1. This competition (“Competition”) is conducted by Coca-Cola South Pacific Pty Ltd, ABN 50 003 029 794, of Level 9, 40 Mount St, North Sydney, NSW 2060 (“Promoter”). Phone number 1800 427 797.
2. Entry into the Competition constitutes acceptance of these conditions. All entry instructions and prize information published by the Promoter form part of these conditions.
3. Only open to Eligible Entrants. An Eligible Entrant is an individual who is an Australian resident aged 13 years or older as at time of entry, excluding any: (i) employee of the Promoter or any of its related corporations or the participating outlets or any of their agencies associated with the Competition; (ii) employee of Coca-Cola Amatil (Aust) Pty Ltd, ABN 68 076 594 119 (iii) spouse, defacto spouse, parent, child or sibling (whether natural or by adoption) of an excluded employee; and (iv) person who the Promoter has previously notified is not permitted to enter the Promoter’s competitions.
4. The Competition opens for entries at 00:01 hrs on 01/03/2011 and closes at 24:00 hrs on 15/04/2011 ("Entry Period"). All times and dates are times and dates in Sydney which will be Australian Eastern Daylight Time (“AEDT”) during the Entry Period. All times are stated using the 24 hour clock. 00:00 hrs is the start of a day and 24:00 hrs is the end of the day.
5. “Promotional Product” means any ’Diet Coca-Cola’ 15 can pack displaying a promotional label advertising the Competition from any participating outlet.
6. To be eligible to enter, the Eligible Entrant must purchase a Promotional Product displaying a promotional label during the Entry Period.
7. Entry can only be made via the internet.
8. To enter via the internet, an Eligible Entrant must visit
www.cocacola.com.au (“Competition Website”) and follow the directions to firstly register for a ‘Coca-Cola’ account if he/she has not done so already. If an Eligible Entrant has not previously registered for a ‘Coca-Cola’ account, he/she will be required to create an account by providing an e-mail address, date of birth, first name, last name, password, contact number, postcode and state. An Eligible Entrant must not register more than once. Once registered, the Eligible Entrant must visit the Competition Website (if they are not already at the Competition Website) and, in accordance with the directions, during the Entry Period, provide: (a) the Eligible Entrant's email address and password, as established during registration; (b) the last five (5) digits of the Promotional Product barcode of the Promotional Product being used to enter; and (c) the last four (4) digits of the transaction number (“Trans No.”) printed on the purchase receipt. An Eligible Entrant must not use more than one (1) account to submit entries on the Competition Website.
9. Any cost associated with accessing the Competition Website is the individual’s responsibility and is dependent on the internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an individual to automatically enter repeatedly is prohibited and may render all entries submitted by that individual invalid.
10. The Promoter reserves the right, at any time, to verify the validity of entries and Eligible Entrants (including an Eligible Entrant’s identity, age and place of residence) and to disqualify any Eligible Entrant who, in the Promoter’s reasonable opinion, submits an entry that is not in accordance with these conditions or who tampers with the entry process. Errors and omissions will be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
11. Incomplete or indecipherable entries will be deemed invalid.
12. Multiple entries permitted, subject to these conditions, including the following: (a) only one (1) entry permitted per Promotional Product purchased; (b) each entry must be submitted separately and in accordance with entry requirements and these conditions; (c) unrecognised barcodes or Trans No.s will be deemed invalid; and (d) a maximum of one (1) entry per Eligible Entrant per day via the internet is permitted.
13. Entrants must retain their Promotional Product barcode as well as a photocopy of their purchase receipt(s) for all entries as proof of purchase. Failure to produce the proof of purchase for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an entrant’s entries and forfeiture of any right to a prize.
14. Entries received between 00:01 hrs on 01/03/2011 and 24:00 hrs on 15/03/2011 will be entered into the daily draw for 15/03/2011, which will take place on the following day. Entries received between 0:01hrs and 24:00hrs on each day between 16/03/2011 and 15/04/2011 will be entered into the daily draw for that day, which will take place on the following day, except as set out below. There will be one (1) daily draw on each day between 16/03/2011 and 18/04/2011, excluding any Saturdays, Sundays or NSW Public Holidays. The daily draws for entries received on a Friday, Saturday, Sunday or NSW Public Holiday, will take place on the following NSW working day. All entries in each draw will be entered into any subsequent draws, except where the entry is selected as a provisional winner. The daily draws will take place at Handling Matters, 1/3 Green Street, Brookvale NSW 2100 Australia at 11:00 hrs. If there are no entries for a particular day, the prize for that day will be awarded in the unclaimed prize draw. Provisional winners will be notified in writing by mail and phone within 2 days of being drawn. All provisional winners will only be deemed winners once verified by the Promoter. If a provisional winner is found not to be an Eligible Entrant, or their entry is deemed invalid under these conditions, the prize for that day will be awarded in the unclaimed prize draw.
15. All provisional winners’ names will be published online on the day or day after they are drawn as a provisional winner at
www.cocacola.com.au with the first online publication on 16/03/2011 and the last online publication on 19/04/2011.. SA and VIC provisional winners will be published in The Australian on 20/04/2011.
16. The Promoter’s decision is final and no correspondence will be entered into.
17. Prizes: There will be a total of thirty two (32) prizes to be won. Each prize is a size M, nine (9) carat white gold solitaire ring set with one (1) natural full cut round brilliant diamond approx 0.30 carats valued at $1,000.
18. If the prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
19. Total prize pool value is $32,000.
20. Prizes are not transferable or exchangeable and cannot be taken as cash.
21. A draw for any unclaimed prizes may take place on 01/07/2011 at the same time and place as the original draw subject to any directions from a regulatory authority. Provisional winners, if any, will be notified in writing by mail and by phone within 2 days of being drawn and will be published online at
www.cocacola.com.au on 15/07/2011. SA and VIC winners, if any, will be published in The Australian on 21/07/2011.
22. Entrants consent to the Promoter using the Eligible Entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this Competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
23. It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and the prize supplier’s requirements.
24. If for any reason the conduct or operation of the Competition is interfered with or disrupted in any way (including by vandalism, power failures, natural disasters, acts of God, civil unrest, strikes, computer bugs or viruses, tampering or technical failures), the Promoter reserves the right to cancel, terminate, modify or suspend or recommence the Competition, subject to the approval of the authorities that have issued permits for its conduct.
25. The Promoter assumes no responsibility for: (i) any error, omission, interruption, or delay in the operation or transmission of any communication sent to (or by) the Promoter or any entrant whether caused by problems with communication networks or lines, computer systems, software or internet service providers, congestion on any carrier network or otherwise, (ii) any theft, destruction or unauthorized access to, or alteration of such communications; (iii) any problem with, or technical malfunction of, any computer system or other equipment used for the conduct of the Competition; (iv) any incorrect or incomplete information which may be communicated in the course of the administering this Competition (whether as a result of one of the foregoing causes or otherwise); (v) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (vi) any variation in prize value to that stated in these conditions; (vii) any tax liability incurred by a winner or Eligible Entrant; or (viii) use of a prize. CAUTION: ANY ATTEMPT TO CAUSE DAMAGE TO ANY WEBSITE OR THE INFORMATION ON ANY WEBSITE ASSOCIATED WITH THIS PROMOTION OR TO OTHERWISE UNDERMINE THE FAIR AND LEGITIMATE OPERATION OF THIS COMPETITION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. THE PROMOTER RESERVES THE RIGHT TO SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW IN THE EVENT THAT ANY SUCH ATTEMPT IS MADE, WHETHER OR NOT THAT ATTEMPT RESULTS IN ANY SUCH DAMAGE, INTERFERENCE OR UNDERMINING.
26. To the full extent permitted by law, the Promoter, its related companies and Coca-Cola Amatil (Aust) Pty Ltd ABN 68 076 594 119 and agencies and all those entities' personnel (the "Relevant Parties") exclude all liability for any loss (including any damage, claim, injury, cost or expense) which is suffered or incurred by any Eligible Entrant in connection with the Competition or prizes, including: (i) any indirect, economic or consequential loss; (ii) any loss arising from the negligence of a Relevant Party; (iii) any liability for personal injury or death. Nothing in these conditions limit, exclude or modify or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia.
27. Eligible Entrants' personal information will be collected by or on behalf of the Promoter to enable it to administer the Competition and publicise its winner(s) and, if an Eligible Entrant consents, may be used to market its products to the Eligible Entrant. The personal information of each winner may be provided to others assisting in the conduct of the Competition, including the Competition administrator, prize suppliers and deliverers, and to regulatory authorities. Persons may contact the Promoter by visiting
www.coca-cola.com.au to request access to, or corrections of, any of their collected personal information that is held by the Promoter. If an Eligible Entrant does not provide accurate personal information the Promoter may determine that they are not eligible to win a prize.
