TERMS AND CONDITIONS for the Premier Mortgage Solutions Trivia Question Competition
1.The Premier Mortgage Solutions Trivia Question Competition (Promotion) is organised and managed by Premier Mortgage Solutions Pty Limited (ACN 095 063 291) (Premier Mortgage Solutions) of Shop 5, 512 Mulgrave Road, Earlville, Queensland 4870.
2.Information on how to enter and the prize forms part of these terms and conditions.
3.Entry to the Promotion is open only to Cairns residents aged eighteen (18) years or over.
4.The following categories of individuals are ineligible to enter the Promotion:
•Employees of Premier Mortgage Solutions Limited (ACN 095 063 291);
•Immediate family of employees of Premier Mortgage Solutions Pty Limited;
•Employees of agencies associated with this Promotion;
•Immediate family of employees of agencies associated with this promotion;
•Premier Mortgage Solutions franchise owners;
•Immediate family of Premier Mortgage Solutions franchise owners;
•Employees and agents of Premier Mortgage Solutions franchises.
5.The Promotion commences at 5:00 am AEST on 1 March 2011 and finishes at 5:00 pm AEST on 31 March 2011 (Promotion Period). Entries are deemed to be received at the time of receipt and not at the time of transmission by the entrant. Late entries will not be accepted.
6.To enter, an entry form must be completed online at
www.premiermortgage.com.au. Only one entry per person will be accepted. By entering the draw, entrants acknowledge that they have read and understand and agree to be bound by these terms and conditions.
7.The first valid entry drawn at random will receive $100 dinner voucher at Dundees on the Waterfront restaurant. This voucher is not exchangeable or redeemable for cash. The total prize pool value is $100.
8.The draw will take place at Premier Mortgage Solutions's office at Shop 5, 512 Mulgrave Road, Earlville Qld 4870 at 4:00 pm AEST on 4 April 2011. The winner will be notified by telephone and confirmed by mail or email.
9.The result of any draw is final and no correspondence will be entered into.
10.If there is a dispute as to the identity of an entrant. Premier Mortgage Solutions reserves the right, in its sole discretion, to determine the identity of the entrant.
11.The prize value is expressed in Australian dollars. The prize winner should be aware that tax implications may arise as a result of claiming the prize and should seek independent financial advice prior to claiming the prize.
12.No responsibility is accepted for late, lost or misdirected entries.
13.Except for any liability that cannot be excluded by law, Premier Mortgage Solutions (including its officers, employees or agents) excludes all liability (however arising) for any claim, loss or damage arising in any way out of the Promotion including, but not limited to, where arising out of the following:
•Any technical difficulties or equipment malfunction (whether or not under the Premier Mortgage Solutions’s control);
•Any theft, unauthorised access or third party interference;
•Any entry or prize claim that is late, lost, altered, damaged or misdirected due to any reason beyond the reasonable control of Premier Mortgage Solutions;
•Any tax liability incurred by the winner; or
•Use of a prize
14.Should the prize for the Promotion remain unclaimed, Premier Mortgage Solutions may conduct a second chance draw at Shop 5, 512 Mulgrave Road, Earlville Qld 4870 at 4:00 pm AEST on 3 May 2011, subject to any directions given by any relevant State or Territory department or authority. The winner will be notified by telephone and confirmed by mail or email.
15.Premier Mortgage Solutions will collect personal information about entrants for the purposes of conducting the Promotion and awarding the prize. Entry is conditional on providing this information. Premier Mortgage Solutions may use that information in accordance with its Privacy Policy. A copy of the Premier Mortgage Solutions Privacy Policy may be obtained by visiting
www.premiermortgage.com.au and following the relevant links. A request to access, update or correct any information should be specifically directed to Premier Mortgage Solutions at Shop 5, 512 Mulgrave Road, Earlville Qld 4870 or by logging onto the Premier Mortgage Solutions website at
www.premiermortgage.com.au.
16.By entering the Promotion the entrant consents to Premier Mortgage Solutions using their personal information for marketing and promotional purposes. Premier Mortgage Solutions may require the winner to participate in any media exposure, including but not limited to promotional, marketing and publicity activities, without any further reference or payment or other compensation.
17.If, after entering the Promotion, the entrant wishes Premier Mortgage Solutions to cease using their personal information for marketing and promotional purposes, the entrant should contact Premier Mortgage Solutions using the details listed in clause 15. By entering the Promotion, the entrant also consents to their details being stored on the Premier Mortgage Solutions customer database and to receive regular updates via E News mailouts and email marketing campaigns both print and online.
18.The winners' personal information may be disclosed to State and Territory lottery departments as required by law and the winner’s name published as required under relevant legislation.
19.If the Promotion is not capable of running as planned due to any reason beyond the reasonable control of Premier Mortgage Solutions (including, but not limited to fraud, a state of emergency, natural disaster, war, technical failures or any other causes) Premier Mortgage Solutions reserves the right without liability to entrants to cancel, modify, terminate or suspend the Promotion.
20.Premier Mortgage Solutions in its absolute discretion reserves the right to verify the validity of all entries and to disqualify entrants if there is evidence of tampering with the entry process, including but not limited to techniques designed to avoid payment of call costs or submission of an entry not in accordance with these terms and conditions.
21.The agreement created under these terms and conditions is subject to the laws of the Queensland and entrants and Premier Mortgage Solutions submit to the non-exclusive jurisdiction of the courts of that State.
22.If a provision of these terms and conditions is invalid, illegal or unenforceable, then to the extent of the invalidity, illegality or unenforceability, that provision must be ignored in the interpretation of these terms and conditions. All other provisions of these terms and conditions remain in full force and effect.
23.These terms and conditions constitute the entire agreement between entrant and Premier Mortgage Solutions in relation to the subject matter.
