OF SEVERAL USM MULTI-SPORT EVENTS THROUGHOUT 2001.


Slapping a big logo on every visible space at each event is not in our race plan. Instead we'd like to go beyond the standard sponsor involvement and help everyone involved to encourage community participation and have fun at each and every event. As such we would like to invite you to enter our competition to become a Subaru VIP Athlete.

It's a fabulous opportunity that includes 2 first prizes - each valued at $1,698. Each prize consists of the following:

    * 1 x Entry to Noosa Festival Triathlon on Sunday 31st October 2011

TERMS AND CONDITIONS

   1. Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

   2. Promotion commences on 24/03/2011 and entries close 11:59pm AEST on 12/06/2011 ("Promotional Period").

   3. Entry is only open to Australian residents aged 18 years or over. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

   4. To enter, individuals must, during the Promotional Period, visit www.subaru.com.au, follow the prompts to the competition entry page, input the requested details including their name, street address, email address, telephone number and answers to the questions provided and then submit the fully completed online entry form.

   5. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

   6. Incomplete, indecipherable or illegible entries will be deemed invalid.

   7. Only one (1) entry permitted per person.

   8. The draw will take place at Anisimoff Legal Suite 1, Level 1, 34 Chandos Street St Leonards NSW 2065 20/06/2011 at 12noon AEST. Winners will be notified in writing by mail and by telephone within two (2) days of the draw and winners' names will be published in The Australian on 27/06/2011.The Promoter's decision is final and no correspondence will be entered into.

   9. The first two (2) valid entries drawn from all entries received will each win:
          * 1 x Entry into the Noosa Festival Triathlon on Sunday 31/10/2011 at Noosa Heads Lions Park, Noosa Heads, QLD for their age group (based on their age as at 31/12/2010);
          * 1 x priority bike racking for the Triathlon event (as per time allocation);
          * 1 x Subaru merchandise race kit which includes Subaru branded merchandise up to the value of $400;
          * 1 x pair of Asics running shoes (in the winner's chosen size);
          * 2 x VIP Corporate Hospitality tickets which include entry into the Hospitality tent, finger food and beverages;
          * the opportunity to meet a Subaru Sponsored Pro Athlete;
          * 1 x pair of Specialized Trivent Expert Triathlon shoes; and
          * 1 x Specialized TT2 Helmet

  10. Prize is subject to the standard terms and conditions of individual prize and service providers.

  11. Total prize is valued at $1,698. Prize does not include any airfares and/or accommodation. Winner's and any companion/s will be responsible for all ancillary costs associated with taking the prize including any travel costs associated with getting to and from the Noosa Festival Triathlon event.

  12. The winner, in agreement with the Promoter, can decide to transfer the prize to someone else who is willing to take the prize as stipulated in Clause 9 above. If transferred, the prize taker agrees to the conditions set out in Clause 14 below.

  13. The "Meet & Greet" element of the prize provides the winner (and his/her companion) with an opportunity to meet one Subaru Sponsored Pro Athlete, and an opportunity to have a photograph taken with them. This element of the prize is not guaranteed and is subject to the goodwill of the Subaru Sponsored Pro Athlete on the day. The Promoter accepts no responsibility and will not offer any alternative in the event that this element of the prize cannot be offered for any reason.

  14. The winners of the prize acknowledge that they participate in the Triathlon at their own risk. Winners must: (a) attend, undergo and pass any appropriate training, briefings, required medical tests and other requirements of the Promoter as determined in its absolute discretion; (b) not have any heart condition or history thereof, or other medical conditions that would make it dangerous to participate in the Triathlon; (c) not be under the influence of drugs or alcohol; (d) comply with all directions of the Promoter at all times; and (e) wear all safety and other equipment required. The Promoter, in its absolute discretion, at all times reserves the right to prevent the winner from participating in the Triathlon if, at any time, they reasonably believe that the winner poses a safety risk or for any other reason. If the Triathlon is varied for any reason beyond the control of the Promoter it may not be rescheduled and no compensation will be offered.

  15. If the prize (or part of the prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.

  16. Total prize pool value is $3,396. Prizes, or any unused portion of a prize, are not transferable and cannot be taken as cash.

  17. A draw for any unclaimed prizes may take place on 20/09/2011 at the same time and place as the original draw, subject to any directions from a regulatory authority. Winners, if any, will be notified in writing by mail and by telephone within two (2) days of the draw and their names will be published in The Australian on 26/09/2011.

  18. Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

  19. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

  20. Any cost associated with accessing the promotional website is the entrant's responsibility and is dependent on the Internet service provider used.

  21. Nothing in these Terms and Conditions limit, exclude or modify or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia ("Non-Excludable Guarantees"). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

  22. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) if the Noosa Festival Triathlon event is cancelled for any reason beyond the reasonable control of the Promoter; (f) any tax liability incurred by a winner or entrant; or (g) participation in the Noosa Festival Triathlon.

  23. As a condition of accepting the prize, the winner must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.

  24. The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.
