Win Big With The Soundies 2011 - Terms And Conditions
1. General
a) MTV Networks Australia Pty Ltd (ACN 107 601 418) of Ground Floor, 4-16 Yurong St
East Sydney, Australia NSW 2010 (“MTVNA”) is the promoter of this competition (“Competition”).
b) Information on how to enter forms part of these terms and conditions (“Terms and Conditions”)
c) By entering any competition promoted by MTVNA you agree to these Terms and Conditions and any other applicable terms as advised by MTVNA.
d) For the purposes of these Terms and Conditions, MTVNA includes its parents, related and subsidiary companies, past present and future officers, agents, representatives, employees, and assigns.
e) The Soundwave concert series (“Soundwave”) will be held in:
a. Brisbane on Saturday 26 February 2011 at RNA Showgrounds
b. Sydney on Sunday 27 February 2011 at Sydney Showground
c. Melbourne on Friday 4 March 2011 at the Melbourne Showgrounds
d. Adelaide on Saturday 5 March 2011 at Bonython Park
e. Perth on Monday 7 March at Claremont Showgrounds
f) For the purposes of these Terms and Conditions each Soundwave concert city will be a “City”, each Soundwave concert date will be a “Date” and each Soundwave concert venue will be a “Venue”.
2. Entry requirements
a) Entrants must be residents of Australia.
b) The employees, agents and contractors of MTVNA, any of its affiliate, parent or subsidiary companies, or any agency associated with the Competition are not eligible to enter the Competition.
c) Direct family members of any person included in 2(b) are not eligible to enter.
d) The competition can be entered online via
http://www.mtvclassic.com.au e) To enter entrants must watch the eight videos (“SOUNDIES Videos”) made available on the website, vote for their favourite SOUNDIES Video and tell us in 25 words or less ‘Which is your favourite video and why?’
f) All entries must include full contact details: name, email address, postal address and telephone number.
g) Any person who fails to provide the full information in the manner requested as part of the entry process will not be eligible for any competition Prize.
h) Any information, photographs, audio-visual or other material provided to MTVNA by an entrant as part on an entry to this competition will not be returned to entrants. Entrants are advised to not send original material.
i) Entries to this competition open at 12:01pm (AEDST) Friday 4 February, 2011 and close at 11:59am (AEDST) on Wednesday 23 February, 2011 (“Competition Period”). Entries received after closing dates will not be eligible.
j) MTVNA accepts no responsibility for lost entries.
k) Unless otherwise agreed, any personal or confidential information submitted to MTVNA by any person in the course of entering or being otherwise involved in this competition such as name, address, telephone number will be treated in accordance with MTVNA’s Privacy Policy available at
www.mtv.com.au.
3. Judging
a) Entries will be judged at the MTVNA office at Ground Floor, 4-16 Yurong St East Sydney NSW 2010.
b) The Major Prize Winner will be notified by 12:00pm (AEDST) on Wednesday, 24 February 2011.
c) This Competition is a game of skill and the most creative entry as selected by the judges after consideration will be deemed the major prize winner (“Major Prize Winner”).
d) The Major Prize Winner will be notified by phone and email via the details provided in the entry. All reasonable efforts will be made to contact the Major Prize Winner.
e) If MTVNA is unable to contact the Major Prize Winner by 12:01pm (AEDST) on Thursday, 25 February 2011, MTVNA may award the Prize to the next most creative entry.
f) The decision of the judges is final and MTVNA will not enter into correspondence or communication regarding the judges’ decisions even where MTVNA may not have acted reasonably or where MTVNA is shown to have made a decision in error.
4. Prizes
a) The Major Prize Winner will win the following prize (“Prize”):
- One (1) meet and greet opportunity with the band or artist of the SOUNDIES Video that has received the most votes during the Competition Period (“Winning Band”) (this is a money can’t buy prize)
- One (1) Yamaha Pacifica 112J OVS Solid Bodied Electric Guitar, signed by the Winning Band (this is a money can’t buy prize)
- One (1) signed limited edition Soundwave skate deck (this is a money can’t buy prize)
- One (1) double pass to Soundwave in Major Prize Winner’s preferred City valued at a maximum of $318.30 ($159.15 per ticket)
- One (1) Atticus clothing pack valued at a maximum of $500.00
- One (1) pair of Macbeth shoes valued at a maximum of $60.00
b) The total Prize pool for the Competition is $878.30, plus three money can’t buy elements.
c) The Prize does not include any travel or transfers to and from the Venue or accommodation in the City, and all travel, transfers, accommodation and travel insurance costs (if necessary) will be the sole responsibility of the Major Prize Winner and their guest.
d) Unless expressly stated all other costs and expenses associated with taking the Prize become the responsibility of the winner.
e) MTVNA will use all reasonable endeavours to secure the Winning Band to participate in the Prize, however where the Winning Band is not available, MTVNA reserves the right to replace the Winning Band with another band or artist from the SOUNDIES Videos.
f) MTVNA may require any person collecting or receiving a Prize to show photograph identification and/or sign a deed declaring that they have collected or received the Prize before MTVNA gives the Prize over.
g) MTVNA may require any person collecting a Prize to sign a copy of these Terms and Conditions.
h) Once a Prize has been collected MTVNA is not responsible for the use or distribution of any Prize.
i) MTVNA will not be liable for any loss or damage whatsoever which is suffered (including but not limited to direct or consequential loss) or for personal injury suffered or sustained, as a result of taking any Prize under this competition.
j) The Venue may require the Major Prize Winner and their guest to present photograph identification on entry to the Event. The Venue may refuse entry at its own discretion where such identification is not presented. MTVNA is not responsible for any refusal of entry made by the Venue because of failure to present identification.
k) The Venue may also impose its own conditions of entry to the Venue and may refuse entry in its own discretion. MTVNA is not responsible for any refusal of entry made by the Venue.
l) Alcohol will be served at Soundwave, and the Major Prize Winner and their guest must abide by the minimum drinking age restrictions. Minors may not be permitted to attend some parts of the Venue, and will be required to respect the conditions set by the Soundwave operators.
m) If a Prize or an element of a Prize referred to in this competition becomes unavailable for any reason MTVNA reserves the right to substitute that Prize for a similar item of similar value.
n) Prizes are not transferable or redeemable for cash. MTVNA accepts no responsibility for any variation in the value of the Prizes.
o) The Major Prize Winner agrees to participate in any promotional activity promoting MTVNA, Prize sponsors and/or the competition at the reasonable request of MTVNA.
p) Any questions, comments or complaints about the Promotion should be directed to MTVNA at the address given in Clause 1 a) of these Terms and Conditions.
5. Intellectual Property
a) MTVNA may record, reproduce, publish, adapt, communicate or otherwise use the entrants’ and/or Major Prize Winners’ performances, names, voices, and likeness for the purposes of creating or producing any television program or other audio and/or audiovisual material and for advertising and publicity purposes in any media in perpetuity without needing to provide additional compensation.
b) Any material, including without limitation competition entries and images and/or audiovisual material included in competition entries, submitted or provided by a competition entrant, and/or Major Prize Winner in association with any competition will become the property of MTVNA and MTVNA may reproduce, publish, adapt, communicate, cause to be seen and/or heard in public or otherwise use any such material throughout the world in perpetuity and without needing to provide additional compensation.
c) MTVNA may require an entrant or Major Prize Winner to execute any document necessary to give effect to 5(a) and/or (b).
6. Warranties
a) Entrants warrant and represent to MTVNA that nothing in any entry to any competition infringes the rights, including copyright, of any third party and is not defamatory or obscene and does not breach any state or commonwealth law.
b) Entrants indemnify MTVNA against any claim, loss or damages suffered by MTVNA as a direct or indirect consequence of a breach by the entrant of any warranty or representation contained in these Terms and Conditions.
c) If MTVNA becomes aware that the Major Prize Winner is in breach of any warranty contained in these Terms and Conditions or made subsequently to MTVNA, MTVNA may deem that Major Prize Winner ineligible.
7. Governing Law
a) These Terms and Conditions are to be construed according to the laws New South Wales, Australia and are subject to the non-exclusive jurisdiction of the courts of that state.
