1. This "Text & Win Competition" is provided by Go Pacific Retail Pty Ltd (58 Gladesville Rd, Hunters Hill, Sydney, NSW, 2110) with the assistance of Message Media (Level 22, 385 Bourke Street Melbourne VIC 3000 Helpline: 1800 205 596) (Competition).
2. Information on how to enter and the prizes form part of these terms and conditions. By sending an entry SMS to 1996 5556 (cost = 55c per msg sent), you acknowledge that you have read and understood and agree to be bound by these terms and conditions.
3. Competition commences 9.00am (AEST) on 2nd May 2011 and entries close midnight 31st July 2011 (AEST). Go Pacific Retail may extend the closing date in its sole discretion. All entries are deemed to be received at the time of receipt NOT at the time of transmission by you. Late entries will not be eligible.
4. The competition will be run from participating Go Sushi venues open during the time of the competition.
5. There is no travel involved in this prize. Each winner and their friend is responsible for getting to and from the designated Go Sushi store in their state. Go Pacific Retail will not be responsible for any costs associated with winning or accepting the prize unless specifically stated herein.
6. The Competition is open to Australian residents. If you are under 18 years of age you must have the approval of your parent or legal guardian. Go Sushi Franchisees who hold a Franchise Agreement with Go Pacific Retail, and Go Sushi Employees (staff at stores), or Message Media and their immediate families are not eligible to enter the Competition.
7. The SMS entry mechanic is only open you if you have an SMS compatible mobile phone connected to a service provider which permits text messaging to the promotional SMS number. It is recommended that you check with your individual service provider in this regard. SMS entries via the internet or computer generation are invalid and will not be accepted. To be valid the mobile number from which each SMS is sent must not be withheld and the mobile number must be owned by the entrant.
8. The cost of entering the Competition is $0.55, including GST (per message sent). If your mobile phone provider applies a surcharge for sending or receiving a premium SMS, this will be in addition to the $0.55. You will need to check with your provider to determine if there are additional costs.
9. The Competition consists of you purchasing a Go Energy Lunch Pack or Go Miso Lunch Pack with a drink or soup from any Go Sushi store (or a Go lunch pack with a Kick Juice or Smoothie from Go Sushi in Broome), receiving a flyer with your unique entry code, and then sending an SMS entry containing your unique code set out in the Go Sushi Entry flyer. The unique entry code must be the first thing entered in the SMS for the entry to be validated.
10. Entries will be drawn on at 10am (AEST) every second Monday, commencing 23/05/11 and final draw on 01/08/11. The winners will be drawn at random by Message Media at Level 22 385 Bourke St Melbourne VIC 3000.
11. Winners will be contacted via a phone call to their mobile telephone number. The winner of the Competition is announced on the following website:
www.gosushi.com.au and in The Australian on 22/08/2011.
12. If for some reason beyond Go Pacific Retail Pty Ltd control, it is not possible to supply the prize as advertised, Go Pacific Retail will be entitled to supply a substitutable prize at discretion to equal or greater value. The total prize pool value is $8394. Individual prizes are worth $1399 (RRP including GST).
13.The prize is awarded within 28 days of the closing date for the Competition.
14. The prize is not transferable and cannot be taken as cash. No compensation is payable if the winner cannot receive any aspect of the prize for any reason. The prize value is correct at time of printing and Go Pacific Retail Pty Ltd accepts no responsibility for any variation.
15. The entrant must purchase a Go Sushi “Go Lunch Pack” with a Miso Soup or V Energy Drink to participate in the Competition.
16.By entering the Competition, entrants agree that Go Pacific Retail Pty Ltd may use the entrants contact details in any media for future promotional, marketing or publicity purposes without further reference or consent including sending the entrant further electronic messages. To opt out of marketing, Entrants can email

Go Pacific Retail Pty Ltd will collect personal information about you for the purposes of conducting the Competition and awarding prizes. Data may be passed to Australian mobile operators upon their request. In accordance with the National Privacy Principles in the Privacy Act 1998 (Cth), you have a right to access most of the information Go Pacific Retail holds about you. 17. Under the Trade Practices Act 1974 (Cth) and other statutes there are some warranties and conditions that cannot be excluded, restricted or modified or can only be excluded, restricted or modified to a limited extent. Go Pacific Retail Pty Ltd excludes all warranties and conditions to the extent allowable by these laws. Go Pacific Retail Pty Ltd accepts no liability or responsibility of any kind for any defect with the prize nor for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) which is suffered or sustained in connection with the Competition or the prize in any way to the fullest extent allowable by law.
18. If the Competition is not capable of running as planned due to any reason (including, but not limited to fraud, a state of emergency, natural disaster, war, technical failures or any other causes) Go Pacific Retail Pty Ltd reserves the right without liability to you to cancel, modify, terminate or suspend the Competition.
19. Go Pacific Retail Pty Ltd is not responsible for any technical error that may occur during the Competition. This includes, but is not limited to, any omission, interruption, deletion, defect or delay in operation or transmission or failure of any telephone, mobile or satellite network.
20. Go Pacific Retail Pty Ltd is not responsible for any misdirected, late or incomprehensible entries in the Competition.
21. Go Pacific Retail Pty Ltd is not responsible for any tax implications that may arise from winning a prize in the Competition. You should seek independent financial advice about such matters.
22. Go Pacific Retail Pty Ltd in its absolute discretion reserves the right to verify the validity of all entries and to disqualify you if you tamper with the entry process including but not limited to techniques designed to avoid payment of call costs or submission of an entry not in accordance with these terms and conditions.
23. These terms and conditions constitute the entire agreement between you and Go Pacific Retail Pty Ltd.
