Terms and Conditions
By entering The Sunday Times ‘Win Free Fuel for a Year’ competition, you are agreeing to the following terms and conditions:
STANDARD TERMS
• Information about how to enter forms part of the terms of entry.

WHO CAN ENTER?
• Entry is open to all residents of WA where The Sunday Times is distributed. All entrants under the age of 18 must obtain the prior permission of a parent or guardian over the age of 18 to enter. If the winner is under the age of 18 the prize money may be awarded to a parent or guardian at the absolute discretion of the promoters.
• Employees of The Sunday Times, a division of Nationwide News Pty Ltd, and their immediate families, associated agencies and companies are not eligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether by natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.
• The Promoter reserves the right to verify the validity of entries and entrants (including but not limited to verifying an entrant’s age) and to disqualify any entrant who tampers with the entry process (including but not limited to tampering by way of the utilisation of automated entry software) or who submits an entry that is not in accordance with these conditions of entry. Errors and omissions will be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
HOW TO ENTER
• There are four coupons each week drawn as follows:
Week One – Competition opens at 4.00pm on Saturday, May 7 and closes at noon on Friday, May 13, 2011 (Week one competition period).
Week Two – Competition opens at 4.00pm on Saturday, May 14 and closes at noon on Friday, May 20, 2011 (Week two competition period).
Week Three – Competition opens at 4.00pm on Saturday, May 21 and closes at noon on Friday, May 27, 2011(Week three competition period).
Week Four – Competition opens at 4.00pm on Saturday, May 28 and closes at noon on Friday, June 3, 2011 (Week four competition period).
• To enter readers are required to complete the coupon in The Sunday Times and post to The Sunday Times/ Win Free Fuel for a Year Competition, GPO Box 2969, Perth, WA 6800.
• All competitions will be drawn at The Sunday Times – 34-50 Stirling Street, Perth, WA, 6800.
• One original coupons will be accepted. Photocopies, scanned copies or facsimiles will be deemed as invalid.
• All winners will be contacted by phone by a member of The Sunday Times.
PRIZES
• The total prize pool is $100,000 AUD. Prize value is correct as at the date of printing. The Promoter accepts no responsibility for change in prize value between now and the ultimate date on which the prize is taken.
• There will ten (10) weekly prize winners per week over four-weeks = 40 prize winners in total.
• Each prize winner (40 in total) will receive the corresponding prize package:
o $2,500 Fuel Card
• The prize is strictly as stated above and cannot be altered.
• Average fuel cost of $2,500 per year has been based on the following calculations –

• Accepting their prize, winners agree to participate and co-operate as required in all editorial activities relating to the competition, including but not limited to being interviewed and/or photographed. The winners agree to grant the Promoters a perpetual and non-exclusive license to use such footage and photographs in all media worldwide and the winners will not be entitled to any fee for such use.
• The winners agree they will not sell or otherwise provide their story and/or photographs to any media or any other organisation.
• The prize will be awarded in the form of a fuel card and will need to be collected from The Sunday Times (34-50 Stirling Street, Perth, WA 6800).
• Winners should seek independent financial advice about any tax implications that may arise from the prize winnings.
• In the event that for any reason whatsoever the prize winner does not take the prize at the time stipulated by the Promoter, then the prize or that element of the prize will be forfeited by the prize winner.
• Prizes are not transferable, re-routable or redeemable for cash or other goods or services.
• All unclaimed prizes remain the property of the promoter (The Sunday Times).
NO LIABILTY
• In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the competition and recommence it from the start on the same conditions, subject to state government legislation.
• The Sunday Times and their associated affiliates, agencies and companies will take no responsibility for prizes damaged or lost in transit, or late, lost or misdirected prizes.
• To the extent permitted by law, The Sunday Times and their associated affiliate agencies, companies, employees and agents will not be liable for any claims, losses, damages, costs, expenses, misadventure, accident or injury that may occur:
• during the draw;
• whilst undertaking any travel connected with entry into the draw;
• in the participation of any element purchased with the prize;
• otherwise as a result of, or arising out of, or in any way connected with this competition and/or its prizes.
• If for any reason this competition is not capable of running as planned, due to causes including but not limited to tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of the Promoter, the Promoter reserves the right in their discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the competition.
• Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence) for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Competition, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these conditions of entry; (e) any tax liability incurred by a winner or entrant; (f) participation in the Competition and/or (g) redemption of the prize.
• All entries become the property of the Promoter. The collection, use and disclosure of personal information in connection with this Competition are governed by the Promoter’s Privacy Notice available from the Promoter and these Conditions of Entry. The Promoter may use information it collects in relation to you to provide you with information regarding further offers, Competitions or goods and services provided by the Promoter and/or the Promoter’s partners and sponsors. The Promoter may also disclose information about you to its service providers to enable the Promoter to provide you with services. Your personal information may be disclosed to State and Territory lottery departments and winners’ names published as required under the relevant lottery legislation. You consent to the Promoter’s use and disclosure of information about you as contemplated by this condition.
• To the full extent permitted by law, The Promoter will not be liable to you in respect of any claim for any loss or damage whatsoever (including, without limitation, any consequential, indirect, special, punitive or incidental damages) or for any personal injury suffered by you as a result of or in connection with the Promoter’s provision of the Service.
