Competition overview
This overview forms part of the general Terms and Conditions for “Win a $5,000 It’s All
About You Grant” (competition). The promoter is the Australian Radio Network. “Win a
$5,000 It’s All About You Grant” will air on Mix101.1 Melbourne.
Listeners will be invited to participate in “Win a $5,000 It’s All About You Grant”, by visiting
one of the following 5 HomesNow display centres – Beveridge, Cranbourne East x 2,
Pakenham and Wyndham Vale. When visiting one of the nominated display centres,
listeners will need to SMS the unique code word, along with their name and suburb to 1977
1011. At the end of the campaign 1 (one) listener who has correctly entered the competition
will win the $5,000 It’s All About You Grant.
1 GENERAL
1.1 The Australian Radio Network’s (ARN) “Win a $5,000 It’s All About You Grant”
(Competitions) begins on 9am Monday 7th March 2011 and ends 11.59pm on
Sunday 27th March 2011. Please note that entry times are also subject to the
HomesNow Display Centre times.
(a) Listeners will be eligible to participate in “Win a $5,000 It’s All About You
Grant” competition between the above dates and times.
(b) Registrations for participation in “Win a $5,000 It’s All About You Grant”
will only be accepted via SMS at the specified HomesNow Display
Centres.
1.2 The Competition will be conducted in accordance with these Competition Rules.
Participation in this competition:
2 ENTRY DETAILS
2.1 Listeners will be invited to participate by visiting the following HomesNow Display
Centres – Beveridge, Cranbourne East x 2, Pakenham and Wyndham Vale. When
visiting one of the nominated display centres, listeners will need to SMS the unique
code word, along with their name and suburb to 1977 1011. At the conclusion of
the campaign, 1 (one) listener who has correctly entered the competition will win
the $5,000 It’s All About You Grant.
(a) Entrants can enter as may times as they like
(b) The winners will be awarded their prize at the conclusion of the
promotion by phone & mail and must take their prize in accordance with
the terms and conditions set out as part of entry of this competition.
Winners will be required to collect their prize from the ARN Studios at
Level 2, 21-31 Goodwood Street, RICHMOND 3121 during business hours.
Winners can request in writing to have their prize posted, however,
Mix101.1 takes no responsibility for prizes that are lost/go missing.
(c) Entry is open to all ages. If someone under the age of 18 wins – their
prize will be awarded to their parent or legal guardian on their behalf.
2.2 The major prize draw will take place between 9am and 5pm on Monday 28th March
2011, at the Mix101.1 Studios – Level 2, 21-31 Goodwood Street, Richmond VIC
3121.
2.3 By participating in this Competition, all entrants agree to be bound by the terms of
the Competition Rules.
3 THE COMPETITION PROCESS
3.1 The competition consists of 1 segment
(a) Selection of participants as detailed in section 1 of these Terms and
Conditions
3.2 The prizes awarded to winners in Victoria consist of:
(a) 1 x $5,000 cash (issued in cheque form)
The total prize pool has a value of $5,000
The prize value is accurate as at the promotion date. The Promoter accepts no responsibility
for any variation in prize value after that date. The prize is not transferable or exchangeable.
If for any reason the prize is not available, the Promoter reserves the right to substitute
another item for it, in its sole discretion, of equal or higher value.
Mix101.1 its associated agencies and companies shall not be liable for any loss (including,
without limitation, indirect or consequential loss), damage, personal injury or death which is
suffered or sustained (including but not limited to that arising from any person's negligence)
in connection with this promotion or accepting or using the prize/s, except for any liability
which cannot be excluded bylaw (in which case that liability is limited to the minimum
allowable by law)The decision of ARN will be final and conclusive and no discussion or
correspondence will be entered into.
Promotions are not open to:
(a) employees of, or contractors to, the Promoter or any of its agencies
involved with the Promotion;
(b) the spouse, de facto spouse, parent, natural or adopted child, or sibling
(whether natural or adopted by a parent) of such employees and
contractors (whether or not they live in the same household);
(c) any person who is discovered to have used or attempted to use any more
than one name in order to qualify to win any Promotion run by the
Promoter except in the case of a legal change of name;
(d) any person where that person or anyone from the same family or
household has won a prize or prizes from the Promoter or any radio
station that is a member of the Australian Radio Network, valued either
individually or collectively at more than $500 in the 30 days prior to the
commencement of the Promotion
(e) All prizes are accepted entirely at the risk of the contestants and
ARN excludes all warranties in connection with any prize (including
representations as to merchantability and fitness for purposes) to
the extent permitted by law.
(f) Any special conditions associated with the cash or prizes on offer
will be announced during the recording of the Segments. The
conditions must be adhered to in order to claim the cash or prize.
(g) ARN, its employees, agencies, affiliates, sponsors and
representatives are not responsible for defective prizes or misuse
of any prize, or for any claims, liability, loss or damage (whether
foreseeable or not) arising out of or in connection with this
Competition, whether caused by the negligence of any of the
aforementioned or not.
3.3 Winners are responsible for any and all taxes payable as a result of a prize being
awarded or received.
4 TECHNICAL MALFUNCTION
4.1 If due to a technical difficulty with a telephone line, ISDN line, mobile telephone or
other technical instrument critical to the broadcast prevents the competition from
proceeding; the decision of ARN is absolute and final. No discussion will be entered
in to.
5 ARN’S DECISION IS FINAL
5.1 ARN’s decision in respect of the selection of participants is binding and conclusive
and can not be challenged on the grounds that ARN failed to act reasonably, fairly,
in good faith or otherwise in accordance with the principles of procedural fairness.
ARN’s decision will remain binding and conclusive notwithstanding that it can be
demonstrated that ARN made a decision that was wrong, based on a factual error
or an irrelevant or irrational consideration. It is not ARN’s policy to enter into
negotiations with listeners or that may challenge a decision made by ARN.
6 PROMOTIONAL ACTIVITIES
6.1 Each participant acknowledges and agrees that:
(a) he or she may be required by ARN, in its absolute discretion, to:
(i) participate in promotional activities for the benefit of ARN
(including participating in a sound recording, photograph, video
or film session); and
(ii) that he or she will not, without the prior written consent of ARN
(which may be given or withheld in its absolute discretion)
participate in any other media activities, promotions or events
for the purpose of or which involve discussion, commenting on,
expressing a view or giving an account of the Competition, ARN,
its related bodies corporate or the operations of ARN and its
related bodies corporate.
(b) in promotional activities referred to in condition 7.1 (a)(i) and (ii), above,
he/she will express a positive view of ARN and its operations and refrain
from expressing a negative or disparaging view of ARN, its related bodies
corporate or the operations of ARN or its related bodies corporate.
7 WITHDRAWAL
7.1 Notwithstanding any other condition of these Competition Rules, ARN reserves the
right to withdraw the Competition at any time and for any reason whatsoever with
the prior approval of the Victorian Commission For Gambling Regulation, the
Department of Gaming and Racing NSW, and the Queensland Office of Gaming and
Regulation. ARN shall not be liable in any way or for any consequence of
withdrawing the Competition.
