1. Information on how to enter and prizes forms part of these Terms and Conditions.
Entry in to the promotion is deemed acceptance of these Terms and Conditions.
2. Entry is open to residents of Australia over the age of 18 who make a qualifying
purchase during the promotion period. Employees and their immediate families of the
Promoter and its associated companies are not eligible to enter.
3. Customers who make a purchase of $4 or more (after discounts) on in-store items
between 28 April to 1 June 2011 at any Coles Express store are eligible to enter.
Purchases of gift cards, and tobacco or tobacco related products in QLD, SA, ACT,
NT or NSW are excluded from this promotion. Entry is not available for Shell card,
Fleet Card, Motorcharge or Motorpass purchases.
4. To enter, customers must ask for their purchase receipt at Coles Express, then
complete the entry form online at
www.colesexpress.com.au/winacar using the
receipt details as prompted. Customers may enter multiple times during the
promotion subject to (a) one entry per purchase receipt; and (b) each entry must be
submitted separately and in accordance with the entry requirements.
5. Any entry form is invalid if not validated, illegible or incomplete. All entries become
the property of the Promoter.
6. Prize is a Holden Series II Captiva 7 LX Petrol valued at $41,868 (includes statutory
on-road costs) as well as free fuel for a year at Coles Express valued at $4,400
(based on one tank of fuel per week in a 60 litre tank priced at $1.40 per litre) in the
form of Coles Express gift cards. The Holden Captiva comes with a 3.2 litre V6 petrol
engine, 5 speed auto with All Wheel Drive, Electronic Stability Control & ABS, 17”
Alloy wheels and metallic paint. Vehicles will be delivered by Holden dealer at Coles
Express’ discretion. Colour choice may affect delivery times. One prize will be won
each week over the 5 week competition. Total value of prizes is $231,340. Prize
values are correct as at the date publication and Coles Express accepts no
responsibility for any variation in any prize value. Prizes are not transferable or
exchangeable and cannot be taken as cash.
7. Winner is responsible for insurance and all other ancillary costs and taxes as
incurred. Prizes and winners are subject to the terms, conditions, requirements and
eligibility criteria of the Prize providers and local roads authority.
8. Promotion commences on 28 April 2011 and ends at 11:59PM AEST on 1 June 2011.
9. Entries for each weekly draw close at 11.59pm AEST on the dates listed in the table
below. The draws will take place weekly, with 5 draws in total. Entries not drawn in
each weekly draw will be entered into any subsequent weekly draws. All draws take
place at 12:00pm at Coles Group Store Support Centre, 800 Toorak Road, Hawthorn
East, Victoria 3132 according to the following:

Prize in each weekly draw will be awarded to the first valid entry drawn.
10. The winners will be notified by email and telephone using the details provided on
entry within two (2) days of being drawn. The winners from the first two weeks will be
published in The Australian on 23/5/2011 and the winners from the last three weeks
will be published in The Australian on15/6/2011.
11. The Promoter may conduct such further draws at the same place as the original draw
as are necessary on 3/11/2011, in order to distribute any prize unclaimed by that
date, subject to any applicable legislation. If necessary, the winners of re-draw/s will
be notified by email and by telephone within 2 days of the re-draw and published in
The Australian on 17/11/2011.
12. If a Prize (or part of a Prize) is unavailable the Promoter, in its discretion, reserves the
right to substitute that Prize (or component) with a prize of equal value and or
specification, subject to any written directions from a regulatory authority.
13. The winners consent to the Promoter using their name, likeness, image and/or voice
(including any photograph, film and/or recording of them) in any media at any time or
times without compensation, financial or otherwise, for the purpose of promoting this
Competition, the Promoter and/or any of the Promoter's products.
14. The Promoter excludes all liability (including negligence) and shall not be liable for
any loss (including loss of opportunity) or damage whatsoever which is suffered
(including but not limited to indirect, special or consequential loss, personal injury, or
death) as a result of entering this promotion or of taking any Prize, except for any
liability which cannot be excluded by law for which the Promoter’s liability is limited to
resupplying the prize (or paying the costs therof) where permitted by law.
15. If for any reason this promotion is not capable of running as planned, the promoter
reserves the right in its sole discretion to cancel, terminate, modify or suspend the
promotion, subject to any applicable legislation.
16. The promoter reserves the right to verify the validity of entries and to disqualify any
entrant for tampering with the entry process or for submitting an entry which is not in
accordance with these conditions of entry, or if the entrant is engaged in any unlawful
or other improper misconduct calculated to jeopardise the fair and proper conduct of
the promotion.
17. Judge's decision is final and no correspondence will be entered into.
18. The Promoter collects personal information about entrants to include entrants in the
promotion and where appropriate award Prizes. If any information requested is not
provided, the entrant may not participate in the promotion. By entering the promotion,
each entrant agrees that the Promoter may disclose entrants’ personal information to
State and Territory lottery departments, prize providers and the relevant roads
authorities and that the winner's name and locality will be published as required under
the relevant lottery legislation. A request to access, update or correct any personal
information should be directed to the Promoter at the address stated below.
19. All entries may be entered into a database and the Promoter may use entrants’
names and email addresses for future promotional, marketing and publicity purposes,
unless notified to the contrary by entrants placing an “x” in the box provided ��
