TERMS AND CONDITIONS1. Information on how to enter & prizes form part of these terms & conditions. Any entry not complying with these terms and conditions is invalid.
2. Entry is open to individuals who are residents of Australia have access to the internet and a valid email address (“Eligible Entrant”). Employees of the Promoter, the Promoter’s associated companies, the Promoter’s agencies associated with this competition and their immediate families are ineligible to enter.
3. The promotion commences at 9am Australian Eastern Standard Time (“AEST”) on Wednesday 27th April 2011 & closes at 11.59pm pm AEST on Sunday 5th June 2011 (“Promotion Period”).
4. To enter the next daily prize draw, go to
www.aero-chocolate.com.au and describe in no more than 25 words what it feels like when the AERO bubbles melt in your mouth (“Entry Statement”) and follow the prompts to complete your full name and contact details to submit your entry. (Note; the prize will be payable to each winner’s name as submitted.)
5. Entry may not exceed once per calendar day per Eligible Entrant and each Entry Statement must be different for each entry. Any form of automated entry using any other devices or software is invalid.
6. All entries received during the Promotion Period will be entered in the next occurring daily prize draw only and will also be entered in any unclaimed prize draw (if necessary). The close time for each Prize Draw’s entries will be at 11.59pm AEST on the day preceding each draw. The particular Prize Draw that a valid entry is entered into will be determined by the time that the entry is received into the Promoter’s entry database.
7. The Promoter reserves the right to verify the validity of all entries and reserves the right to disqualify any individual entrant or group of entrants for tampering with the entry process, including but not limited to making more than one entry per calendar day per Eligible Entrant, providing entry information that is false or incomplete, or for submitting an entry which is not in accordance with these conditions of entry.
8. Before awarding a prize, the Promoter reserves the right to require an entrant who is drawn in a Daily Prize draw to verify their name and contact details by providing proof of identity in a form determined by the Promoter.
9. Prize is a $1,000 which will be awarded in the form of a cheque made payable only to the person whose name appears on the winning entry. Promoter’s decision is final and no correspondence will be entered into. Prize is not transferable and cannot be taken as cash.
10. The Prize Draws will commence on Thursday 28th April 2011 and conclude on Monday 6th June 2011, (total of 40 Prize Draws). Each draw will be conducted at 10.30am on the next occurring weekday following the close time at Unit 6, 106 Old Pittwater Road, Brookvale NSW 2100 (i.e. three separate Prize Draws to award prizes to entries received on a Friday, Saturday or Sunday during the Promotion Period will occur on Mondays). The first valid entry drawn at each Prize Draw will win the prize.
11. All winners will be notified by email and their names & postcodes will be published in The Australian as follows: prizes drawn 28 April to 16 May 2011 on 23 May 2011; 17 May to 6 June 2011 on 13 June 2011. All winners’ names and postcodes will also appear at
www.aero-chocolate.com.au12. Total prize pool is valued at $40,000.
13. The Promoter is not liable for any loss or damage whatsoever which is suffered, including but not limited to indirect or consequential loss, or for personal injury suffered or sustained during the course of accepting or using the prize, except for any liability which cannot be excluded by law.
14. Each entry becomes the property of the Promoter. All details will be held in accordance with the Nestlé Privacy Policy which can be accessed by visiting
www.nestle.com.au or calling 1800 005 510. An entrant's details may only be used to contact the entrant about the Promoter, its related companies, their brands, special offers, samples, consumer research and other promotions if the entrant consents to that use, for example by ticking an "opt in" box on an entry form.
15. The Promoter may conduct an unclaimed prize draw at the same time and place as the original draws on Tuesday 20th September 2011 to distribute any prizes if they are unclaimed by that date subject to any written directions given by a relevant lotteries or gaming authority. The first valid entry drawn will win the prize and the draw will continue until all unclaimed prizes have been distributed. Any unclaimed prize winner will be contacted by email and have their name and postcode published in The Australian on Tuesday 27th September 2011 and will also appear at
www.aero-chocolate.com.au16. Subject to clause 14, by entering the competition, each entrant agrees to the use of their entry statement for printing, broadcast, publicity and promotional purposes, including but not limited to the Promoter’s website/s without compensation, and agrees that the Promoter will own all intellectual property rights, including copyright, in any such material. It is a condition of accepting any prize that the winner acknowledges that the Promoter acquires the entry statement for use for its commercial purposes and agrees not to object to any such use on the basis of any moral right.
17. Prize will only be delivered in Australia and each winner should allow 28 days from the prize draw for delivery of their prize.
18. If for any reason this Promotion is not capable of running as planned, whether caused by infection by computer virus, mobile phone failure, line drop out, bugs, tampering, unauthorised intervention, fraud, technical failures or any other cause beyond the control of the Promoter which corrupt or affect the administration, security, fairness or integrity of the Promotion, the Promoter reserves the right in its sole discretion, (subject to any written direction given by a relevant Regulatory Authority), to cancel, terminate, modify or suspend the Promotion. The Promoter may in its sole discretion disqualify any individual who tampers with the entry process.
19. Entries are deemed to be received at the time of receipt into the Promoter’s database. The Promoter is not responsible for receipt of incorrect, inaccurate or incomplete information caused by an entrant or occurring during transmission. The Promoter is not responsible for any problems or technical malfunction of any telephone, telephone or computer network, or lines, servers, or telephone or internet providers, traffic congestion on any phone or computer network, or any combination thereof, including any injury or damage to participants or any other person’s handset or computer related to or resulting from participation or sending or receiving of any communication or of any materials in this Promotion.
