Yoplait Go-Gurt 'Win a Snow blasted School Yard 2011" competition

CONDITIONS OF ENTRY

1.Information on how to enter and details of the prizes form part of these Conditions of Entry (Conditions). Entry into the Yoplait Go-Gurt Blasted Schoolyard competition (Competition) is deemed to be an acceptance of these Conditions.
2.Competition commences at 05.00 pm (AEDST) on 20 January 2011 and entries close at 5.00pm (AEST) on 1 April 2011 (Competition Period).
3.Entry is open to Australian residents. Employees (and their immediate families) of the Promoter, or agencies or companies associated with this Competition, are ineligible to enter.


How to enter


4.To enter the Competition, you must during the Competition Period:
1.purchase any of the following specially marked products (Competition Products) from a participating outlet:


1.Yoplait Smackers tubes strawberry 8x70g pack;
2.Yoplait Go-Gurt tubes strawberry & fruit salad 8x70g pack;
3.Yoplait Go-Gurt tubes spiders 8x70g pack; and
4.Yoplait Go-Gurt tubes strawberry 8x70g pack;
2.log onto www.gogurt.com.au or www.smackerssnowblast.com and complete the online entry form to register as an individual entrant by providing your first name, last name, telephone number, email address, and any additional information required by the Promoter;
3.receive your username and password and select the school you would like support and your relationship with the school (if the school you wish to select is not available you will be prompted to enter the school’s details); and
4.enter the unique code found on the Competition Product (Unique Code).
5.Only valid Unique Codes entered during the Competition Period will register and allow entry into the Competition.
6.Participants can enter more than once, but each entry requires the separate purchase of a Competition Product.
7.Unique Codes can be submitted once only. Unrecognised Unique Codes will not be accepted.
8.Participants may not exchange Unique Codes with other participants for monetary payment or other consideration.
9.Any entry that is lodged by automatic, repetitive, robotic, programmed or similar entry methods or agents, including the use of a competition entry service, will void all entries by that entrant.
10.Participants must retain the packaging bearing the Unique Code from the Competition Products. Failure to produce the original packaging bearing the Unique Code when requested may, in the absolute discretion of the Promoter, result in invalidation of all of an entrant’s entries.


Prizes


11.The following prizes will be awarded (Prizes):
1.(Major Prize) a ‘Win a Snow blasted School Yard 2011’ experience. The experience comprises an event at the winning school which will involve up to 10 tonnes of artificial snow being laid out in an area at the school and various supervised snow-based activities being conducted for a duration of approximately 4 hours valued at up to AUD $65,800 (incl. GST).
2.(Runner Up Prizes): The two schools that place second and third respectively in the promotion will each receive a cheque to the value of $4,000 for sporting equipment.
3.(Minor Prize) 200 x iPod* 2GB Shuffles valued at AUD $66 (incl. GST) each. The total value of the Minor Prize pool is AUD $13,200 (incl. GST).
*Apple is not a participant in or sponsor of this promotion

 
12.The value of the total prize pool is valued up to AUD $87,000 (incl. GST).


How Major Prize winners are determined


13.The winner of the Major Prize will be the school with the most Unique Codes registered on its behalf during the Competition Period at the end of the Competition Period, 5.00pm (AEST) on 1 April 2011 at Salmat Interactive, Level 17, 100 Arthur Street, North Sydney, NSW, 2060 (Winning School). One Major Prize will be awarded to the Winning School.14.If the same number of Unique Codes are registered on behalf of two or more schools (Drawn Schools), then the Promoter will contact each Drawn School and request that it provides a statement, in 50 words or less, as to why that school should win the Major Prize.15.Any statements required to be provided by the Drawn Schools in accordance with clause 14 must be sent via facsimile to (03) 8610 1980 or via email to gogurt@bmf.com.au and must be received by the Promoter by 5:00pm AEST on 13 May 2011.
16.The Promoter, in its absolute discretion, will judge and select any winners to be determined under clauses 14, 15, 31 and 32. Entries will be judged based on the creativity and originality of the entrant’s 50 word response.


The Major Prize


17.Representatives of the Promoter will arrange the delivery of the Major Prize event (Event). The Winning School will be notified by the Promoter and must nominate a representative from the school (School Representative) who will work closely with the Promoter to arrange the specific details of the Event (including the date, time and place of the Event) and to ensure that the Event is conducted in accordance with an Event running sheet to be provided to the School Representative by the Promoter prior to the Event.
18.The Major Prize includes approximately 10 tonnes of ice to be delivered to the site of the Event by truck.
19.If a the Winning School elects not to conduct the Event, the Major Prize will be forfeited and the following prizes will be awarded in lieu of the Event:
1.computers and computer equipment equal to 20% of the value of the Major Prize; and
2.the opportunity to donate an amount equal to 80% of the value of the Major Prize to a charity of the Winning School’s choice. Charities and associations directly associated with the school, such as Parent and Teacher Associations, are excluded.
20.If the Winning School elects to conduct the Event, but the Promoter determines that it is not possible to conduct the Event for any reason including that:
1.the school does not have a suitable site to conduct the Event on the school’s grounds, and a suitable alternative site cannot be identified; or
2.the 10 tonnes of ice cannot be delivered by truck to the site of the Event; or
3.the forklift truck required to move the ice cannot be operated on the site of the Event,
the following prize will be awarded to the Winning School in lieu of the Event:


4.computers and computer equipment equal to 50% of the value of the Major Prize; and
5.the opportunity to donate an amount equal to 50% of the value of the Major Prize to a registered charity of that school’s choice. Charities and associations directly associated with the school, such as Parent and Teacher Associations, are excluded.
21.The Winning School must provide:
1.a suitable number of volunteers to assist with the supervision of the Event. The number of volunteers required is to be agreed between the Promoter and the School Representative;
2.all electricity necessary (including bearing the cost of the electricity) to enable the Event to:
1.be set-up;
2.run for the full duration; and
3.be dismantled and removed from the site; and
3.suitable access for all machinery and moving equipment necessary to enable set-up and removal of the Event.
22.The Event must be conducted within 6 months of the end of the Competition Period.
23.If the Event cannot proceed on the date nominated by the Winning School due to inappropriate weather conditions, the Major Prize winning school must arrange with the Promoter an alternative date (Alternative Date) for the Event. If the Event again cannot proceed on the Alternative Date due to inappropriate weather conditions, the Promoter will award to the Major Prize winning school:
1.computers and computer equipment equal to 50% of the value of the Major Prize; and
2.the opportunity to donate an amount equal to 50% of the value of the Major Prize to a registered charity of that school’s choice. Charities and associations directly associated with the school, such as Parent and Teacher Associations, are excluded.
24.The value of all Prizes is accurate as at 29 October 2010. The Promoter accepts no responsibility for any variation in the value of the prizes after that date. The prizes cannot be transferred, exchanged or redeemed for cash (other than as specified in these Conditions). Where a prize is unavailable, the Promoter retains the right to substitute the prize with a prize of equal or greater value.


Notification of winners – Major Prize


25.The Winning School will be notified by mail and phone within 14 days of the end of the Competition Period.
26.The name of the Winning School will be published in The Australian on 15 April 2011. In the event of a draw the winning school will be published in the Australian on 20 May, 2011.


Notification of winners – Minor Prize


27.The Promoter will randomly determine one winning time (Winning Time) for each of the 200 Prizes during the Promotion Period.  A Prize will be awarded to the entrant who submits the first valid entry after each Winning Time.
28.The winners of the Minor Prize will be notified immediately upon submission of their online entry via an automatic on-screen message and by phone within 14 days of the end of the Competition Period.
29.The winners of the Minor Prize will also have their last name, initial of their first name and State published on the Competition website.


Unclaimed Prize – Major Prize


30.In the event that the Winning School does not claim the Major Prize by 22 August 2011, the Major Prize winner will be the school with the second most Unique Codes registered on its behalf during the Competition Period (Unclaimed Major Prize Winner).31.The Unclaimed Major Prize Winner will be notified by mail and telephone and its name will be published in The Australian on 25 August 2011.
32.If no clear Unclaimed Major Prize Winner can be determined under clause 30 due to two or more or the runners up receiving equal amounts of Unique Code registrations (Drawn Schools), the Promoter will contact each Drawn School on 24 June 2011 and request that it provides a statement, in 50 words or less, as to why it should win the Major Prize.33.Any statements required to be provided by a Drawn School in accordance with clause 32 must be sent via facsimile to (03) 8610 1980 or via email gogurt@bmf.com.au and must be received by the Promoter by 5:00pm AEST on 5 September 2011 and the winning school will be determined in accordance with clause 16.
34.Any winning school under clause 33 will be notified by mail and telephone and its name will be published in The Australian on 12 September 2011.


Unclaimed Prize – Minor Prize


35.If the winner of any Minor Prize does not claim their prize by 1 July 2011 a draw will take place on 8 July 2011 at 3pm (Sydney time) at Salmat Interactive, Level 17, 100 Arthur Street, North Sydney, NSW, 2060, subject to any directions from a regulatory authority. Winners, if any, will be notified by telephone and e-mail.

General Conditions


36.The Promoter’s decision is final, and no correspondence will be entered into.
37.All entries are deemed to be received by the Promoter at the time of receipt into the Promoter’s database and not at the time of transmission by the entrant. Entries will not be accepted past the close of date and time.
38.The Promoter, in its absolute discretion, reserves the right to verify the validity of all entries and to disqualify any entrant who tampers with the entry process, including but not limited to, by using techniques designed to avoid payment of call costs, by using techniques designed to avoid purchasing the Competition Products or by making a Prize claim with stolen, forged, mutilated or tampered with Competition Products or Unique Codes, or who submits an entry that is not in accordance with these Conditions.
39.Unless otherwise due to fraud or ineligibility under these Conditions, all prize claims in excess of the advertised total prize pool will be honoured. Printing errors or other quality control matters outside of the control of individual entrants shall not be used as the sole basis for refusing to award the Prize.
40.The Promoter and its associated agencies or companies accept no responsibility for lost, late, stolen, damaged or misdirected entries, or codes entered incorrectly.
41.If for any reason this Competition is not capable of running as planned, the Promoter reserves the right in its absolute discretion to modify the terms of the Competition including the prizes and these Conditions.
42.Any tax liability arising as a result of accepting any Prize is the responsibility of the winning schools.
43.Except for any liability which cannot be excluded by law the Promoter:
1.is not responsible for any problems or technical malfunction of any telephone network or lines, computer on line systems, servers, or providers, computer equipment, software, technical problems or traffic congestion on any computer system or at any website, or any combination thereof, including (but not limited to) any injury or damage to participants or any other person’s property related to or resulting from participation in this Competition;
2.accepts no responsibility for any incorrect or inaccurate information, either caused by users or by any of the equipment or programming associated with or utilised in connection with this Competition, or by any technical error that may occur in the course of this Competition, including (but not limited to) any failure of the computer system or other equipment to determine winners in accordance with these Conditions; and
3.accepts no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to or alteration of entries or entrant’s details.
44.The Promoter and its associated companies and agencies will not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained as a result of receiving, taking or using any Prize except for any liability which cannot be excluded by law. As a condition of accepting a Prize, all winners (and companions), or the parents or guardians of the winners (and companions), must sign any legal documentation as and in the form required by the Promoter in its absolute discretion including, but not limited to, a legal release and indemnity form.
45.All claims and entries become the property of the Promoter.
46.By entering this Competition, each entrant consents to the Promoter using the entrant’s personal information to administer the Competition and announce the winner and disclosing the entrant’s personal information to organisations that assist the Promoter with administering the Competition and announcing the winner, and to third parties as required by law (including authorities that regulate this Competition). By entering into this Competition, each entrant also consents to their personal information being used by the Promoter for future marketing and Competition purposes (other than marketing or promoting via email). The Promoter is bound by the National Privacy Principles in the Privacy Act 1988 (Cth). Entrants can access and correct the personal information the Promoter holds about them by contacting the Promoter on 1800 677 852. The Promoter’s full privacy policy is available on request.

I had a lot of trouble entering the codes as well, but I eventually got one to work and won an iPod
