Terms and Conditions1.Information on how to enter the promotion and on the prize forms part of these Conditions of Entry. Entries not made in accordance with these terms and conditions will be disqualified.
2.The promoter is Blue Mountains Lithgow & Oberon Tourism ("Promoter") and the promotion is managed by The Hyper Hyper Company Pty Limited {ABN 13 101 483 023} of Suite 40, 12 Waratah Street, Mona Vale, NSW 2103 ("Hyper Hyper").
3.Entry is only open to persons aged 18 years and over ("Eligible Entrants"). The officers, management and employees (and their immediate families) of the Promoter and its related bodies corporate and any agencies associated with the promotion are ineligible.
4.The Promoter reserves the right to verify the validity of entries and to disqualify any entrant who tampers with the entry process or who submits an entry that is not in accordance with these Conditions of Entry.
5.The judges' decision is final and no correspondence will be entered into.
6.The Promotion commences 15th February AEST on 2011 and entries close midnight AEST on 14th April 2011 ("Promotional Period").
7.To enter, Eligible Entrants must visit
http://www.hyperhub.com.au/blue_mountains during the Promotional Period, fully complete the online survey (including contact details) and answer all the questions.
8.Incomplete entries will be ineligible.
9.No responsibility is accepted for late, lost or misdirected entries. It is the responsibility of the Eligible Entrant to notify the Promoter of any change of contact details during the Promotional Period.
10.The participating operator is The Mountain Heritage Resort.
11.If for any reason this promotion is not capable of running as planned (including but not limited to) infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter or Hyper Hyper which corrupts or affect the administration security, fairness, integrity or proper conduct of this competition, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, to cancel, terminate, modify or suspend the competition.
12.The Promoter and Hyper Hyper are not responsible for any problems or technical malfunction of any telephone network or lines, computer on line systems, servers, or providers, computer equipment, software, technical problems or traffic congestion on the Internet or at any web site, or any combination thereof, (including but not limited to) any injury or damage to participants or any other person's computer related to or resulting from participation in or down-loading any materials in this competition. Any costs associated with accessing the promotional website is the entrant's responsibility and is dependent on the Internet service provider used. Any contact details entered incorrectly on the website shall be deemed invalid.
13.Eligible Entrants enter and participate in the Promotion at their own risk. The Promoter and Hyper Hyper shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for personal injury which is suffered or sustained, as a result of taking the prize, except for any liability which cannot be excluded by law.
14.It is a condition of accepting the prize that the winner (and companion) may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.
15.The Promoter reserves the right to refuse to allow a winner to take part in any or all aspects of the prize, if the Promoter determines, in their absolute discretion, that a winner is not in the mental or physical condition necessary to be able to safely participate in the prize.
16.In the event of war, terrorism, state of emergency or disaster the Promoter reserves the right to cancel, terminate, modify or suspend the promotion.
17.The Promoter and/or Hyper Hyper collect entrants' personal information through a fair and legitimate method in order to conduct the promotion. All personal information collected pursuant to this promotion is the property of the Promoter. By entering the promotion, unless otherwise expressly advised by entrant, each entrant agrees that the Promoter may use this information in any media for future promotional, marketing and publicity purposes, including sending the entrant electronic messages. A request to access, update or correct any information may be directed to the Promoter at their address set out above.
18.The Promoter or Hyper Hyper reserves the right to request winners to provide proof of age, identity and residency prior to awarding the prize. Identification considered suitable for verification is at the discretion of the Promoter. In the event that the winner cannot provide suitable proof, the winner will forfeit their prize in whole and no substitute will be offered.
19.The Promoter or Hyper Hyper reserves the right to conduct security verification checks at their absolute discretion. Prize winners may be required to sign a declaration confirming their eligibility to accept the prize.
20.Every participant who correctly completes the mystery word Thre_ Si_ter_ will automatically receive an entry into the draw to receive a weekend for 2 people staying at the Mountain Heritage Resort in a Spa Room including breakfast.
21.The winning entrant will be notified by phone on the website and receive confirmation by mail by 15th April 2011. Prize must be booked and taken by 15th October 2011.
22.Prize is not to be used in conjunction with any other promotion.
23.Prize or any unused portion of prize is not transferable or exchangeable and cannot be taken as cash. Any cancellation fees and other costs will be at the winning entrant's expense. Prizes are to be presented to the operator and used by 18th December 2011. Black out period apply.
24.The prize winners are advised that tax implications may arise from their prize winnings and s/he should seek independent financial advice prior to acceptance of the prize.
25.Money, additional transfers, insurance, incidental costs relating to the selected redemption, are the responsibility of the winner and his/her companions. No extension will be permitted. Cancellation fees and other costs will be at the winners/participants expense.
