winner will receive a custom made Hawaii Five-O Surfboard
valued at $700.00

23. All prizes are not transferable or exchangeable. Prize winners are advised
that Tax implications may arise from their prize winnings and they should
seek independent financial advice prior to the acceptance of the prize.
24. If any element of the prize becomes unavailable for any reason, which is out
of the Promoters control then a similar prize to equal value, will be awarded
in lieu at the discretion of the Promoter.
25. In the event that for any reason whatsoever a winner does not take an
element of the prize at the time stipulated by the Promoter then that element
of the prize will be forfeited by the winner and cash will not be awarded in lieu
of that element of the prize.
26. The Promoter and their associated agencies and companies associated with
this promotion will take no responsibility for prizes lost or damaged in transit.
27. Prize values are based upon the recommended retail prices at the time of
printing (inclusive of GST). The promoter accepts no responsibility for
change in prize value between now and the ultimate prize redemption date.
28. If for any reason this Promotion is not capable of running as planned,
including due to infection by computer virus, bugs, tampering, unauthorized
intervention, fraud, technical failures or any other causes beyond the control
of the Promoter, which corrupt or affect the administration security, fairness
or integrity or proper conduct of this Promotion, the Promoter reserves the
right in its sole discretion to disqualify any individual who tampers with the
entry process, take any action that may be available, and to cancel,
terminate, modify or suspend the Promotion, subject to any direction given
under relevant Lottery and Gaming Regulations, and relevant state permit
regulations.
29. The Promoter and associates agencies accept no responsibility for any
breach of contract or any infringement or other violation of copyright or any
other intellectual property rights or proprietary rights through the acceptance
of entries into this contest and each entrant takes full responsibility for any
such claims made in relation to their entry.
30. By submitting an entry, each entrant agrees to assign all rights in the entry
and any other material submitted as part of or in connection with an entry
(“Material”) to the Promoter and consents to the Promoter using the entry
and Material in any manner the Promoter wishes (including modifying,
adapting or publishing the Entry and Material in whole or in part or not at all),
by way of all media, including, without limitation, posting their entry and
Material (whether in original form or a modified or adapted by the Promoter
as permitted under this paragraph) on the Promoter’s website without
payment to the entrant (of royalties, compensation or otherwise).
31. All entries become the property of the Promoter. The entrant hereby assigns
irrevocably to the Promoter all right, title and interest (including without
limitation the entire copyright, including but not only a present assignment of
future copyright) to the results and proceeds of the entrant’s contribution to
the Promotion including but not limited to any copyright in the entry sent to
the Promoter and including but not limited to any literary, dramatic, musical
or artistic work (within the meaning of the Copyright Act 1968 (Cth))
incorporated therein in which the entrant owns copyright.
32. By accepting the prize, the winner and parent/legal guardian agrees to
participate in and co-operate as required with all reasonable media editorial
requests relating to the prize, including but not limited to, being interviewed
and photographed, filmed and/or chaperoned throughout the duration of the
prize.
33. The Promoter and the agencies and companies associated with this
Promotion will not be liable for any loss (including, without limitation, indirect,
special or consequential loss or loss of profits), expense, damage, personal
injury or death which is suffered or sustained (whether or not arising from any
person’s negligence) in connection with this Promotion or accepting or using
a prize, except for any liability which cannot be excluded by law (in which
case that liability is limited to the minimum allowable by law).
34. The Promoter reserves the right to request winners and parents/legal
guardians to provide proof of identity and proof of residency at the nominated
prize delivery address. Identification considered suitable for verification is at
the discretion of the Promoter.
35. Should an entrant’s contact details change during the promotional period, it is
the entrant’s responsibility to notify the Promoter. A request to access or
modify any information provided in an entry should be directed to the
Promoter.
36. In the case of the intervention of any outside agent or event which naturally
changes the result of the Promotion or prevents or hinders the planned
operation of the Promotion, including but not limited to vandalism, power
failures, tempests, natural disasters, acts of God, civil unrest, strikes, the
Promoter may in its absolute discretion cancel the event and recommence
the Promotion, vary or suspend the Promotion and, if determined by the
Promoter at its sole discretion, from the start on the same conditions subject
to the approval of the relevant State regulations.
37. The Promoter reserves the right in its sole discretion to disqualify any
individual who tampers with the entry process.
