TERMS AND CONDITIONS
WHO IS ELIGIBLE TO NOMINATE AND ENTER


1. Entry is only open to residents of NSW, VIC, SA and QLD in Australia.

2. Entrants under 18 years old must have parental/guardian approval to enter and further, the parent/guardian of the entrant must read and consent to all Terms and Conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to this promotion.

3. Entrants who are renting their property must obtain their landlord’s approval in the event they win and permanent adjustments need to be made to the property (the installation of solar panels, hot water systems, heating or cooling appliances, etc).

4. Individuals residing at a government owned property are not eligible to enter. Individuals are not eligible to enter on behalf of businesses and/or schools.

5. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are also ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

6. For the sake of clarity, each unit or suite in an apartment building will be considered as one (1) property. In addition, units that are part of separate buildings/structures on the same street number will be considered as individual properties. Townhouses that are joined in one building/structure but with separate street numbers will also be considered as individual properties. Furthermore, any property of any type of residence that spans over multiple street numbers will only be considered as one (1) property.

7. Only one (1) representative of each eligible property can nominate the eligible property and enter this promotion.

8. Limit of one (1) nomination and entry per person and per eligible property.

9. Any disputes about eligibility for this promotion will be determined by the Promoter, in its absolute discretion.

10. “Entrant” means both an individual who nominates their property and an individual who registers to support the entry of one of the neighbours in their street (“Supporting Neighbour”).

11. An individual may only be a Supporting Neighbour or submit their own entry, they cannot do both.
PROMOTIONAL PERIOD

12. This promotion commences on 06/03/2011 and ends at 11.59pm AEST on 15/05/2011 (“Promotional Period”).

HOW TO NOMINATE YOUR PROPERTY

13. To be eligible to enter, eligible individuals must nominate their current residential property in this promotion during the Promotional Period, by one (1) of the following methods:

a. Online: visit www.originenergy.com.au, follow the prompts to the promotional nomination page and complete the nomination process during the Promotional Period by:
i. inputting the requested details including their property street address, their full name and a valid email address;
ii. ticking the box that acknowledges they agree to these Terms and Conditions;
iii. choosing whether to tick the box to confirm that they are an existing Origin electricity and/or natural gas customer;
iv. choosing whether to tick the box to allow the Promoter to contact them about this promotion and for marketing purposes; and
v. choosing whether to tick the box to allow their house number and property street name and suburb to be provided to individuals living on their street who also nominate their own property, and
vi. submitting their nomination,
(“Nomination Process”); OR

b. Phone: call 13 47336 (13 GREEN) and provide the requested details, including their full name and a valid email address, for the Promoter to send them an email with a link to the promotional website. The individual must then follow the prompts to click through the email to the promotional nomination page and complete the Nomination Process during the Promotional Period. Standard call charges apply; OR

c. SMS: send an SMS to 1300 296 842 containing their full name and a valid email address. The individual will then receive an email from the Promoter. The individual must then follow the prompts to click through the email to the promotional nomination page, and complete the Nomination Process during the Promotional Period. Standard messaging rates apply. SMS entry cost will vary dependent on the mobile network used but will not exceed 55c.

14. Upon successful nomination:

a. individuals will be sent a confirmation email from the Promoter that confirms that they have successfully nominated their property. A username and password will also be given, allowing them to log into their nomination on the promotional website to create and submit their entry and invite neighbours on their street to register to support their entry;

b. if they choose to do so (by ticking the relevant box on the nomination page as set out above) individuals will have their name, house number and their property street name and suburb made available to other individuals living on their street who nominate their own property.

15. Entrants will also be able to download an electronic recruitment kit (which will give them some guidance on how to recruit eligible neighbours living on their street) from the promotional website once they have successfully nominated their property. Entrants can request a recruitment kit to be posted to them (if desired) by calling 13 GREEN (13 47336) and providing their full name and postal address so that the request is received by the Promoter on or before 11:59pm AEST 02 May 2011.

16. To be eligible to win a prize, individuals who nominate their property must submit an entry to the Promoter during the Promotional Period.

HOW TO ENTER AND PUBLICATION OF YOUR ENTRY

17. Nominees who wish to submit an entry (as opposed to registering as a Supporting Neighbour) must visit www.originenergy.com.au, follow the prompts to the log-in page, and:

a. enter their username and password to access their nomination;

b. follow the prompts to upload their entry (whether that is text, video, images or a combination of all three), in response to the promotional question “Tell us about your street, and why you would like to win?”;

c. choose whether to tick the box to allow their street name to be published with their entry – including on the promotional website (their first name, suburb and state will be published with their entry even if they do not tick this box); and

d. submit their fully completed entry by 11:59pm AEST on 15/05/2011.

18. Once an entry is received by the Promoter, the entry (i.e. the text, video or image/s the entrant has submitted to tell the Promoter about their street and why they would like to win) will be uploaded onto the promotional website, including linked to their property location on a map. The amount of personal information published with the entry (and level of detail shown on the map) will depend upon the entrant’s choice as referred to in clause 17(c) above.

19. All entries will be reviewed by the Promoter. The Promoter reserves the right not to upload an entry onto the promotional website, in its absolute discretion, if the entry does not comply with these Terms and Conditions.

HOW TO REGISTER AS A SUPPORTING NEIGHBOUR

20. Once an individual has nominated their property, they can invite neighbours on their street to register as Supporting Neighbours by sending those neighbours an email via the promotional website.

21. For the sake of clarity, a street is considered to be a continuous stretch of road with the same street name which may or may not span across multiple suburbs.
22. Eligible neighbours who receive an email can then register as a Supporting Neighbour by following the prompts to click through the email to the Supporting Neighbours registration page and complete the registration process during the Promotional Period by:

a. inputting the requested details including their house number, their full name and a valid email address;

b. ticking the box that acknowledges they agree to these Terms and Conditions;

c. choosing whether to tick the box to confirm that they are an existing Origin electricity and/or natural gas customer;

d. choosing whether to tick the box to allow the Promoter to contact them about this promotion and for marketing purposes; and

e. submitting their registration.

Entrants should only nominate eligible neighbours who they have a direct relationship with, and who consent to receiving these types of promotional messages.

23. Once they successfully submit their registration, Supporting Neighbours will see a message on the website telling them their registration was successful.

24. There is a limit of 19 Supporting Neighbours per entry.

25. Supporting Neighbours will only win a prize if the individual whose entry they register to support wins a prize for that entry.

THE PROMOTIONAL QUESTION

26. The response to the promotional question “Tell us about your street, and why you would like to win?” must be provided in one (or a combination) of the following formats:

a. Text: in two-hundred (200) words or less;
b. Video: must not exceed three (3) minutes in duration; and/or
c. Images: up to 5 images.

27. Uploaded video files must be submitted in MPEG4, 3GPP, MOV, WebM, AVI, MPEGS, WMV or FLV file format and must not exceed 1GB file size.

28. Uploaded image files must be at least 400 pixels (wide) x 400 pixels (high), must be submitted in JPEG, PNG, GIF format and must not exceed 5MB file size. Large images will be scaled down proportionately to 1000 pixels (wide) x 1000 pixels (high) for publication on the promotional website.

29. Videos or still images cannot feature any prominent third party trade marks or logos (including prominent trade marks or logos on clothing, as determined by the Promoter in its absolute discretion) and cannot refer to any third party or brand.

PUBLIC VOTING

30. Once an entry is received by the Promoter, the entry (i.e. the text, video and/or image/s the entrant has submitted to tell the Promoter about their street and why they would like to win) will be uploaded onto the promotional website for public voting between 21/03/2011 and 11:59pm AEST on 15/05/2011.

31. All votes must be submitted in accordance with the voting Terms and Conditions (available at [INSERT DIRECT URL LINK]) in order to be counted.

32. At the end of the voting period, the individual who submitted the entry that received the most valid votes on the promotional website and any of their Supporting Neighbours will share in a total of $10,000 (GST inc), awarded in the form of a cheque. The prize money will be divided depending on how many Supporting Neighbours an entry has. For example, if the entry that received the most valid votes on the promotional website has four (4) Supporting Neighbours then the $10,000 prize will be divided equally amongst the individual who submitted the entry and the Supporting Neighbours (ie 5 people in total, with each of them to receive $2,000 (GST inc)). In the event that the entry that received the most valid votes on the promotional website has no Supporting Neighbours, then the individual who submitted that entry will receive the entire $10,000 prize.

33. In the event of a tie between entries with the highest number of valid votes, the Promoter will determine the best entry (from all tied entries) based on the number of Supporting Neighbours and the quality and creativity of the entry. In this event, the Promoter’s decision is final and correspondence will not be entered into.

34. The winner of the $10,000 prize will be announced on or around Monday 4 July 2011 by email or letter.

FINALISTS

35. All valid entries received will be divided into participating State groups and then individually judged by the Promoter’s panel of judges based on the number of Supporting Neighbours and the quality and creativity of the answer to the promotional question.

36. The Promoter will also contact and/or visit entrants to inspect the properties of the entrants (i.e. the property of the individual entrant and/or the properties of each Supporting Neighbour) and assess their suitability for sustainable products (based on the structure and condition of the buildings and any other relevant factors, as decided by the Promoter in its absolute discretion).

37. The Promoter will select a minimum of two (2) entries from each participating State group. For each selected entry, the individual who submitted the entry and any of their Supporting Neighbours will be finalists (“Finalists”). These entries and Finalists will each have the opportunity to go through to the next judging stage. The individual who submitted the entry chosen as a Finalist will be announced via email or letter (or any other medium determined by the Promoter in its sole discretion) on or around Monday 27 June 2011.

38. The Finalists may be required to participate in interviews, property and street assessments, publicity events, photo shoots and/or other broadcasts surrounding their entry, at the Promoter's reasonable request, without any remuneration.

39. All Finalists will be required to sign a Licence, Consent and Release Form (“Form”), the content of which will be determined by the Promoter in its absolute discretion. If a Finalist does not sign the Form, that Finalist will be disqualified. Where the Finalist that is disqualified is the individual who submitted the entry, then any Supporting Neighbours will also be disqualified and an alternative entry will be selected by the panel of judges.

40. The judges reserve the right to select additional reserve entries at any stage in this promotion which they determine to be the next best, and record them in order, in case of an invalid entry, disqualification, ineligible entrant or Supporting Neighbour.

WINNERS

41. The Promoter’s panel of judges will then individually judge all Finalists based on: overall participation; the quality and creativity of their entry; and the enthusiasm of the entrant(s) throughout the finalist stage. This will determine the four winning entries (i.e. one winning entry from each participating State group) and winning entrants (ie the individual who submitted the entry and any Supporting Neighbours) (“Winners”). The individual who submitted the entry chosen as a winner will be notified via email or letter (and published in any other medium determined by the Promoter in its sole discretion) on or around Monday 4 July 2011.

42. If the winning entry was submitted by an individual without any Supporting Neighbours then only that individual will win a prize. If the winning entry was submitted by an individual with Supporting Neighbours, that individual and each Supporting Neighbour will win a prize. For example, if the winning entry is submitted by an individual with three (3) Supporting Neighbours, then all four entrants will each win a prize.

43. Each prize is an Origin sustainable energy package valued at up to $12,500 (GST inc), which will include:

a. An in-home display device; and

b. An energy audit of the property conducted by the Promoter (or any of its related bodies corporate).

44. Once the energy audit of each Winner’s property has taken place, the Promoter will arrange for some or all of the following prizes to be awarded to each Winner, based on the outcome of the energy audit and suitability of the property (as determined by the Promoter in its sole discretion), as follows:

a. 12 months supply of electricity (including 100% GreenPower) from Origin Energy Electricity Limited (ABN 33 071 052 287) for the property up to the value of $3,000 (inc GST). Value is calculated including usage charges and all other charges applicable under Origin’s standard terms and conditions;

b. 12 months supply of natural gas (including GreenGas) from, in NSW, Origin Energy LPG Ltd (ABN 77 000 508 369), in SA and QLD, the Promoter, and in Victoria, the Promoter in and around Mildura and, in all other areas of Victoria, Origin Energy (Vic) Pty Ltd (ABN 11 086 013 283) for the property up to the value of $2,000 (inc GST). Value is calculated including usage charges and all other charges applicable under Origin’s standard terms and conditions. Individuals must be living in an area where natural gas is available in order to receive this element of the prize;

c. A solar photovoltaic system, installed on the roof of each Winner’s property (if required);

d. A solar hot water system (if required) or energy efficient hot water service;

e. Origin vouchers to spend on products, like heaters and air-conditioning units (and any other appropriate products, as determined by the Promoter in its absolute discretion), from Origin destination stores (if available in their State); and/or

f. Any other appropriate products (including costs of installation if required) as determined by the Promoter in its absolute discretion.

45. The Promoter will liaise with each of the Winners to determine the exact products and/or services suitable for their property (including the value of the Origin vouchers awarded, if available in their State).

46. If a Winner is not a current Origin customer, they will be required to transfer their electricity/natural gas supply to Origin and agree to Origin’s standard electricity/gas terms and conditions and GreenPower terms and conditions in order to receive the electricity/natural gas elements of the prize (if applicable). Winners should check with their current electricity/natural gas supplier to determine whether they may be liable to pay early termination fees for switching to Origin.

47. If for any reason a Winner does not take a prize (or an element of the prize) by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited.

48. If a prize (or part of the prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification.

49. Prizes (or any unused portion of a prize) are not transferable or exchangeable and cannot be taken as cash.

50. The prize will be for use at each Winner’s residential property, as nominated at the time of entry, and cannot be used for any other properties. If a Winner resides in a building with multiple residences, only the Winner’s section of the property (as provided at the time of entry) will receive the prize.

51. In the event that a Winner is renting their property, any products awarded as part of the prize that are not affixed to the property will be deemed to be owned by the Winner. Any products awarded as part of the prize that are affixed to the property will be deemed to be owned by the landlord.

52. In the event Origin vouchers are awarded:

a. any ancillary costs associated with redeeming the Origin vouchers are not included;

b. any unused balance of the Origin vouchers will not be awarded as cash; and

c. redemption of the Origin vouchers is subject to any terms and conditions of the Promoter including those specified on the Origin vouchers.

53. As a condition of accepting a prize, each Winner must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form and the Promoter’s standard terms and conditions of supply and/or installation (as applicable to the products awarded as part of the prize).
GENERAL

54. Participation in this promotion is deemed acceptance of these Terms and Conditions.

55. This is a game of skill and chance plays no part in determining any winner.

56. Any costs associated with entering this promotion, including any costs associated with preparing the response to the promotional question, are the sole responsibility of the entrant.

57. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age, place of residence and/or ownership of property) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions will be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

58. Incomplete, indecipherable or illegible entries will be deemed invalid.

59. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

60. The Promoter’s decision and that of its panel of judges is final and no correspondence will be entered into.

61. When an entrant submits any materials for this Promotion including comments, recordings and images (“Content”), the entrant, unless the Promoter advises otherwise, licenses and grants the Promoter, its affiliates and sub-licensees a non-exclusive, royalty-free, perpetual, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish and display such Content for any purpose in any media (including but not limited to, company brochures and other marketing and/or advertising material), without compensation, restriction on use, attribution or liability.

62. Entrants agree that they are fully responsible for the Content they submit. The Promoter shall not be liable in any way for such Content to the full extent permitted by law. The Promoter may remove any Content without notice for any reason whatsoever. Entrants warrant and agree that: (a) they will not submit any Content that is unlawful or fraudulent, or that the Promoter may deem in breach of any intellectual property, privacy, publicity or other rights, unreasonably commercial (i.e. tantamount to a ‘guerrilla marketing’ attempt), defamatory, obscene, profane, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin or gender, not suitable for children aged under 15, or otherwise unsuitable for publication; (b) they will obtain prior consent from any person who appears (or whose property appears) in their Content to the uses and terms herein, including without limitation the terms of the Privacy Statement in these Terms and Conditions; (c) they will obtain full prior consent from any person who has jointly created or has any rights in the Content, to the uses and terms herein; (d) their Content shall not contain viruses or cause injury or harm to any person or entity; and (e) they will comply with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and the access or use of others' computer or communication systems. Each entrant warrants to the Promoter that the entry that is submitted is an original work that does not infringe the rights of any third party. Entrants (and if applicable, all Supporting Neighbours) consent to any use of their entry which may otherwise infringe their moral rights pursuant to the Copyright Act 1968 (Cth)

63. Without limiting any other terms herein, all entrants (including Supporting Neighbours) agree to indemnify the Promoter for any breach of the above terms.

64. Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice (including photograph, film and/or recording of the same) in any media or context for an unlimited period worldwide without remuneration for the purpose of promoting this promotion (including any outcome), the Promoter, and any products or services manufactured, distributed and/or supplied by the Promoter.

65. Finalists and Winners must, at the Promoter's reasonable request, participate in all promotional activity (such as interviews, property and street assessments, publicity events, photo shoots and/or other broadcasts) surrounding their entry into this promotion, without any remuneration.

66. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant (including Supporting Neighbour); or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.

67. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.

68. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

69. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a Winner or entrant; or (f) use of a prize.

70. In the event that a prize is won by a minor, a person over the age of 18 that is responsible for the property corresponding to the prize winning entry will be required to sign legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
PRIVACY STATEMENT

71. Entrants’ personal information is collected by or on behalf of the Promoter and may be disclosed to the Promoter’s contractors and agents (including without limitation marketing and promotional agencies, information technology providers and database service providers) to conduct, administer and promote the Sustainability Drive promotion, and to send the entrant information about the promotion and about the Promoter’s products and services, (unless the entrant did not choose to receive such information when they completed the nomination form or supporting neighbour registration form). All offers and correspondence (including electronic messages) will include information about unsubscribing. The Promoter will continue to provide entrants with this information and these offers until advised otherwise by the entrant.

72. Subject to the opt in choices offered on the nomination and entry forms:

a. by nominating their street, entrants agree that their first name and house number will be made available to other people who have nominated in their street; and

b. by submitting their entry, entrants agree that their first name, street name, suburb and State may be published with their entry (which may include photos and videos) and will be made available to the general public, including on the Sustainability Drive website and that their first name, street name, suburb and state will be shown on a map on screen on the Sustainability Drive website.

73. Entrants who do not opt into having certain items of their personal information published will still be required, if selected as a Finalist or Winner, to agree to the publication of their first name, street name, suburb and State, in conjunction with their entry.

74. All entrants who are selected as Finalists or Winners (whether as an individual entrant or as a Supporting Neighbour) consent to the Promoter using their personal information (including without limitation their entry and their first name, street name, suburb and State) in any media or context for an unlimited period worldwide without remuneration for the purpose of promoting any of the Sustainability Drive promotion (including any outcome), the Promoter, and any of the Promoter’s products or services.

75. If an entrant does not provide the personal information requested, they may not be able to enter the promotion. If inaccurate personal information is provided, the Promoter may determine that the entrant is ineligible to win a prize.

76. If an entrant provides the Promoter with personal information about another person (such as an individual that appears in an entry submission), the entrant must tell that person about this privacy statement and obtain their consent (or the consent of their parent/guardian if they are under 18 years of age) to their personal information being collected, used and disclosed by the Promoter in accordance with this privacy statement.

77. Entrants may contact the Promoter on 13 24 62 to request access to the personal Information that the Promoter holds about them. The Promoter’s privacy policy is available at www.originenergy.com.au.
THE PROMOTER

78. The Promoter is Origin Energy Retail Limited (ABN 22 078 868 425) of Level 21, 360 Elizabeth Street, Melbourne VIC 3000.

“ORIGIN SUSTAINABILITY DRIVE – EXISTING CUSTOMERS” PROMOTION
HOW TO ENTER

To enter, individuals must nominate their property for the Sustainability Drive Promotion by either:

(a) visiting www.originenergy.com.au/ and following the prompts to the promotion entry page to input the requested details (including their street name) that correspond to their Origin account and submit the fully completed nomination form by 11:59pm AEST on 15/05/11; or
(b) calling 134 7336 and leaving the requested details (including their name and valid email address) to receive an email regarding this promotion from the Promoter. Once the entrant has received this email, they must then follow the prompts in the email to visit the promotional website and input the requested details (including their street name) that correspond to their Origin account and submit the fully completed nomination form by 11:59pm AEST on 15/05/11. Calls to the promotional number are charged at the standard rate. Calls from mobile and pay phones may attract a higher rate; or
(c) sending an SMS to 1300 296 842 containing their full name and valid email address to receive an email regarding this promotion from the Promoter. Once the entrant has received this email, they must then follow the prompts in the email to visit the promotional website and input the requested details (including their street name) that correspond to their Origin account and submit the fully completed nomination form by 11:59pm AEST on 15/05/11.
TERMS AND CONDITIONS

i. Information on how to enter and the prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

ii. Entry is only open to residents in NSW, Vic, SA and QLD who are living at a residential property supplied with Origin gas or electricity, whose name appears on the Origin gas/electricity bill.

iii. Entrants under 18 years old must have parental/guardian approval to enter and further, the parent/guardian of the entrant must read and consent to these Terms and Conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to the minor entering this promotion.

iv. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

v. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

vi. Only one entry permitted per person.

vii. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

viii. Promotion commences 06/03/11. Entries close at 11:59pm AEST on 15/05/11. There will be a draw for each week of the promotion. The draws will take place at Anisimoff Legal, Level 4, 448 St Kilda Road, Melbourne VIC 3004 on 14/03/11, 21/03/11, 28/03/11, 04/04/11, 11/04/11, 18/04/11, 27/04/11, 02/05/11, 09/05/11, 16/05/11 at 12pm. Undrawn entries in each draw will roll over into any subsequent draws.

ix. Winners will be notified by email or letter and have their first name and state published in an email sent to other Origin customers who have also entered the draw.

x. The Promoter’s decision is final and no correspondence will be entered into.

xi. The first five (5) valid entries drawn in each weekly prize draw will win a $200 credit on their Origin bill(s). In the event that the winner receives multiple Origin bills, the Promoter will determine which bill to allocate the credit to.

xii. Total prize pool value is $10,000.

xiii. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash.

xiv. As prizes will be automatically applied to the winner’s Origin bill, there will be no unclaimed prize draw.

xv. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

xvi. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

xvii. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.

xviii. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

xix. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) taking of the prize.

xx. The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.
