Terms & Conditions
1. Information on how to enter, how to claim, how to play, and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions. There will be a maximum total prize pool of up to $1,023,672.50. There will be a maximum of 706,000 promotional game boards distributed with the Sunday Herald Sun on 30/01/11 and 7,647,000 promotional game cards printed for this promotion (which will be distributed throughout the Promotional Period as defined in paragraph 3 below). The game boards distributed on 30/01/11 will have the promotional game card for that day included. Game boards will also be available to download at
www.heraldsun.com.au/trivialpursuit. Downloaded game boards can only be used for the purpose of collecting Collect and Win tokens and will not contain any other prize elements.
2. Entry is only open to residents of Victoria and Tasmania who purchase a copy of the Herald Sun, or the Sunday Herald Sun between 30/01/11 and 12/02/11. This promotion is not open to residents of New South Wales, ACT, Queensland, Northern Territory, Western Australia or South Australia and is not being conducted in these States/Territories. Employees and the immediate families of the Promoter, its affiliates/joint promotional partners, participating newsagents, subagents, and any agencies associated with this promotion are ineligible to enter.
3. Promotional game cards will be distributed between Sunday 30/01/11 and Saturday 12/02/11 (Promotional Period). Collect and Win Prize claims and Instant Win Prize claims must be registered on the Trivial Pursuit hotline on 1300 721 123 no later than 12 noon (AEDST) on 13/02/11. Hotline is open between 9am and 5.30pm (AEDST) daily until 12/02/11, and until 12 noon (AEDST) on 13/02/11. Claims must then be sent in by mail and received by last mail on 21/02/11. Entries for the Unclaimed Prize Draw close at 12 noon (AEDST) on 21/02/11.
4. On each day during the Promotional Period, a promotional game card will be inserted in the Herald Sun (Mon – Sat), and the Sunday Herald Sun (“HWT newspapers”). .
5. Collect and Win Prizes: For the chance to win a Collect and Win Prize, readers must cut out the six (6) Trivial Pursuit Wedges in the “Collect and Win” section of the promotional game card (found in the HWT newspapers daily during the Promotional Period) and attach each Trivial Pursuit Wedge to the corresponding Prize Token printed on the promotional game board. On 30/01/11, the Trivial Pursuit Wedges for the “Collect and Win” element of the promotion will be featured on the actual game board. Collect all of the Trivial Pursuit Wedges required to complete a ‘Prize Token Set’ on the promotional game board to win the corresponding Collect and Win Prize for that Prize Token set. For example, to win the Collect and Win Prize corresponding with the ‘Car’ Prize Token set, you must collect all six (6) different coloured Trivial Pursuit Wedges marked “car” during the Promotional Period, as follows: 1. “CAR YELLOW”, 2. “CAR PINK”, 3. “CAR GREEN”, 4. “CAR PURPLE”, 5. “CAR BLUE” and 6. “CAR ORANGE”.
To claim a Collect and Win Prize, you must first register your claim on the hotline by calling 1300 721 123 no later than 12 noon (AEDST) on 13/02/11. The hotline is open between 9am and 5.30pm (AEDST) daily, until 12/02/11 and from 9am until 12 noon (AEDST) on 13/02/11. Claimants must have their promotional game board with them when they call.
For verification purposes, Collect and Win Prize winners must send in:
(a) their promotional game board with the original corresponding Trivial Pursuit Wedges for the relevant Prize Token Set attached; and
(b) their name, address and telephone number written on a separate sheet of paper; to a reply paid address to be advised by the Promoter, so that it is received by last mail on 21/02/11. Collect and Win Prize winners must also retain a photocopy of their promotional game board (with the Trivial Pursuit Wedges attached).
6. Instant Win Prizes: Entrants must scratch the Instant Win panel on the promotional game card to see whether they have won an Instant Win Prize. Instant Win Prizes can be redeemed for the prize specified on the Instant Win panel and must be redeemed by 12 noon (AEDST) on 13/02/11 by calling the promotional hotline on 1300 721 123.
For verification purposes, winners of Instant Win Prizes (excluding Goulburn Valley drinks winners) must send in:
(a) the original Instant Win Prize section of the game card, with the scratched panel clearly visible; and
(b) their name, address and telephone number written on a separate sheet of paper;
to the reply paid address supplied by the Promoter, so that it is received by last mail on 21/02/11. Instant Win Prize winners must also retain a photocopy of their game card (with the Instant Win Prize section clearly visible).
7. Spin & Win Prizes: To be eligible to enter the Spin & Win element of this promotion, entrants must either:
(a) enter the unique code printed in the Spin & Win section of the game card by logging on to heraldsun.com.au/trivialpursuit and following the prompts;
(b) send an SMS with their name, address, daytime phone number and unique code (in that order, with a space between each detail) to 199 944 99; or
(c) call 1900 991 015 and follow the instructions, between 30/01/11 and 11:59pm AEDST on 12/02/11. SMS entries and 1900 calls charged at 55c incl. GST. 1900 calls from mobile phones or pay phones may attract a higher rate. SMS entry mechanic is only open to consumers with an SMS compatible mobile phone connected to a service provider and plan which permits text messaging to the promotional SMS number. SMS entrants under 18 years old must obtain account holder’s consent. SMS helpline: 1300 721 123. Every day starting from Monday 31/01/11 to Sunday 13/02/11 one (1) person will be drawn for his/her chance to play to win $35,000 (14 draws in total). Each draw will take place at 9.15am at Loyalty Marketing, Suite 11/210 Toorak Road, South Yarra Vic 3141. The first valid entrant randomly drawn in each draw will be contacted via telephone and email and/or SMS at 9.30am on the day of the draw.
Winners must make themselves or a proxy available to attend a Spin & Win recording at the Seven Studios, located at 160 Harbour Esplanade Docklands VIC 3008 at 3pm on a date nominated by the Promoter (between 31/01/11 and 13/02/11). The nominated date may be the same day that the winner is contacted by the Promoter. If a winner cannot make themselves or a proxy available on the nominated date (or in the event that the Promoter cannot contact a winner), the Promoter will select a representative to play the Spin & Win game on behalf of the drawn entrant. If the winner (or a proxy) is able to attend the Spin & Win game, they (or their proxy, if applicable) must bring the original game card, showing the unique code used to enter to the Seven Studios for verification purposes (unless the promotional game card has been sent to the Promoter for verification purposes). If the winner is uncontactable, and the Promoter has nominated a representative to play the Spin & Win game on their behalf, the winner will be required to present their original game board/card to the Promoter by 12 noon on 21/2/2011 to be eligible to receive the prize awarded during the Spin & Win segment (unless the promotional game card has been sent to the Promoter for verification purposes).
Network Seven will broadcast a segment every day from Monday 31/01/11 to Sunday 13/02/11 between 7:30pm and 8:30pm (AEDST) in Victoria and Tasmania only on Network Seven and Prime. The segment host will ask each Spin & Win entrant drawn a question from a Trivial Pursuit card (from the Trivial Pursuit "20th Anniversary Edition", ”Classic Family” or “Bet You Know It” game). The question will be selected at random and will be determined at the absolute discretion of the Promoter and the segment host. If the question is answered incorrectly, the entrant will win the consolation prize of $500.
If the question is answered correctly, the entrant (or his/her representative) will then spin the wheel for a 1:12 chance of winning $35,000. Correct or incorrect answers will be determined by the Trivial Pursuit card used by the Channel Seven segment host. There will be 11 x $1,000 rungs and 1 x $35,000 rung. The entrant will win whichever prize the tab lands on when they spin the wheel. All prizes will be rewarded in the form of a cash cheque. Transfers to the Seven Studios will be the responsibility of the winner, however, for any winners residing in Tasmania, the Promoter will cover the cost of return flights to Melbourne (from the Hobart or Launceston airport) provided that flights can be organised in time for the entrant to attend the Spin & Win game.
8. Unclaimed Prize Draw: Individuals who enter the Spin & Win element of this promotion will be automatically entered into the Unclaimed Prize Draw. Once the Spin & Win element of this promotion has concluded, individuals can still enter the Unclaimed Prize Draw by either: (a) logging on to heraldsun.com.au/trivia and entering their unique code and details, as requested; (b) sending an SMS with their name, address, daytime phone number and unique code (in that order, with a space between each detail) to 199 944 99; or (c) calling 1900 991 015 and following the instructions. Entries for the Unclaimed Prize Draw close at 12 noon (AEDST) on 21/02/11. Limit of one entry into the Unclaimed Prize Draw per game card. 9. The Unclaimed Prize Draw will take place at 3pm (AEDST) on 28/02/11 at Loyalty Marketing: Suite 11, 210 Toorak Rd, South Yarra 3141 VIC. The Promoter reserves the right, at any time, during the Promotional Period, to conduct additional unclaimed prize draws in order to distribute any prizes that are not claimed in accordance with these Terms and Conditions.
10. Prizes will only be awarded where the entrant has fulfilled all of the requirements of the Promoter’s verification tests and procedures. The Promoter reserves the right, at any time, to verify the validity of all claims/entries and claimants/entrants (including a claimant’s/entrant’s identity, age and place of residence) and to disqualify any claimant/entrant who tampers with the claim/entry process or who submits a claim/entry that is not in accordance with these Terms and Conditions. The verification tests and procedures shall be determined by the Promoter in its absolute discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
11. The Promoter’s decision in relation to all aspects of this promotion is final and no correspondence will be entered into.
12. No responsibility will be accepted for late, lost or misdirected mail/entries/claims.

14. Vehicle prize is a Lexus IS250 Prestige, with 6 speed automatic transmission, 4 year new car manufacturers warranty, metallic paint, and registration, compulsory insurance and on-road costs. Additional insurance, options, petrol and all other ancillary costs are the responsibility of the winner. The colour of the vehicle prize will be at the discretion of the winner (subject to availability). The prize must be collected from Melbourne City Lexus, 559 Elizabeth Street, Melbourne Vic 3000. The Promoter reserves the right to exchange the car prize for one of a similar value in the event that the Lexus IS250 Prestige cars are not available for any reason.
15. The Flight Centre Holiday prizes consist of $5,000 worth of Flight Centre credit for each winner, awarded in the form of a gift card. The $5,000 Flight Centre gift card winners will be contacted by their nearest Flight Centre Store and the winner will receive a gift card redeemable with that store. The Flight Centre prizes are not redeemable for cash or travellers cheques. The winners must comply with the standard terms of use as specified by Flight Centre. Where the cost of purchase exceeds the available gift card balance, the winner will be required to make up the difference between the purchase price and the balance. 17. 19. There are 70,000 Goulburn Valley 600ml milks to be won instantly. To collect this prize, winners redeem their winning game card at a participating outlet, as indicated on the game board and game cards, from January 30 2011 to February 28, 2011. 20. Movie Pass prizes are subject to Hoyts Terms and Conditions as specified on the Pass. Pass cannot be used Saturday after 5pm, for No Free or Discount Offers, Special Events, IMAX, the Bean Bag, La Premiere, Directors Suite, 3D and Xtremescreen cinemas. Pass is valid until the expiry date indicated and is not transferable or redeemable for cash.
21. JB Hi Fi Gift Cards must be redeemed within a participating JB Hi-Fi Store or through the JB Hi-Fi website. Gift Cards are not redeemable for cash and will only be up to the value as stated on the Gift Card. The Gift Card does not have any monetary value and can only be exchanged for goods and services. Gift Cards are partially redeemable, however, any unused balance will not be refunded or credited to a recipient. It is up to the redeemer to use the full value of the Gift Card within the validity period. If the beneficiary's order exceeds the amount of the Gift Card, the beneficiary will be required to pay for the difference in price between the value of the Gift Card and the retail price of the goods or services. 23. In the event that a prize(s) is/are not available, the Promoter reserves the right to substitute prize(s) in its discretion to the same and equal recommended retail value and/or specification, subject to any written directions from the Victorian Commission for Gambling Regulation.
24. Collect and Win Prize winners will be notified by mail. Instant Win prize winners will be revealed instantly under the latex panel, immediately in writing. Except for any liability that cannot be excluded by law, the Promoter and the various prize suppliers (including their respective officers, employees and agents) exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry/prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; or (e) use of any prize. It is a condition of accepting certain prizes (as determined by the Promoter in its absolute discretion) that the winner may be required to sign a legal release in a form determined by the Promoter in its absolute discretion. 28. Any costs associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used. Any contact details entered incorrectly on the website or on any required promotional material shall be deemed invalid.
29. SMS entries for the Spin & Win element of this promotion or the Unclaimed Prize Draw via the internet are not valid and will not be accepted. All entries are deemed to be received at the time of receipt into the ‘Herald Sun Trivial Pursuit Promotion’ database and NOT at the time of transmission by the entrant..
30. The Promoter is not responsible for any incorrect or inaccurate information, either caused by the phone user or for any of the equipment or programming associated with or utilised in this promotion, or for any technical error, or any combination thereof that may occur in the course of the administration of this promotion including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.
31. If for any reason this promotion is not capable of running as planned (including but not limited to) technical failures, unauthorised intervention, fraud or any other causes beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, and, subject to any written directions given by the Victorian Commission for Gambling Regulation, to cancel, terminate, modify or suspend the promotion.
32. Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (incl. photograph, film and/or recording of the same) in any media for an unlimited period of time without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter and promotional partners.
33. The Promoter collects entrants’/claimants’ personal information in order to conduct the promotion. If the information requested is not provided, the entrant/claimant may not participate in the promotion. By participating in the promotion, unless otherwise advised, each entrant/claimant also agrees that the Promoter may use this information, for an indefinite period, in any media for future promotional, marketing and publicity purposes without any further reference, payment or other compensation to the entrant/claimant, including sending the entrant/claimant electronic messages and/or telephoning the entrant/claimant. 34. Promotional game materials are rendered void if stolen, forged, mutilated or tampered with in any way or if the ‘Void if Removed’ panel is tampered with in any way or if they fail the Promoter’s validation test. Promotional game materials from any other promotion will not be accepted.
35. For the sake of clarity, any ‘wedges’ which have been cut out from any other source other than by cutting out the Trivial Pursuit Wedges from an official promotional game card from this promotion will not be accepted and will not constitute a Trivial Pursuit Wedge for the purposes of submitting a Collect and Win Prize claim. Only official and original Trivial Pursuit Wedges cut out from the Trivial Pursuit panel of an official promotional game card issued for this promotion will be accepted.
36. Printing and other quality control errors will not invalidate an otherwise valid prize claim.
37. The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought.
38. If a winner of a prize is under the age of 18 years, the prize will be awarded to the winner’s nominated parent or guardian.
