“APPLE iPAD GIVEAWAY”
TERMS AND CONDITIONS OF ENTRY
1. Information on how to enter and prizes forms part of these Terms and Conditions. Entry into the Malibu Rum Australia “Apple iPad Giveaway” promotion (“Promotion”) is deemed to be an acceptance of these Terms and Conditions.
2. Promotion commences at 9.00am AEST on 5 April 2011 and ends at 5.00pm AEST on 14 June 2011 (“Promotional Period”).
3. Entry is only open to Australian residents over the age of 18. Employees (and their immediate families) of the Promoter, or agencies or companies associated with the conduct of this Promotion, are ineligible to enter.
4. To enter, entrants must already have “liked” or, during the Promotional Period, “like” the Malibu Rum Australia Facebook page at http://www.facebook.com/MalibuRumAus. Once an entrant has “liked” the Malibu Rum Australia Facebook page, the entrant will be given the opportunity to complete and submit an online registration which will automatically enter the entrant into the draw to win the prize.
5. Entries are deemed to be received at the time of receipt by the Promoter. Records of the Promoter are final and conclusive as to time of receipt.
6. All valid entries received during the Promotional Period will be entered into a random prize draw, with the winning entry to be drawn at 12:00 midday (Toronto, Canada time) on 14 June 2011 at 411 Richmond St. E. #308, Toronto ON M5A 3S5.
7. This Promotion is a game of chance and skill plays no part in determining the winner.
8. The prize is an Apple i-Pad valued at $700 (including GST). "Apple" and "iPad" are registered trade marks of Apple, Inc. Apple, Inc. is not affiliated with, nor does it endorse, sponsor or support, the Promoter, Malibu Rum products or this Promotion.
9. The Promoter’s decision is final and no correspondence will be entered into. The winner will be notified by telephone and email on 15 June 2011. The winner’s name will be published on www.facebook.com/maliburumaus on 23 June 2011.
10. The Promoter encourages the responsible use of the prize, in accordance with applicable State and Territory legislation.
11. If the Promoter determines, in its absolute discretion, that the winner is not in the necessary condition to be the recipient of the prize, the Promoter reserves the right to refuse to award the prize to the winner.
12. The prize must be taken as offered and cannot be varied, transferred, exchanged or redeemed for cash. The Promoter retains the right to substitute the prize with a prize of equal or greater value (including where the prize is unavailable, for whatever reason).
13. The Promoter will take all reasonable steps to notify the winner. The Promoter may conduct such further draws as are necessary to determine a winner and to distribute the prize forfeited or unclaimed by the relevant time (subject to any written directions given under applicable State or Territory legislation). Such further draws will take place at the
same place as the original prize draw on 16 June 2011, as are necessary for an unclaimed prize. The winner of an unclaimed prize will be notified in writing.
14. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
15. If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel this Promotion, as appropriate.
16. Any cost associated with accessing the Malibu Rum Australia Facebook page is the entrant’s responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
17. This Promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook Inc. or Apple, Inc. Entrants understand that they are providing information to the Promoter and not to Facebook Inc. or Apple, Inc. The information provided will only be used by the Promoter for the purpose of administering this Promotion and awarding the prize to the determined winner.
18. Any questions, comments or complaints from entrants should be directed to the Promoter at the address listed in these Terms and Conditions and not to Facebook Inc.
19. By entering into this Promotion, each entrant agrees to release and indemnify and keep indemnified Facebook Inc. from and against all liability and forever forego and abandon all rights and causes of action against Facebook Inc. arising as a result of the Promoter conducting this Promotion.
20. There is no association or endorsement or sponsorship arrangement between the Promoter and either Facebook Inc. or Apple, Inc.
21. The Promoter is not responsible for any incorrect or inaccurate information, either caused by promotional website users or by any of the equipment or programming associated with or utilised in this Promotion, or by any technical error that may occur in the course of the administration of this Promotion. The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to or alteration of entries.
22. If, for any reason, this Promotion is not capable of running as planned due to any reason including, but not limited to, infection by computer virus, bugs tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this Promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend this Promotion.
23. It is a condition of accepting the prize that the winner may be required to sign a release of liability in a form to be determined in the absolute discretion of the Promoter.
24. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury
or any loss or damage (including loss of opportunity) whether direct, indirect, special or consequential, arising in any way out of this Promotion including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by the winner or entrant; or (f) use of the prize.
25. All claims and entries become the property of the Promoter. The Promoter requires entrants’ personal information in order to conduct this Promotion. If you do not provide the mandatory personal information requested then you will not be able to take part in this Promotion. By entering this Promotion, each entrant is taken to consent to the Promoter using the entrant’s personal information to administer this Promotion, announce the winner and disclose the entrants’ personal information to organisations that assist the Promoter with administering this Promotion and announcing the winner, and to third parties as required by law (including authorities that regulate this Promotion). The Promoter is bound by the National Privacy Principles in the Privacy Act 1988 (Cth) and, by entering this Promotion, the entrant is taken to consent to the Promoter’s privacy policy. An entrant may request a copy of the Promoter’s privacy policy by contacting the Corporate Lawyer at the address set out in these Terms and Conditions. An entrant may access and correct any personal information held by the Promoter, upon request to the Promoter, marked to the attention of the Corporate Lawyer.
26. As a condition of entering this Promotion, each entrant consents to the Promoter using each entrant's name, likeness, image and/or voice in the event they are a winner of this Promotion (including photograph, film and/or recording of the same) in any media for an unlimited period of time without remuneration or compensation for the purpose of promoting, publicising or marketing this Promotion (including any outcome), and promoting any products or services manufactured, distributed and/or supplied by the Promoter. The winner agrees to participate in all reasonable promoted activities in relation to this Promotion as requested by the Promoter and their agents.
27. The Promoter supports responsible consumption and recommends that alcohol be enjoyed in moderation.
