Terms and Conditions
1. Instructions on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
WHO CAN ENTER
2. Entry is only open to Australian residents. Employees and immediate families of
Westfield Tea Tree Plaza, Marion and West Lakes; as well as retailers and tenants and the agencies associated with this promotion are ineligible.
HOW TO ENTER
3. To be eligible to enter, individuals must, during the promotional period, submit an official entry form, with email address included, and place it in the box provided. The individual will then be added to the Westfield Tea Tree Plaza, Marion or West Lakes e-newsletter distribution list.
4. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
5. One entry per person.
6. The promotion commences from 4:00pm on Thursday 3 February 2011 and entries close at 5.00pm on Sunday 13 February 2011. A draw will take place at 11am AEST on Monday 14 February 2011at Westfield Tea Tree Plaza, 976 North East Rd, Modbury SA 5092. The Promoter’s decision is final and no correspondence will be entered into.
PRIZE DETAILS
7. The first valid entry drawn from all entries received will win one engagement ring featuring 1 carat of diamonds, set in 18 carat Gold.
8. Total Prize Value is: $1,999. This prize cannot be redeemed for cash. The winner will be advised on a collection point and date for collection.
9. Prize is subject to the standard terms and conditions of individual prize and service providers.
10. If for any reason a winner does not take the prize or an element of the prize at the time stipulated, then the prize or that element of the prize will be forfeited and will not be redeemable for cash.
11. In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion, subject to any written directions from a relevant regulatory authority.
12. If the winner of any prize is under the age of 18 years, the prize will be awarded to the winner’s nominated parent or guardian.
13. If the prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
14. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize.
