Terms and Conditions
1. Information on how to enter the Fone Zone - Maroon 5 Competition (the "promotion") and prizes form part of these terms and conditions of entry "(the "conditions of entry"). Entry into the promotion is deemed acceptance of these conditions of entry.
Entry into this promotion is open to all Australian residents.

Entry into this promotion is open to all Australian residents aged 10 years and over. Entrants under the age of 18 must obtain the prior permission of a parent or guardian over the age of 18 to enter. Employees of mcm Media and their immediate families, associated agencies of mcm Media and companies associated with the promotion are not eligible to enter the promotion. Any person who within 365 days prior to the day on which this promotion first commences has won a prize valued at AU$100 or more from another mcm media promotion is not eligible to enter this promotion.

To enter the promotion, you must log onto www.take40.com click through to "Fone Zone - Maroon 5" competition and successfully complete an interactive game. The participant will then be asked to register their details including your name, address, phone number and e-mail address. One complete and valid online registration will provide you with one entry into the draw. Incomplete, incorrect and incomprehensible entries will be deemed invalid.

Only one complete online registration will be accepted per day (midnight to midnight) from the same person. Multiple registrations in the same day will not provide multiple entries. Any participant who submits more than one online registration form per person, per day (midnight until midnight) will have all entries apart from their original entry on that day deemed invalid.
5. After successfully completing an online registration and confirming that you have read, accepted and understood these terms and conditions, you will then be given the opportunity to "Refer A Friend" by sending an e-mail that contains a hyperlink to the promotion to your friends.
You will receive one (1) additional entry (subject to successful completion of the game and all entry requirements) into the draw for each referred friend who enters by clicking on the hyperlink that you email them. A limit applies of one (1) additional entry into the draw per friend referred. Incomplete, incorrect or incomprehensible entries will be deemed invalid. You must only use the refer-a-friend feature to send an approved email to only those people whom you have an existing relationship and who you reasonably believe will not mind receiving information about the promotion. Any spam or referrals using your own details will be disqualified. The Promoter accepts no responsibility or liability for any entries not received or included for any reason, including due to technical or other failure.
6. The cost of accessing the competition website will be dependent on the participant's individual Internet Service Provider and is the responsibility of the participant. The Promoter accepts no liability for a participant's failure or inability to access the competition website.

8. Entrants will be entered into the relevant State entry pool (NSW, QLD, VIC, SA or WA) (the "STATE ENTRY POOLS") in which they reside. ACT residents will be entered into the NSW entry pool, TAS residents will be entered into the VIC entry pool and NT residents will be entered into the SA entry pool.

Major Prize: There will be 5 x major prizes available, one for each state entry pool. Each winner will receive a Maroon 5 Prize pack valued at a maximum of $1,248.00 details below:* 1 x double pass to see Maroon 5 live in concert, in the winners nearest capital city valued at a maximum of $200.00. Dates outlined in Clause 15.
* 1 x Nights' accommodation for 2 people in a minimum 3.5 star hotel, valued at maximum of $200.00
* Return Hotel/Concert transfers for 2 people valued at maximum of $200.00
* Motorola Defy phone valued at maximum of $648.00
The total major prize pool is valued at a maximum of AU$6,240.00
10. Minor prize: There will be 30 x minor prizes available. The minor prize is a Maroon 5 album 'Hands All Over', valued at a maximum of $29.95 each
The total minor prize pool is valued at a maximum of AU$898.50
11. The total prize pool is valued at a maximum of AU$7,138.50
12. The competition commences on Tuesday 18 January 2011 12:00 PM (AEDT) and online registration commences at this time. All registrations must be received by 12:00 PM (AEDT) on Monday 21 February 2011.
13. There will be 5 Major Winners (the "MAJOR WINNERS") over the entire Promotion Period. 1 Winner will be drawn from each of the State Entry Pools outlined in Clause 9. There will be 30 Minor Winners (the "MINOR WINNERS") drawn from all entries received over the entire Promotion Period.
14. All aspects of the Major Prize must be taken together as a package. The Major Prize must be taken by the Major Winner of each State Entry Pool, on the dates stipulated below. In the event that for any reason whatsoever a Major Winner does not take the Major Prize or an element of the Major Prize at the time stipulated by the Promoter, then the Major Prize or that element of the Major Prize will be forfeited by the Major Winner.
* WA: Sunday 1 May 2011: Burswood Dome, Perth, WA
* VIC/TAS: Thursday 5 May 2011: Rod Laver Arena, Melbourne, VIC
* NSW/ACT: Friday 6 May 2011: Acer Arena, Sydney, NSW
* QLD: Saturday 7 May 2011: Brisbane Entertainment Centre, Brisbane, QLD
* SA/NT: Monday 9 May 2011: Adelaide Entertainment Centre, Adelaide, SA
15. Major Winners are responsible for all ancillary or incidental costs associated with taking the Major Prize, including without limitation, travel expenses (for example where a Major Winner does not live in one of the States that is hosting the Major Prize).
16. A credit card imprint or cash deposit may be required from the winner at check-in to the hotel, for all incidental charges. Once accommodation vouchers are issued they are non-changeable.
17. All prize draws will take place at the premises of Beinteractive Pty Ltd, Level 8, 155 George Street Sydney NSW 2000 at 11:30am on Tuesday 22 February 2011. All winners will be notified in writing and winners of prizes over $250 will have their details published in the public notices section of The Australian Newspaper on Friday 25 March 2011.
18. An unclaimed prize draw will take place at Be.interactive Pty Ltd, Level 8, 155 George Street, Sydney NSW 2000 on Tuesday 29 March 2011 at 11:30am subject to NSW Office of Liquor, Gaming and Racing, Victorian Commission for Gambling Regulation, Office of the Liquor and Gaming Commissioner (SA) and ACT Gambling and Racing. All winners will be notified in writing and winners of prizes over $250 will have their details published in the public notices section of The Australian Newspaper on Friday 1 April 2011.
19. The judges decision is final and no correspondence will be entered into. Prizes are not exchangeable or transferable for cash. All online registrations are deemed to be received at the time of receipt into the Promoter's database, and not at the time of transmission by the participant.
20. All prize values are the recommended retail value as provided by the supplier and are correct at time of printing. The Promoter accepts no responsibility for any variation in prize value. If the prizes are unavailable for whatever reason, the Promoter reserves the right to substitute the prize for a prize of similar value.
21. Only one prize per household will be awarded (SA residents are entitled to win more than one prize).
22. In consideration for the Promoter awarding the prize to the winner, the winner hereby assigns to the Promoter all right, title and interest in and to all copyright in any material created pursuant to the winner's participation in any aspect of the prize (Works). The winner acknowledges that the Promoter is free to use the Works and to exercise its rights in relation thereto and the winner will not be entitled to any fee for such use.
23. The Promoter and each of their related bodies corporate, associated agencies and companies associated with this competition will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person's negligence) in connection with this competition or accepting or using any prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
24. Should a participant's contact details change during the competition period, it is the participant's responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to the Promoter.
25. mcm media and each of their related bodies corporate, associated agencies, and companies associated with this promotion will take no responsibility for any delay in delivery once prizes have left the Promoter's premises.
26. The Promoter reserves the right to request winners to provide proof of identity, proof of residency at the nominated prize delivery address, and/or proof of entry validity. Proof of identification, residency and entry considered suitable for verification is at the discretion of the Promoter. In the event that a winner cannot provide suitable proof of identity, proof of residency and proof of entry validity, the winner will forfeit their prize in whole and no substitute will be offered.
27. All entries become the property of the Promoter. The Promoter collects personal information about you to enable you to participate in this promotion (which may include disclosure to third parties for the purpose of processing and conducting the promotion) but no further use of this information will be made without your prior consent. Entrant's personal information may be disclosed to State and Territory lottery departments and winners names published as required under the relevant lottery legislation.
28. If for any reason this promotion is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of the Promoter, which corrupt or affect the administration security, fairness or integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the competition, subject to NSW Office of Liquor, Gaming and Racing, Victorian Commission for Gambling Regulation, Office of the Liquor and Gaming Commissioner (SA) and ACT Gambling and Racing.
29. In the case of the intervention of any outside agent or event which naturally changes the result or prevents or hinders it's determination, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strikes; the Promoter may in its absolute discretion cancel the event and recommence it from the start on the same conditions subject to NSW Office of Liquor, Gaming and Racing, Victorian Commission for Gambling Regulation, Office of the Liquor and Gaming Commissioner (SA) and ACT Gambling and Racing.
30. The Promoter may, in its sole discretion, disqualify all entries from, and prohibit further participation in this competition by any person who tampers with or benefits from any tampering with the entry process or with the operation of the competition or acts in violation of these conditions, acts in a disruptive manner or acts with the intent to annoy, abuse, threaten or harass any other person.
