BASIC CONTEST RULES

Correct as at 30 November 2010

The following stipulates basic contest rules for any / all contests both on and off air, featured on Brisbane’s Best Mix - 97.3fm. Each contest may have its own special restrictions / qualifications, in which case, an addendum to these rules will be featured.
All Brisbane’s Best Mix - 97.3fm contests are open to any / all listeners, unless otherwise specified.
1. Only one (1) winner per family / household per contest. This includes winning a 'minor prize', CD, money, voucher etc from the promoter in the one competition
1.2 WHO MAY ENTER:
The only persons who may enter and be awarded prizes are:
(i) Those who are not employees of, or contractors to, the Promoter or any of its agencies involved with this competition; or
(ii) who are not the spouse, de facto spouse, parent, natural or adopted child, and sibling (whether natural or adopted by a parent), of such employees and contractors (whether or not they live in the same household).
iii) those contestants who have not won a prize/prizes valued (either individually or collectively) at $200 or more from the Promoter or in any contest run by the Promoter in the prior 30 days.
iv) those contestants who have not won a prize/prizes valued (either individually or collectively) at $500 or more from the Promoter or in any contest run by the Promoter in the prior 60 days.
v) those contestants that have not won a prize valued at $1,000 or more from the Promoter or in any contest run by the Promoter in the prior 90 days.
vi) Those contestants who have not won a prize valued at $5,000 or more from the Promoter or in any contest run by the Promoter in the prior 12 months.
vii) Those who have not already won a major or minor prize in the same competition.
Contestants who are discovered to have used or attempted to use any more than one name in order to qualify to win any contest run by the Promoter except in the case of a legal change of name are not permitted to win.
All contestants acknowledge that the Promoter can rely on Clause 2 even if the Promoter only learns of a person’s ineligibility after the promoter has appeared to award the prize to the ineligible person. Return of the prize or payment of its value to the Promoter can be required by the Promoter if this occurs. All winners must acknowledge ineligibility to enter a further competition on or off air, if any of the above occur.
2. All major prizes will be given away by Brisbane’s Best Mix - 97.3fm.
3. All prizes must be picked up within sixty (60) days of winning. It is the sole responsibility of the winner to claim their prize. Winners are required to come into the Radio Station to pick up their prize.
4. In extenuating circumstances winners may request that their prizes are sent via Australia Post or courier delivered. If this request is approved by ARN please note ARN will assume the prize has been received and will take no further responsibility once the prize leaves Brisbane’s Best Mix - 97.3fm, whether it is lost or stolen in transit.
5. When claiming a prize, winners under the age of 18 must be accompanied by a parent / guardian. Both must sign the release and show adequate ID.
6. Brisbane’s Best Mix - 97.3fm is at liberty to dispose of an unclaimed prize at the end of the sixty (60) day grace period.
7. All unclaimed prizes will be forfeited.
8. In the event of two (2) telephone lines being tied together (crossed), the entire call will be disqualified.
9. In case of a dispute over telephone lines, the decision of Brisbane’s Best Mix - 97.3fm is final.
10. Employees and families of Brisbane’s Best Mix - 97.3fm / it’s advertising agency / sponsors and affiliates are ineligible to enter and / or win any contest on Brisbane’s Best Mix - 97.3fm.
11. Due to unavailability or unforseen circumstances, Brisbane’s Best Mix - 97.3fm may substitute another prize of similar or equal value.
12. Designated representatives collecting prizes - in very unique circumstances with prior permission of Brisbane’s Best Mix - 97.3fm is allowed. Written authorisation will be required and ID for both winner and their representative. Brisbane’s Best Mix - 97.3fm will qualify what it terms a “unique situation”.
13. Brisbane’s Best Mix - 97.3fm is not responsible for defective prizes or misuse of a claimed prize.
14. All entries become the property of Brisbane’s Best Mix - 97.3fm. Further, Brisbane’s Best Mix - 97.3fm may withhold any material relevant to the completion of the contest.
15. All contestants acknowledge as a condition of entry that Brisbane’s Best Mix - 97.3fm has the right to publicise or broadcast his / her name, character, likeness, voice on all matters incidental therein.
16. All contest winners must avail themselves for a photo if required by Brisbane’s Best Mix - 97.3fm and acknowledge that Brisbane’s Best Mix - 97.3fm has the right to utilise publicity photos in any reasonable manner it sees fit.
17. In the event a winner chooses not to accept a prize, they forfeit any and all claims to the prize, which can then be awarded to a runner-up at the discretion of Brisbane’s Best Mix - 97.3fm.
18. In the event a winner chooses not to accept a prize, Brisbane's Best Mix- 97.3Fm does not have to offer a counter prize.
19. Winners are responsible for any/all taxes incurred on prizes received including overseas holidays.
20. All prizes are not transferable.
21. Brisbane’s Best Mix - 97.3fm, its agencies, affiliates, sponsors or representatives absolve themselves from any liability, financial or resultant arising out of or in connection with any contest staged by Brisbane’s Best Mix - 97.3fm.
22. In certain circumstances, a list of winners will be made available on request to unsuccessful entrants at Brisbane’s Best Mix - 97.3fm during business hours.
23. Basic contest rules and addendum are available for review at Brisbane’s Best Mix - 97.3fm during business hours, and to entrants by mail, upon receipt of a stamped, self-addressed envelope.
24. Brisbane's Best Mix- 97.3Fm insists that winners come in to the station during business hours to collect their cheque if the value is $200 or over with suitable photo ID.
25. Brisbane's Best Mix- 97.3Fm has the right to ask a winner to come into the station during business hours to collect their cheque with photo ID if they feel it is a necessary requirement.
26. For competitions that have an on-air call back element, you must answer the phone to be eligible for the prize.
27. A missed call from 97.3Fm does not mean that you have won a competition.
28. For trivia based question & answering competitions, the Brisbane's Best Mix- 97.3Fm judge’s decision is final. No further correspondence will be entered into.
29. Additions or deletions to these rules may be enacted at the discretion of Brisbane’s Best Mix - 97.3fm at anytime.
