Terms and Conditions

By entering the Panasonic Australian Open 'Cool Moments' Game of Skill Competition (the "Competition"), you are agreeing to the following terms and conditions:

1.   STANDARD TERMS

1.1. Information on how to enter forms part of the terms of entry.

2.   WHO CAN ENTER?

2.1. Subject to clause 2.2, entry is open to all residents of Australia aged 18 years or over.

2.2. Employees and their immediate families of Panasonic Australia Pty LTD, Seven Network (Operations) Limited, and their associated agencies and companies are not eligible to enter.

3.   HOW TO ENTER

3.1. The Competition commences on 17th January 2011 at 10:00am AEDST and concludes on 31st January 2011 2011 at 09.59am AEDST ("Competition Period"). There will be 14 rounds in this Competition ("Rounds"). The Rounds will open and close on the following dates and times:

3.2. The Competition will request users to become a fan of Panasonic Australia's Facebook page (www.facebook.com/panasonicaustralia) in order to take part in the Competition through the (Cool Moment) Application ("the Application").

3.3. The Application can be accessed through a tab within Panasonic Australia's Facebook page entitled 'Cool Moments' and can also be accessed directly at http://apps.facebook.com/coolmoments/.

3.4. The entrant will be presented with 2 video clips of Brisbane International, Sydney International, World Tennis Challenge in Adelaide or Australian Open highlights ("Cool Moments") from which they will be asked to vote for their favourite. Each video will have a clear description underneath.

3.5. Upon voting for their favourite Cool Moment, the entrant will be requested to answer in 25 words or less their top tip for keeping cool this summer. As part of the entry submission, the entrant will be asked to supply the following details during the Competition Period:

   1. First Name
   2. Surname
   3. Email address
   4. Postal Address
   5. Telephone Number

3.6. Entries will be judged on creativity and originality.  The Competition is a game of skill and chance plays no part in determining the winner.

3.7. Entrants (including winners) in the Competition may enter as many times as they like but may not use "scripting" for multiple entries (which will be deemed invalid).

3.8. Entries must be received by the dates and times as indicated in clause 3.1. Entries received during one Round will not be entered into any subsequent Rounds.

3.9. The entry must be:

(a)   the original independent creation of the entrant; and

(b)   free from any claims, including copyright or trademark claims, by other parties.

3.10. Entry details remain the property of the Promoter and will not be returned to the entrant.  The winners agree to grant the Promoter a perpetual and non-exclusive licence to use their entries in all media worldwide and the winners will not be entitled to any fee for such use.

3.11. The time of entry will in each case be the time indicated in the Facebook post as lodged on the Panasonic Australia Facebook – Cool Moment application.

4.   PRIZES

4.1. There will be fourteen (14) winners who will receive the prize package.  The best valid entry in each Round, as determined by the judges in their absolute discretion, will win the prize package of one (1) Panasonic Split Inverter Air Conditioner (Model CS/CU-E21LKR) valued at  RRP AUD $2,149.00.

4.2. Total combined prize pool value is: AUD $30,086 (including GST). Prize value is based upon the recommended retail prices and is correct as of 22 December 2010. The Promoter accepts no responsibility for any change in prize value between now and the date on which the prize is awarded.  The winner is not entitled to receive any money from any party if there is a difference between the maximum prize value as stated in these terms and conditions and the actual prize value at the time it is awarded, or any time thereafter.

4.3. The prize cannot be transferred or exchanged and cannot be redeemed for cash. The Promoter is not responsible for any tax implications that arise as a result of taking the prize. Winners should seek independent financial advice about any tax implications that may arise from the prize winnings.

4.4. In consideration for taking the prize, each winner agrees to participate and co-operate as required in all editorial activities relating to this competition, including but not limited to being interviewed and photographed. Each winner also grants the Promoter a perpetual and non-exclusive licence to use such footage and photographs in all media worldwide and the winners will not be entitled to any fee for such use. Installation of Panasonic Air Conditioner is not included. It is the winners' responsibility to arrange for the installation of the Air Conditioner by a qualified and licensed installer.

4.5. The winner is responsible for any other related expenses other than those specified in the prize details.

4.6. The winners agree they will not (and will ensure that their companion does not) sell or otherwise provide their story and/or photographs to any media or other organisation.

4.7. All customer service queries should be directed to: 132 600.

5.   HOW TO WIN

5.1. Each entrant who has entered the Competition within the Competition Period and in accordance with the terms of these terms and conditions will be eligible to win the prize package detailed in clause 4.1. All entries will be judged at the Promoter's offices on the dates and times specified in clause 3.1. The entries will be judged by a panel of judges appointed by the Promoter. The winning entry in a Round will be deemed to be the most creative and original entry from all entries received for that Round. Entries that do not contain the information required by clause 3.5 or that do not otherwise comply with these terms and conditions, may be deemed invalid.

5.2. The winners will be notified by a phone call on the day of judging, and an email advising the winner of their prize will also be sent.

5.3. The judges' decision is final and the Promoter will not enter into correspondence regarding the result.

5.4. It is a condition of accepting the prize that the winner must comply with all conditions of use of the prize and also the prize supplier's requirements.

5.5. Once an entrant has won a daily prize, they are no longer eligible to win another daily prize in this Competition.

5.6. It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.

6. LIABILITY

6.1  Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, excludes or modifies the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia ("Non-Excludable Guarantees"). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter  and Facebook (including their respective officers, employees and agents) exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Competition.

6.2 Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees,  the Promoter and Facebook (including their respective officers, employees and agents) are not responsible for and exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) the prize.

6.3 Panasonic Australia Pty LTD, Seven Network (Operations) Limited & affiliates  and their associated agencies and companies will take no responsibility for prizes damaged or lost in transit, or late, lost or misdirected entries.

6.4 If this Competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the Competition, as appropriate.

6.5 Any cost associated with accessing the promotional website is the entrant's responsibility and is dependent on the Internet service provider used.

6.6 The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.

6.7 This Promotion is in no way sponsored, endorsed or administered by, or associated with Facebook. Any questions, comments or complaints should be directed to the Promoter and not Facebook.

7 PROMOTER'S DETAILS & PRIVACY

7.1  The Promoter is Panasonic Australia Pty LTD (ABN 83 001 592 187) of Austlink Corporate Park, 1 Garigal Rd, Belrose, NSW 2085.

7.2  The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including, but not limited to, prize suppliers and as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite time unless otherwise advised, use the information for promotional, marketing and publicity purposes including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter's Privacy Officer. All entries become the property of the Promoter.
