“COATES HIRE DREAM MACHINE” PROMOTION FOR

COATES HIRE OPERATIONS PTY LIMITED ACN 074 126 971

HOW TO ENTER

1. To be eligible to enter, individuals must  hire any equipment(s) (“Eligible Hire”) from the Promoter under a hire agreement, in one of the following ways:

a. In-store: visit any Coates Hire store nationally to make an Eligible Hire between 28/03/11 and close of business on 15/05/11;

OR

b. Phone: call 13 15 52 and leave the requested details when prompted between 28/03/11 and 5pm (local time) on 15/05/11.

2. To enter, individuals must then complete any one of the following steps between 28/03/11 and 11:59pm AEST on 15/05/11 (“Promotional Period”):

a. Visit www.coateshire.com.au, follow the prompts to the promotion entry page, fully complete and submit the entry form as prompted including their full name, date of birth, gender, residential address, daytime contact number, a valid email address, full hire agreement number (as found on their hire agreement) and details of the equipment hired, so that it is received during the Promotional Period.

OR

b. Send an SMS to 19 999 889 containing their full hire agreement number (as found on their hire agreement), full name and residential postcode, (in that order, with a space between each word and no spaces between the numbers) so that it is received during the Promotional Period.

Premium SMS cost is 55c. Entrants must have premium service access. SMS Provider: Be Interactive. SMS helpline: 1800 65 33 44.

 

TERMS AND CONDITIONS

Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
Except as detailed in paragraph 4 below, entry is only open to Australian residents aged 18 years or over. For the sake of clarity, an individual making an Eligible Hire on behalf of their company can only enter themselves into the promotion.
To be eligible to enter, entrants must: (a) accurately complete and sign a new hire agreement with the Promoter; (b) be within the Promoter’s trading terms throughout the Promotional Period; and (c) must not have overdue monies owing as at the time of the relevant draw or instant win notification, in order to be eligible to claim a prize. A hire agreement does not include the purchase of consumables or sale items.
Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin. Employees of Customers of the Promoter (and their immediate families as defined above) are ineligible to enter unless the employee has obtained the written authorisation of the Customer. The Promoter has the right to request a copy of such written authorisation before awarding any prize. No person can enter the competition if to do so would breach any internal policy of their employer.
The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age, place of residence and employment) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process including but not limited to tampering by way of use of techniques designed to avoid the payment of SMS costs. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
The Promoter requires the employee of a company to disclose all details of their entry and individual hire agreements to their employer. Disclosure is the sole responsibility of the company and its employee and the Promoter is not responsible in the event of non-disclosure.
Incomplete or indecipherable entries will be deemed invalid.
Multiple entries permitted, subject to the following: (a) only one entry permitted per Eligible Hire; (b) each entry must be submitted separately and in accordance with entry requirements; (c) unrecognised hire agreement numbers will be deemed invalid; and (d) a maximum of five (5) entries per person per or company per week during the Promotional Period is permitted. Entry count is reset to coincide with weekly draw as per below draw table in clause (11).
If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
Entries are deemed to be received at the time of receipt into the promotion database and NOT at the time of transmission by the entrant.
Promotion commences on 28/03/11. Eligible Hires must be made by close of business on 08/05/11 (for in-store hires), by 5pm (local time) on 15/05/11 (for phone hires) and by 11:59pm AEST on 15/05/11 (for online hires).  Final entries close 11:59pm AEST on 15/05/11. All draws including the  major prize draw will take place at 3pm AESST/AEDST (as the case requires) at Greeneagle Distribution & Fulfilment, Unit 10/20-28 Rickety Street, Mascot NSW 2020 at the time indictacted in the table below. The Promoter reserves the right to draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn.Winners will be notified in writing and via telephone. Winner of the major prize will have their name published in The Australian Newspaper on 15/06/11.

A  draw will be conducted weekly to determine the minor prize winners as per the table above. The first two (2) valid entries drawn in each minor prize draw will win a V8 Hot Lap Voucher in the winner’s nearest region valued at up to a maximum of $299.00 RRP. If the winner is from Western Australia or South Australia they will be awarded a $299.00 Ticketek voucher in lieu of the V8 Hot Lap Voucher. The next three (3) valid entries drawn in each minor prize draw will win a V8 double supercars general admission race pass to the V8 Super Car event in the winner’s nearest region valued at up to a maximum of $150.00RRP. If the winner is from Western Australia or South Australia they will be awarded a $150.00 Ticketek voucher in lieu of the V8 Super Car event pass. Total minor prize pool is valued at $7,318.00. At the end of the Promotional Period, a draw will be conducted from all entries received, with the first valid entry drawn winning the major prize of a Holden VE Series 2 SSV Redline Ute, including dealer delivery, registration, CTP, all on road costs and stamp duty, valued at up to RRP $49,990, plus up to $10,000 worth of extra’s. These extra’s include; encompassing exhaust, airbox and engine recalibration, lowering kit, revised spring rate, high flow headers valued at up to $10,000. Total major prize is valued at up to $59,990.00 RRP. The winner will be able to choose the colour of the prize depending on stock availability at the time of the draw. The winner will be required to pay for any extras that are not standard features of the major prize including metallic paint. The major prize can only be dispatched from a dealer or organisation nominated or chosen by the Promoter. The winner must also be prepared to take delivery of the major prize by visiting the Holden dealer nominated the Promoter nearest to the ordinary residential address of the winner. The winner is responsible for all costs incurred by them, including transport and freight charges to and from the nominated Holden dealer, in taking delivery of the major prize.
Any ancillary costs associated with redeeming the V8 Super Car event pass or the Ticketek voucher are not included. Any unused balance of a Ticketek voucher will not be awarded as cash. Redemption of a Ticketek voucher or V8 Super Car pass is subject to any terms and conditions of the issuer.
To be eligible to claim the major prize, the winner must be able to legally obtain motor vehicle registration of the major prize in his or her name in accordance with the applicable legislation in the Australian State or Territory in which the major prize is collected. If the winner is, through any legal incapacity or otherwise, unable to register the major prize in his or her name, then such winner may at their own cost, assign the major prize to another person with legal capacity for the purpose of registration.
In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion, subject to any written directions from a relevant regulatory authority.
 If for any reason a winner does not take the prize (or an element of the prize) by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited.
If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
Total prize pool value is up to $67,308.00.RRP Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless stipulated otherwise.
An unclaimed prize draw to award any unclaimed prizes, will take place at Greeneagle Distribution & Fulfilment, Unit 10/20-28 Rickety Street, Mascot NSW 2020 on 15/08/11 at 3:00pm, subject to any written directions from a regulatory authority. The winner if any will be notified in writing within two (2) days of the draw. If the major prize is awarded via the unclaimed prize draw, the winner will be published in The Australian on 15/06/11.
Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
Except for any liability that cannot be excluded by law, including the Non-Excludable Guarantees, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of  the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions;(e) if the V8 Super Car event is cancelled for any reason beyond the reasonable control of the Promoter; (f) any tax liability incurred by a winner or entrant; or (g) use of the prize / attendance at the V8 Super Car event.
The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.
