Terms and Conditions
SKY SPORTS RADIO BIG SPORTS BREAKFAST – STATE OF ORIGIN PROMOTION
1. General Entry
1.1 Information on how to enter the Sky Sports Radio State of Origin
promotion (the Promotion) form part of these terms and conditions of
entry (the Terms and Conditions).
1.2 The promoter is 2KY Broadcasters Pty Ltd, 495 Harris Street, Ultimo,
NSW, ABN 54 000 820 057 (the Promoter).
1.3 Entry is open only to residents of New South Wales over the age of 18
(an Eligible Participant).
1.4 By entering and/or participating in the Promotion, each Eligible
Participant fully and unconditionally agrees and acknowledges that
these Terms and Conditions and the decision of the Promoter on all
matters relating to this Promotion will be final and binding.
1.5 Directors, officers and employees of (and contractors to) the Promoter
and its related companies and their immediate family are not eligible to
participate in the Promotion. For the purposes of these Terms and
Conditions, “immediate families” means a spouse (including de facto),
parent, sibling, child, grandparent, grandchild, or parent in law and
includes stepparents and stepchildren and half siblings.
2. Term of Promotion
The Promotion commences at 5:30 AM (AEST) Monday 9 May 2011 and
ends at 23:59 PM (AEST) on Tuesday 17 May 2011 (the Promotion
Period).
3. How to Enter
3.1 To enter the Promotion, an Eligible Participant must, during the
Promotion Period, register their details via the on-line entry form located
on the Sky Sports Radio website (
www.skysportsradio.com.au) (the
Registration) and correctly answer the question: “Game 2 of the 1992
State of Origin series was won by one point. Who kicked the winning
final field goal?”
3.2 Maximum one (1) entry per Eligible Participant.
3.3 The Promoter reserves the right to disqualify any entry if that entry is
not made in accordance with the terms of these Terms and Conditions.
Any illegible entries will not be accepted.
4. Selection of Winners
4.1 On Wednesday 18 May 2011 at 08:30 AM (AEST) one (1) Eligible
Participant who has satisfied the entry requirements in clause 3 will be
randomly drawn (the Prize Draw).
4.2 The first Eligible Participant drawn will be the “Winner”.
4.3 The Prize Draw will take place at the office of the Promoter at 495
Harris Street, Ultimo, NSW.
5. Prizes
5.1 The Prize includes:
(a) 2 x Return airfares (Sydney to Brisbane on 25 May/Gold Coast
to Sydney on 27 May)
(b) Two (2) night’s luxury accommodation at the Jupiters Hotel &
Casino (Broadbeach) for 2 people
(c) All transfers, meals and beverages
(d) Winner’s choice of fully paid golf or theme park access.
(e) 2 x tickets to an exclusive function at Gambaros Seafood
Restaurant in Brisbane
(f) 2 x Category One (1) tickets at Suncorp Stadium for State of
Origin 1 on 25 May 2011
Prize Value Per Person: $2,800
Total Prize Value: $5,600
5.2 Costs
All other costs associated with the Prizes, including but not limited to
any taxes, insurance, travel to and from the Winner’s home to Sydney
airport and other ancillary costs are the responsibility of the Winner.
5.3 Prize Specific Conditions
(a) The Prize must be taken as offered and cannot be varied or
redeemed for cash.
(b) The Prize value is GST inclusive, is in Australian dollars, is the
recommended retail value as provided by the supplier and is
correct at time of printing.
(c) The Prize can be transferred to another adult over the age of
18.
(d) The Prize must be taken on the dates specified only (i.e. 25
May 2011 to 27 May 2011).
(e) Except as provided for in clause 11 of these Terms and
Conditions, in the event that for any reason whatsoever the
Winner does not take an element of the Prize at the time
stipulated by the Promoter then that element of the Prize will be
forfeited by the Winner and cash will not be awarded in lieu of
that element of the Prize.
(f) The Winner agrees that he or she (and his/her companion) will
not, without prior written consent of the Promoter (which may be
withheld in its absolute discretion) participate in any other media
activities or promotions for the purpose of, or discussing,
commenting on or expressing a view on any aspect of the
Promotion
(g) In promotional activities, the Winner (and his/her companion)
will refrain from expressing a negative or disparate view of the
Promoter and its operations and related bodies.
(h) The Winner acknowledges and agree that the Promoter has the
right to all materials generated in connection with the Promotion
and can use the material in any medium and in any manner it
sees fit.
(i) The Promoter will also hold the copyright to any photographs
taken for publicity purposes and can use these photos in any
promotional material for the time period of five years.
6. Prize Winner Notification
The Winner will be notified by telephone and email after the Prize Draw. The
name of the Winner will be announced on air on the Sky Sports Radio Big
Sports Breakfast Show between 08:00 AM (AEST) and 09:00 AM (AEST) on
Wednesday 18 May 2011. The name of the Winner will be published on
www.bigsportsbreakfast.com.au and in the public notices section of the Daily
Telegraph on Friday 20 May 2011.
7. Tax Statement
Any taxes which may be payable as a consequence of the Winner receiving the
Prize are the sole responsibility of the Winner. The Promoter accepts no
responsibility for any tax implications that may arise from the Prize winnings.
Independent financial and tax advice should be sought.
8. Exclusion of Liability
8.1 To the extent permitted by law, the Promoter is not liable for any loss,
including, but not limited to, direct, consequential (including economic)
or indirect loss or any loss of profits, by reason of any act or omission,
deliberate or negligent, by the Promoter or their servants or agents, in
connection with this Promotion or the arrangement for supply, or the
supply or failure to supply, of any goods or services by any person to
the Winner.
8.2 Nothing in these Terms and Conditions affect, nor is intended to affect,
any rights that an Eligible Participant might have that are not able to be
excluded under applicable Australian consumer protection laws. To the
fullest extent permitted by law, any liability of the Promoter or its
servants or agents for breach of any such rights is limited to the
supplying of the relevant goods or services again.
9. Use of Personal Information / Marketing
9.1 The Promoter is bound by the National Privacy Principles in the Privacy
Act 1988. The Promoter’s privacy policy is located at
www.skysportsradio.com.au.
9.2 Any entries become the property of the Promoter. Any information
Eligible Participants provide will be used by the Promoter for the
purpose of conducting this Promotion.
9.3 The Promoter may disclose Eligible Participants' personal information to
its contractors and agents to assist in conducting this Promotion or
communicating with Eligible Participants.
9.4 By entering the Promotion, Eligible Participants consent to their
personal information being collected, used and disclosed by the
Promoter, its agents, affiliates, related business companies, other
companies associated with this Promotion, and business partners for
any promotional activities, including the Eligible Participant's personal
participation in reasonable promotional activities as requested by the
Promoter, and any marketing and publicity purposes without any further
reference, payment or other compensation to the Eligible Participant.
9.5 Eligible Participants’ consent includes authorising the Promoter, its
agents, affiliates, related business companies, other companies
associated with this Promotion and business partners to send the
Participant future electronic messages including but not limited to, SMS,
MMS, and email regarding any promotional, marketing and publicity
activities.
9.6 Eligible Participants' personal information may be disclosed to State and
Territory lottery departments and Winner’s name published as required
under the relevant lottery legislation. A request to access, update or
correct any information should be directed to the Promoter at its
address set out below.
9.7 All Eligible Participants consent to the publication of their name and
suburb of residence (however their full address will not be published)
and agree to participate in reasonable Promotion activities as requested
by the Promoter.
10. General Conditions
10.1 The Promoter, its employees, officers, agents, and its parent companies
and subsidiaries are not responsible for and shall not be liable for:
(a) any condition caused by events beyond the control of the
Promoter that may cause the game to be disrupted or
corrupted;
(b) any injuries, losses (including, without limitation, loss of profits),
or damages of any kind (even where resulting from negligence
of the Promoter or any other person) caused by the Prize or
resulting from acceptance, possession, use, or misuse of the
Prize, or from participation in the game or downloading material
from the website; or
(c) any printing or typographical errors in any materials associated
with the Promotion.
10.2 The Promoter reserves the right, in its sole discretion, to:
(a) cancel or suspend the Promotion, should virus, bugs,
unauthorized human intervention, or other causes beyond the
control of the Promoter, in its sole opinion, corrupt the
administration, security, fairness, integrity, or proper operation
of the Promotion;
(b) disqualify any Eligible Participant who engages in offensive,
illegal or objectionable conduct;
(c) disqualify any individual who tampers with the entry process, or
who submits an entry that is not in accordance with these Terms
and Conditions and, subject to any written directions given by
any relevant government or regulatory authority, to cancel,
terminate, modify or suspend the Promotion;
(d) request the Winner provide proof of age, identity or residency at
the nominated Prize delivery address.
10.3 In the case of the intervention of any outside agent or event which
naturally changes the result or prevents or hinders it's determination,
including but not limited to vandalism, power failures, tempests, natural
disasters, acts of God, civil unrest, strikes; the Promoter may in its
absolute discretion cancel the event and recommence it from the start
on the same conditions subject to State Regulation.
10.4 It is a condition of accepting the Prize that the Winner may be required
to sign a legal release in a form determined by the Promoter in its
absolute discretion.
10.5 To the extent that a situation or issue arises for which these Terms and
Conditions make no provision or in relation to which the relevant Terms
and Conditions are unclear, the Promoter also reserves the right to
make a decision regarding such situation or issue in its sole and
absolute discretion and such decision will be final and binding.
10.6 In the event that the Winner is identified as a minor, self excluded
patron, involuntarily excluded patron or any other person who is in
breach of these Conditions of Entry, the Promoter reserves the right to
refuse to allow the Winner to take part in, or receive, any or all aspects
of the Prize, and the Promoter will notify any relevant regulator
accordingly where required by law to do so.
10.7 Decisions of the management of the Promoter are final. No
correspondence will be entered into.
11. Unclaimed prize draw
If, 24 hours after the Prize Draw, a Winner is unable to be contacted, or, for
whatever reason the Winner does not accept the Prize, that Prize will be
redrawn and a new winner will receive the Prize. This redraw will take place at
10:30 AM (AEST) on Thursday 19 May 2011 at the Promoter’s office located at
495 Harris Street, Ultimo, NSW, subject to any written directions.
