Terms and Conditions of entry 1. Information on how to enter and prizes form part of these Conditions of Entry. Participation in this promotion constitutes acceptance of these Conditions of Entry.
2. The promoters are the Australian Grand Prix Corporation (ABN 86 947 927 465), 220 Albert Road, South Melbourne, Victoria 3205 and ACP Magazines Limited. (ABN 18 053 273 546) and 54-58 Park Street, Sydney New South Wales 2001. (Promoters).
3. Entry is only open to Australian residents who are 18 years of age or over. The Promoters, licensees, on-sellers and their employees (and their immediate families), and their agencies associated with this promotion are ineligible to enter.
4. The promotion period begins at 12.00am (AEST) on Saturday 1 January 2011 and ends 11.59pm (AEST) on Monday 28 February 2011(Promotion Period).

Incomplete or incomprehensible entries will be ineligible to win. Entries are deemed to be received at the time of receipt by the Promoters and not at the time of transmission by the entrant.
5. Only one entry per person will be permitted. The judgeâs decision is final and no correspondence will be entered into. The Promoters reserve the right to verify the validity of entries and to disqualify any entrant who tampers with the entry process or who submits an entry that is not in accordance with these Conditions of Entry.
6. Judging will take place at 11am on Monday 7 March 2011 at the ACP offices, (54-58 Park Street, Sydney New South Wales 2001). The winner will be notified by phone in the first instance and by mail and posted on
www.topgear.com/au. The entrant acknowledges that the prize will only be available for claiming for a limited period as specified in these Conditions of Entry.
7. One winner with the best entry will receive:
1. one F1 two seater Hot Lap consisting of 1 x âoutâ lap, 1 x âflyingâ lap and 1 x âinâ lap, or as otherwise determined by the Promoter in its discretion (having regard to race control requirements) for the winner and a companion (Hot Lap) at, or during the week of, the 2011 FORMULA 1 QANTAS AUSTRALIAN GRAND PRIX, 24-27 March 2011 (subject to FIA confirmation in late 2010) (Event) and a photograph taken during the activity by an AGPC official photographer. Value up to $15,000;
2. Economy Flights for the winner and the Prize Companion from the nearest capital city to Melbourne (does not include Victorian residents) Value up to $2000; and
3. 5 nightsâ Accommodation for 2 in a 4 star hotel in Melbourne (to be determined by the Promoters) over the Event weekend. Value up to $2000.
4. Grandstand tickets for the winner and guest to the 2011 Formula 1 Qantas Australian Grand Prix. Value up to : $399 per ticket
Total Prize is valued at up to $ 19,798
8. If the prize remains unclaimed at 5pm AEST on Monday 7 March 2011 the Promoters may determine another winner in order to distribute the prize. Any such winner will be notified by phone and mail, and their names will be published on
www.topgear.com/au.
9. For the avoidance of doubt, spending money, meals, transport to and from the Event (other than flights as referred to in Condition 7.d.), transfers and all other ancillary costs (other than the costs contained in Condition 7) incurred as a result of taking a prize are not included and remain the responsibility of the winner.
10. No element of the prize is exchangeable and cannot be taken as cash. The prize may be transferred to another Nominated Participant as designated by the prize winner in writing to AGPC by no later than 14 March 2011, subject to such Nominated Participant meeting the requirements for participation, including without limitation medical clearance requirements, and agreeing that their participation will be deemed acceptance of these Conditions as if all references to the âwinnerâ were references to the Nominated Participant, except where the context otherwise requires.
11. All elements of the prize referred to in Condition 7 must be taken to coincide with the Event to be held from 24-27 March 2011, and if not taken at the times stipulated, will be forfeited.
12. The Promoters will not be responsible in circumstances where the Event is cancelled or the Event dates are re-scheduled for any reason, other than as set out in the Conditions of Sale of tickets to the Event (available at
www.grandprix.com.au). If the prize or any part of the prize becomes unavailable for reasons beyond the Promotersâ reasonable control, the Promoters will endeavour to provide a substitute prize of equivalent value.
13. 13. The Promoters reserve the right to disqualify any individual who tampers with the entry process and to cancel, terminate, modify or suspend the promotion. The Promoters do not accept any responsibility for late, lost or misdirected entries for this promotion.
14. 14. As a condition of accepting the prize, the winner will be required to sign a waiver of liability and indemnity form as required by the Promoters.
15. 15. The winner must, at its own cost, organise and undertake a compulsory medical examination (which may include an ECG test) to obtain medical clearance by the date specified by the Promoters. The winner must consent to the test results being made available to CAMS for the purpose of assessing fitness to participate in the Hot Lap.
In order to participate in the Hot Lap, the winner must also be within the following height, weight and body dimension restrictions:

ENTRANTS ARE REMINDED AND AGREE, ACCEPT AND ACKNOWLEDGE THAT MOTOR RACING, THE EVENT AND CERTAIN ACTIVITIES ASSOCIATED THEREWITH (INCLUDING, WITHOUT LIMITATION, PARTICIPATION IN THE PRIZE) ARE DANGEROUS AND ACCIDENTS CAN HAPPEN.
Entrants are warned that there is a possibility of an accident causing injury, death or property damage or loss and attendance at the Event and participation in the prize is at entrantâs (and their companionâs) own risk. Entrants acknowledge that the risks associated with attending the Event and participating in the prize include but are not limited to the risk of suffering harm as a result of cars (or parts of them) colliding with other cars, persons or property. Entrants acknowledge that entry to and remaining at the Event and participating in the prize has a degree of danger and, to the extent permitted by law (in particular sections 32J and 32JA of the Fair Trading Act 1999 (Vic) and section 74 of the Trade Practices Act 1974 (Cth)), hereby exclude, release and forever discharge the Promoters, the Crown in right of the State of Victoria, the Minister administering the Australian Grands Prix Act 1994 (Vic), the Minister administering the Crown Land (Reserves) Act 1978 (Vic), FĂŠdĂŠration Internationale de l'Automobile, Formula One Administration Limited, Formula One Management Limited, Confederation of Australian Motor Sport Limited (CAMS), Parks Victoria, the State Sports Centres Trust, APP Corporation Pty Limited (ACN 003 764 770), Event sponsors and all other persons involved in the organisation, conduct and promotion of the Event or the prize (Associated Entities) from all liability for claims, loss, damage, costs or expenses arising from any personal injury or death (whether arising from negligence (but excluding gross negligence) or otherwise), arising from or connected with participation in Recreational Services (as defined below) at the Event, including the prize.
To the extent permitted by law (in particular sections 32J and 32JA of the Fair Trading Act 1999 (Vic) and section 74 of the Trade Practices Act 1974 (Cth)), entrants acknowledge that, to the extent to which they participate at the Event in:
* a sporting activity or similar leisure time pursuit; or
* an activity that:
1. a. involves a significant degree of physical exertion or physical risk; and
2. is undertaken for the purposes of recreation, enjoyment or leisure, (Recreational Services),
including, without limitation, participation in the prize, the Associated Entities do not make any warranty that the Recreational Services at the Event, including the prize, will be provided with due care and skill or that any materials provided in connection with the Recreational Services, including the prize, will be fit for the purposes for which they are supplied. Entrants acknowledge that, to the extent that any warranty is implied it is excluded to the full extent permitted by law.
WARNING: If an entrant (or their companion) participates in these activities their rights to sue the supplier under the Fair Trading Act 1999 if they are killed or injured because the activities were not supplied with due care and skill or were not reasonably fit for their purpose, are excluded, restricted or modified in the way set out in the Conditions.
NOTE:The change to an entrantâs rights as set out in this notice, does not apply if their death or injury is due to gross negligence on the supplierâs part. âGross negligenceâ is defined in the Fair Trading (Recreational Services) Regulations 2004.
For the purpose of this Condition 15 âthe supplierâ shall mean and include the Associated Entities.
Without limiting any other release or limitation of liability contained in these Conditions of Entry, the Associated Entities will not be liable for any indirect or consequential loss suffered by any Entrant caused by any acts or omissions of the Associated Entities, their directors, employees, agents and contractors arising out of or in relation to the Event or the prize.
16. Nothing in this Condition 15 or in these Conditions generally affects your rights under the Trade Practices Act 1974 (Cth), Fair Trading Act 1999 (Vic) or similar legislation regarding implied conditions and warranties to the extent that such implied conditions and warranties cannot be excluded by law.
17. The Promoters reserve the right to request the winner and the Prize Companion provide proof of age, identity and residency prior to awarding any element of the prize. Identification considered suitable for verification is at the discretion of the Promoters
18. If a winning entry is deemed not to comply with the Conditions of Entry of this promotion, the entry will be discarded and a new winner of that prize will be determined by drawing a further valid entry. The Promotersâ decision is final and no correspondence will be entered into.
19. If a prize (or part of a prize) becomes unavailable, the Promoters, in its discretion, reserve the right to substitute a prize (or that part of the prize) with a prize to the equal value and/or specification.
20. Neither the Promotersâ, nor any of the Associated Entities will be liable for any loss, expense, damage, personal injury or death which is suffered or sustained by any person in connection with this Promotion or accepting or using a prize, except for any liability which cannot be excluded by law.
21. Entrants consent to, and will procure that the Prize Companion consents to, the Promoters using the entrantâs and the Prize Companionâs name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoters or the Associated Entities.
22. The Promoters collect entrantsâ personal information in order to conduct the promotion, as well as winnersâ personal information in order to award the prize. If the information requested is not provided, the entrant may not participate in the promotion.
23. By entering the promotion, unless otherwise advised, each entrant also agrees that the Promoters may use this information, in any media for future promotional, marketing and publicity purposes without any further reference, payment or other compensation to the entrant, including sending the entrant electronic messages, and telephoning the entrant for an indefinite period. Such personal information will be dealt with by the Promoters in accordance with the Information Privacy Act 2000 (Vic) and the Promoterâs privacy policy. A request to access, update or correct any personal information, or to access the Promoterâs privacy policy, should be directed to the Promoters by contacting the Promoters at Grand Prix House, South Melbourne, VIC, 3205. All entries become the property of the Promoters.
24. By entering this promotion entrants agree that if they win they must make any their Prize Companion aware of these Conditions, and procure such personâs agreement to these Conditions as a condition of their acceptance of participation in the prize.
25. A term (or part or parts thereof) of these Conditions will not apply where the term is unenforceable under the law of the relevant jurisdiction under which any legal action is legitimately taken, however such terms (or part or parts thereof) are severable and do not invalidate the remaining terms.
