Information on how to bid and information on prizes form part of these Terms and Conditions. Participating in this promotion is deemed acceptance of these Terms and Conditions.

Definitions: "Bid" means a Bid submitted by a specific Bidder in connection with the promotion; "Bidder" means an eligible person who has placed a specific Bid Amount for the Product; "Bid Amount" means a number from 1 to 1,000; "Lowest Unique Bid" means the lowest bid placed that is the only bid at that amount; "Product" means the product offered in connection with the promotion; "Successful Bidder" means the Bidder that is determined by the Promoter to have the right to receive the Product; and "Unique Bid" means a bid that is different from any other bid amount.

Promotion is only open to Australian residents aged 18 years and over. Employees (and the immediate family) of the Promoter and its agencies associated with this promotion are ineligible.

To place a Bid, the individual must visit http://www.AustralianFreebies.com.au and complete the official online bidding form, by submitting all requested information including their Bid Amount.

The Successful Bidder will be the Bidder who submitted the Lowest Unique Bid. The Successful Bidder will have the right to receive the Product. The Product received is dependent on which Product the Successful Bidder submitted the Lowest Unique Bid for. The product can only be one (1) of the following:

The Promoter reserves the right to conduct security verification checks at their absolute discretion. The Successful Bidder may be required to sign a declaration confirming their eligibility to accept the Product.

The Promoter reserves the right to cancel, terminate, modify or suspend the promotion, in the event of war, terrorism, state of emergency or disaster or any other reason beyond the control of the Promoter which affects the proper conduct of the Promotion.

The Promoter accepts no responsibility for any variation in the value of the Product.

Product must be taken as offered and is not transferable or exchangeable and cannot be redeemed for cash.

If for any reason this promotion is not capable of running as planned (including but not limited to) infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupts or affect the administration security, fairness, integrity or proper conduct of this competition, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the Bid process, and, to terminate, modify or suspend the promotion.

The use of any automated software or any other mechanical or electronic means that allows a bidder to automatically Bid repeatedly is prohibited and will render all bids submitted by that Bidder invalid.

The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for personal injury which is suffered or sustained, as a result of taking any Product, or arising in any way out of or in connection with the promotion, except for any liability which cannot be excluded by law. It is a condition of the promotion that the Successful Bidder must execute a Deed of Acknowledgment, Release and Indemnity ("Deed") in a form prescribed by the Promoter in order to receive the Product.

All Bids remain the property of the Promoter. The Promoter collects Bidders’ personal information in order to conduct the promotion. If the information requested is not provided, the bidder may not participate in the promotion. Hence, I believe that there will be a limited likelihood that there will be one unique entry per person for this competition. As such, I wonder how the successful winner will be determined, "Simply fill in your details and place your free bid. If you place a bid with the lowest number that no one else has bid on, you win. It's that easy!"

I believe these reverse auctions work by all non-successful bidders paying their bid price.  I think the seller also sets a reserve such that they sell a $500 product, for example, only once they have received say $1000 worth of unsuccessful bids. There are a lot mor elosers than winners in this game.

I'd prefer it if reverse auctions were removed from ACC as it is really stretchin it to consider them to be competitions.
