1. Information on how to enter and prizes form part of these Terms and Conditions. By participating, entrants agree to be bound by these Terms and Conditions. Entries must comply with these Terms and Conditions to be valid.
2. Entry is open to residents of Australia only and persons who are 18 years and over who are available to travel on specific dates between May and August 2011. Employees of the Promoter and their immediate families and agencies associated with this promotion are ineligible to enter.
3. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Conditions of Entry or who tampers with the entry process. Errors and omissions will be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights
4. Incomplete, indecipherable or illegible entries will be deemed invalid.
5. Promotion commences at 00.01am (AEST) on Wednesday 13 April 2011. Promotion closes at 12.00am (AEST) on Wednesday 11 May.
6. Each valid entry received during the Promotion Period will be submitted for judging. Judging will take place at the Promoters premises on 13 May 2011. Judging will be done by a panel of judges appointed by the Promoter. The winner will be notified by telephone and in writing.
7. To enter simply buy the May 2011 issue of madison, then visit
www.madisonmag.com.au and write in 250 words or less ‘What is the best discovery you have made in your own home town?’ also include your name, address and contact phone number and attach one example of your own work. Examples of work include but are not limited to links to your own blog, Twitter and /or word documents you attach to your entry. Only one entry per person permitted. Entrants must retain a copy of their madison (May 2011 issue) as proof of purchase. Failure to produce the proof of purchase for all entries if requested may, in the absolute discretion of the Promoter, result in invalidation of an entrant’s entrie/s and forfeiture of any right to a prize.
8. The Entrant warrants to the Promoter that the entry submitted is an original artistic work of the Entrant that does not infringe the rights of any third parties. If the entry or any part of the information provided to the Entrant in relation to the entry was provided by a third party, the Entrant warrants that they have obtained the relevant copyright permission to submit the entry for the purposes of this promotion. The entrant agrees to indemnify the promoter against all claims and costs by third parties arising from a breach of the warranty set out in this condition.
9. Entries must not be offensive, defamatory or racist. Any entry which the judges deem inappropriate will be invalid. The entrant agrees to indemnify the Promoter.
10. The best entry as determined by the judges will be deemed the winner and will receive:
4 x Return flights to Brisbane for the winner and one companion from the winner’s nearest capital city valued at up to $3500 (depending on point of departure). 4 x Two (2) night’s accommodation in Brisbane standard twin share in a 4 star hotel valued up to $3000. 4x $500 spending money awarded in the form of a cheque made in favour of the winner. The spending money will be awarded each time the winner travel’s to Brisbane. If the winner is unable to travel to Brisbane for any reason whatsoever the winner will not be awarded this component of the prize.
Prize must be taken as 4 separate packages each consisting of 2 flights to Brisbane from the winners nearest capital city), 2 nights shared accommodation, $500 spending money). The winner will be required to undertake a series of promotional activities at the discretion of the Promoter including but not limited to:
• Writing one blog per visit covering each experience detailed in the itinerary. Blog entries will appear on
www.madisonmag.com.au (approximately 200 words and 5 photographs per entry). The blog is subject to Editorial approval. The promoter is entitled to amend, edit, select, crop, retouch, add to or delete from any part of the submitted blog.
• Attend events and functions as detailed in the itinerary.
• All material will be submitted to the Madison editor (and /or her representatives) and will be edited as per the editing procedures used for blogging within ACP Magazines Ltd. The edited material will then be featured on
www.madisonmag.com.auThe winner (and one travel companion) must be available to travel to Brisbane on each of the four separate occasions for 3day/2night itineraries during May to August 2011 – proposed date ranges include 19-21 May, 1-5 June, 1-5 July, 10-13 August. These dates are subject to change. The winner must be flexible to accommodate the Promoters preferred travel dates or the Promoter reserves the right to forfeit the winner and select another winner. A Madison team member will be your mentor on the first trip to Brisbane. Selection of Madison team member will be determined by the Promoter in its complete discretion.
The winner warrants to the Promoter that the blog / example of work submitted is an original artistic work of the winner that does not infringe the rights of any third parties. If the entry or any part of the information provided to the winner in relation to the entry was provided by a third party, the winner warrants that they have obtained the relevant copyright permission to submit the entry for the purposes of this promotion. The winner agrees to indemnify the promoter against all claims and costs by third parties arising from a breach of the warranty set out in this condition.
The winner will be responsible for supplying any equipment required to properly undertake blog duties including but not limited to camera, video camera and computer. The Promoter will not provide equipment for use by the winner nor cover any costs associated with obtaining equipment for providing any required material.
The total prize pool value is up to $8,500.
11. The winner (and their companions) are responsible for all other expenses including spending money (unless specified), meals, drinks, transfers (unless specified), laundry charges, activities (unless specified), incidentals, energy surcharges, gratuities, services charges and all other ancillary costs associated with redeeming the prize.
12. It is a condition of accepting the prize that the winner may be requested to present their credit card or a cash deposit upon arrival at any accommodation to cover all incidentals they may incur during their stay.
13. Prize must be taken as offered. The prize, or any unused portion of the prize, is not transferable or exchangeable and cannot be redeemed as cash. The prize cannot be used in conjunction with any other special offer. The prize is valued in Australian dollars. The Promoter accepts no responsibility for any variation in the prize value. Prize winner is advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of their prize. In the event that a portion of the prize is awarded to the winner in the form of a voucher / ticket / pass/ letter, redemption of that portion of the prize will be subject to the terms and conditions stipulated on the voucher / ticket / pass/ letter. The Promoter will not be liable for any voucher / ticket / pass/ letter that has been lost, stolen, forged, damaged or tampered with in any way. Redemption of the prize subject to the standard terms and conditions and guidelines of the accommodation venue and the activity service provider. Failure to follow the standard rules and guidelines presented will result in the winner forfeiting their right to participate in the said activity.
14. All elements of the prize are subject to availability with no cash alternative and the prize package is non-transferable and non-refundable. Winner(s) cannot change, vary, substitute or extend any element of the prize (in whole or in part).
15. If winner is unable to fulfill prize during time period, winner forfeits the prize package with no compensation or further liability of the promoter. Cash will not be awarded in lieu of the prize.
16. If the prize or portion of the prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize for a prize of equal or greater value, subject to State Regulation.
17. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
18. The judges reserve the right to select additional reserve entries which they determine to be the next best, and record them in order, in case of an invalid entry or ineligible entrant.
19. This is a game of skill and chance plays no part in determining the winner(s). Each entry will be individually judged based on their answer to the 250 words or less question.
20. Subject to the terms and conditions of the participating prize provider(s), if for any reason a winner does not, once the prize has been booked, take the prize or an element of the prize at the time stipulated, then the prize or that element of the prize will be forfeited and will not be redeemable for cash.
21. In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion.
22. The Promoter’s decision is final and binding - no correspondence will be entered into. The Promoter accepts no responsibility for late, lost or misdirected entries or other communications. Entries will be deemed void if forged, manipulated or tampered with in any way.
23. In the event any prize becomes unavailable for reasons beyond the Promoter’s control, the Promoter may substitute a prize of equal or greater value, subject to any written directions from the various lottery authorities.
24. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash.
25. When you submit any materials via the Promotion including comments, recordings and images (“Contentâ€), you, unless the Promoter advises otherwise, license and grant Company, its affiliates and sub-licensees a non-exclusive, royalty-free, perpetual, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish and display such Content for any purpose in any media, without compensation, restriction on use, attribution or liability. You agree not to assert any moral rights in relation to such use. You warrant that you have the full authority to grant these rights.
You agree that you are fully responsible for the Content you submit. The Promoter shall not be liable in any way for such Content to the full extent permitted by law. The Promoter may remove any Content without notice for any reason whatsoever. You warrant and agree that: (a) you will not submit any Content that is unlawful or fraudulent, or that the Promoter may deem in breach of any intellectual property, privacy, publicity or other rights, defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin or gender, not suitable for children aged under 15, or otherwise unsuitable for publication; (b) you will obtain prior consent from any person or property that appears in your Content; (c) you will obtain full prior consent from any person who has jointly created or has any rights in the Content, to the uses and terms herein; (d) your Content shall not contain viruses or cause injury or harm to any person or entity; and (e) you will comply with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and the access or use of others' computer or communication systems.
Without limiting any other terms herein, you indemnify the Promoter for any breach of the above terms.
26. All entries and subsequent submitted work submitted in connection with this promotion become the property of the Promoter. Entries/ submitted work will not be returned to any entrant. As a condition of entering into this promotion, each entrant agrees to assign all of their rights, title and interest (including copyright) in and to their entry and subsequent submitted work to the Promoter. Each entrant warrants to the Promoter that each entry and/or submitted work submitted is an original artistic work of the entrant that does not infringe the rights of any third party. The entrant agrees to indemnify the Promoter against all costs and claims by third parties arising from a breach of this warranty. Entrants consent to any use of their entryand/or subsequent submitted work which may otherwise infringe their moral rights pursuant to the Copyright Act 1968 (Cth).
27. Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
28. Inclusion of all creative work in Mdison magazine and on the Madison website (including but not limited to creative control and date of inclusion) remains at the complete discretion of the Promoter

It is a condition of accepting the prize that the winners agree to interviewed and photographed at any time after winner notification by the Promoter or their agents for a story or feature on this promotion to be developed and featured in Madison magazine (or any other form of media it deems suitable). This story will feature in Madison magazine at a time to be determined by the Promoter. All control relating to any such feature will remain with the Promoter at all times. Alternatively (to attending a photo shoot), the winner and/or runners up may be requested to provide the Promoter with a suitable photograph to be included in any such feature appearing in Madison magazine or on the Madison website.
29. Entrants must disclose any issues that may generate negative publicity and impact on the success of this promotion and/or Madison magazine. The Promoter can disqualify an entrant for failure to disclose any issues that may generate negative publicity and impact on the success of the Madison 48 hours 48 Hot Spots promotion and/or Madison magazine.
30. It is a condition of accepting the prize that the winner warrants to the Promoter that they understand that any arrangement entered into in relation to the redemption of this prize does not create a relationship between the winner and the Promoter of employer and employee, principal and agent, partnership or joint venture.
31. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.
32. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.
33. Except for any liability that cannot be excluded by law, the Promoter (including their respective officers, employees and agents) exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorized access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Conditions of Entry; (f) any tax liability incurred by a winner or entrant; (g) the prize and/ or (h) participation in the promotion.
34. Entries remain the property of the Promoter. Details from entries will be collected and used for the purposes of conducting this competition (which may include disclosure to third parties for the purpose of processing and conducting the competition) and for promotional purposes surrounding this competition. By entering this competition entrants consent to the use of their information as described and agree that the Promoter may use this information, or disclose it to other organisations that may use it, in any media for future promotional purposes without any further reference or payment to the entrant. 35. The Promoter assumes no responsibility for any failure to receive an entry or for inaccurate information or for any loss, damage or injury as a result of technical or telecommunications problems, including security breaches. If such problems arise, then the Promoter may modify the promotion.
36. By entering the competition, the entrant consents to receipt of any email regarding the competition, and other emails which inform the entrant of the Promoter’s other publications, products, services and events and to promote third party goods and services it may be interested in.
