Conditions of Entry
1. This promotion is in no way sponsored, endorsed or administered by, or associated
with, Facebook. This competition is available to enter online between 11am AEST
Friday 1 April, 2011 and 4pm AEST Friday 22 April, 2011. To enter simply tell us in
25 words or less why you love the Lonely Avenue collaboration between Ben Folds
and Nick Hornby.
2. The competition is open only to Australian residents of ACT, New South Wales,
Queensland, South Australia, Victoria and West Australia aged 18 years and above
with the exception of those related to employees of the Promoter, their families,
agents and anyone else connected with this promotion.
3. The competition closes 4pm AEST Friday 22 April, 2011 subject to Paragraph 15
below. The Promoter, Penguin Books (Australia) accepts no liability for any problems
or technical malfunction of any telephone network or lines, computer on–line
systems, servers, or providers, computer equipment, software, technical problems
and/or traffic congestion on telephone networks or lines that cause late or delayed
entries, or for any lost and/or misdirected entries not received by the closing date.
4. Competition winners will be judged at 11am AEST Wednesday 27 April, 2011 at
Penguin Books (Australia), 250 Camberwell Road, Camberwell, Victoria, 3124 and
the winners’ name and state will be announced on
www.penguin.com.au/competitions and on Penguin Books Australia Facebook page from Wednesday 27 April, 2011.
5. The winner only will be notified by phone/email. You must claim your prize within
7 days after we notify you. Any prize that is unclaimed after 7 working days will
automatically lapse and the Promoter reserves the right to offer the unclaimed prize to
a substitute winner selected in accordance with these rules.
6. Books will be sent to you within 21 working days after claiming the prize.
7. Chance plays no part in determining the winner. Entries will be judged in regard to
skill and most creative reply.
8. Do not send any creative materials apart from your written entry, as no material can
or will be returned.
9. By entering this competition each entrant confirms that his/her entry is their
wholly-owned creation. Any entry that makes use of any third party materials must be
fully cleared prior to entry unless they are no longer protected by copyright or other
intellectual property rights. Entrants will indemnify and keep the Promoter harmless
from any claims arising from their entries, including for any infringement of any
personal or proprietary right of any other person.
10. The submission of an entry automatically constitutes and is deemed a grant by the
Entrant to the Promoter of a perpetual, royalty-free, non-exclusive licence to edit,
publish, translate, modify, adapt, make available and distribute the entry throughout
the world in any media now known or hereafter invented. Each entrant undertakes to
complete any necessary documentation to formalise the licence. Please do not submit
materials to us if you do not want to grant such rights to the Promoter.
11. All entries become the property of Pearson Group (Australia).
12. The judge’s decision is final and no correspondence will be entered into.
13. The first valid entry from ACT, New South Wales, Queensland, South Australia,
Victoria and West Australia judged as the winner will win two tickets (valued at
approximately $96.35 each) to the Ben Folds Lonely Avenue Tour concert in May
2011, from the same state as which the entry was received, and a copy of 31 Songs by
Nick Hornby (valued at $22.95rrp).

Tickets are to be used as prescribed by the terms & conditions outlined by the ticket’s
corresponding ticket agency. Penguin Books Australia accepts no responsibility for
lost, stolen or misplaced tickets.
14. The next five winners judged as runners’ up will each receive a piece of sheet
music signed by Ben Folds and Nick Hornby and a copy of 31 Songs by Nick Hornby
(valued at $22.95rrp).
15. The competition winners may be asked to take part in reasonable event publicity
and to the use of their names and photographs for such publicity at the Promoter’s
websites, and in online Penguin newsletters and Penguin’s social media sites.
16. Participation is not transferable and not redeemable for cash or any other goods or
services. If for any reason the promotion is not capable of running as planned, the
Promoter reserves the right in its discretion (subject always to any direction given by
a relevant gaming or lotteries authority) to cancel, terminate, extend, modify or
suspend the promotion. The Promoter may in its discretion disqualify any individual
who tampers or interferes with the participation process.
16. The personal information you submit as a participant will be collected by the
Promoter, Penguin Books (Australia). Your personal information will be stored and
used for purposes related to the Promotion and for direct marketing by Penguin Books
(Australia) in accordance with the applicable privacy legislation including the Privacy
Act 1988 (Cth). It will not be disclosed to any other organisation. A copy of the
