Sensodyne “Win a $5000 style makeover” Competition

Terms and Conditions

1.Information on how to enter and the prizes form part of the Terms and Conditions. Entry into the competition is deemed acceptance of these Terms and Conditions.

2.This competition is only open to eligible entrants (“Eligible Entrants”), being individuals who:

1.are permanent residents of Australia; and
2.are 18 years of age or over.


3.Employees (and their immediate families) of the Promoter and agencies associated with this competition are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

4.Any entry that is made on behalf of an Eligible Entrant by a third party, or otherwise by proxy, will be invalid.

5.The competition is a game of chance, and skill plays no part in determining the winners.

6.The competition commences on Sunday, 17/04/2011 at 09:00 (AEST) and concludes on Thursday, 02/06/2011 at 23:59 (AEST) (the “Competition Period”).

7.To enter the competition and be eligible to win, Eligible Entrants must go to www.sensodyne.com.au, follow the prompts to the competition entry page and fill in all the required data fields on the online entry form and submit the fully completed form, so it is received during the Competition Period. Details collected include (but are not limited to) full name, full postal address (including suburb, state/territory and postcode), phone number, valid e-mail address and age. Mandatory details will be indicated on the entry form.

8.Eligible Entrants must ensure that the Promoter receives their entries during the Competition Period. All entries received before the commencement date and time or after the conclusion date and time for this competition, will not be entered into the draw. All entries are deemed to be received at the time of receipt by the Promoter and not at the time of transmission by the Eligible Entrant. The Promoter takes no responsibility for late, lost or misdirected entries.

9.Incomplete and incomprehensible entries will be deemed invalid.

10.Multiple entries permitted, subject to the following: (a) each entry must be submitted separately and in accordance with entry requirements; and (b) a maximum of five (5) entries per person per day is permitted.

11.Limit of 1 prize per person (excluding SA residents).


12.The Promoter reserves the right to request winners to provide proof of identity, proof of residency at the nominated prize delivery address and/or proof of entry validity in order to claim a prize. Proof of identification, residency and entry considered suitable for verification is at the discretion of the Promoter. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered.

13.The Promoter reserves the right to verify the validity of entries and Eligible Entrants (including an Eligible Entrant’s identity, age and place of residence) and to disqualify any Eligible Entrant who, in the opinion of Promoter submits an entry that is not in accordance with these Terms and Conditions or who has, in the reasonable opinion of the Promoter, engaged in conduct in entering the competition which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the competition and/or Promoter. The Promoter reserves the right to disqualify a winner if Promoter becomes aware that the winner and/or the winner’s entry is of a type described in this clause. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

14.DRAW

15.The draw will take place at Anisimoff Legal, Level 4, 448 St Kilda Road, Melbourne VIC, 3004 on Monday, 06/06/2011 at 11.00 (AEST).

16.PRIZES

17.There is one Major Prize and ten Minor Prizes available to be won in this competition. The first valid entry drawn will win the Major Prize. The next ten (10) valid entries drawn will each win a Minor Prize.

18.The Major Prize consists of:
1.Westfield XS Gift Cards to the value of $5,000; and
2.A three (3) hour personal stylist session at the nominated Westfield centre in the winner’s nearest capital city (as outlined in the table below) valued at $600.


19.Stylist session component of the prize must be taken before 31/12/2011.

20.In the event that the Major Prize winner lives outside the greater metropolitan area of their nearest capital city (excluding Darwin and Hobart), the Major Prize winner will be awarded return transfers for themselves, from their place of residence to their nearest capital city and accommodation for one (1) night at a 3 star hotel, up to the value of $1,000 in total.

21.In the event that the Major Prize winner’s nearest capital city is Darwin or Hobart, or the winner resides in Darwin or Hobart, the winner must take the stylist session component of the prize in Brisbane and Melbourne respectively. If the Major Prize winner’s nearest capital city/place of residence is Hobart, he/she will receive a return economy class flight from Hobart to Melbourne and accommodation for one (1) night at a 3 star hotel (up to the value of $1,000 in total). If the Major Prize winner’s nearest capital city/place of residence is Darwin, he/she will receive a return economy class flight from Darwin to Brisbane and accommodation for one (1) night at a 3 star hotel (up to the value of $1,000 in total). Exact hotel will be determined by the Promoter in its absolute discretion. Frequent flyer points will not form part of the prize. Trip itinerary to be determined by the Promoter in its absolute discretion. The Major Prize winner is responsible for ensuring that they have valid travel documentation.

22.The travel and accommodation components of the Major Prize (if applicable to the Major Prize winner) are awarded so that the Major Prize winner can attend the stylist session and thus must be taken to coincide with the redemption of the stylist session.

23.The Promoter will determine, in its absolute discretion, whether the Major Prize winner lives outside the greater metropolitan area of their nearest capital city.

24.The Promoter will organise the accommodation, transfers and flights components of the Major Prize, where applicable.

25.If the Major Prize winner resides within the metropolitan area of their nearest capital city (as determined by the Promoter), then the prize does not include accommodation, transfers or airfares and these components of the prize are not redeemable for cash.

26.Spending money, meals, insurance, transport to and from departure point, transfers (other than those outlined above), items of a personal nature, in-room charges and all other ancillary costs are not included.

27.The Promoter will consult with the Major Prize winner to determine the best date/time to take stylist session component of the prize. In the event that an agreement cannot be reached, the Promoter’s decision will be final.

28.If the Major Prize winner receives accommodation, he/she may be required to present their credit card at time of accommodation check in. City

29.Each of the ten (10) Minor Prizes consists of a $50 Westfield XS Gift Card.

30.Any ancillary costs associated with redeeming the Westfield XS Gift Card are not included. Any unused balance of the Westfield XS Gift Card will not be awarded as cash. Redemption of the Westfield XS Gift Card is subject to any terms and conditions of the issuer including those specified on the Westfield XS Gift Card.

31.Some Westfield retailers may refuse to accept the Westfield XS Gift Card. These retailers include the Coles Group (with the exclusion of Kmart), Myer and the Woolworths Group.

32.A list of retailers at which the Westfield XS Gift Card will be accepted is available at http://westfieldgiftcards.com.au/giftcard/about_gift_cards/where_to_use_the_card/index.html.

33.Winners will be notified via email and will be published on the Sensodyne website, www.sensodyne.com.au. The Major Prize winner will have their details published in the public notices section of The Australian Newspaper on Monday, 13/06/2011.

34.UNCLAIMED PRIZE DRAW

35.A draw for any unclaimed prizes may take place on Monday, 12/09/2011 at the same time and place as the original draw, subject to any directions from a regulatory authority. Winners, if any, will be notified by email. The unclaimed Major Prize winner, if any, will be published in the public notices section of The Australian Newspaper on Friday, 16/09/2011.

36.GENERAL

37.Total prize pool value is up to $7,100.

38.If there is a dispute as to the identity of an Eligible Entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the Eligible Entrant.

39.Subject to the unclaimed prize draw clause, if for any reason a winner does not take a prize (or an element of the prize), then the prize (or that element of the prize) will be forfeited.

40.If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.

41.Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash.

42.The Promoter’s decision is final and the Promoter will not enter into correspondence regarding the competition result.

43.It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and the prize supplier’s requirements.

44.It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.

45.In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the competition on the dates and in the manner described in these Terms and Conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the competition and recommence it from the start on the same conditions, subject to any written directions from a regulatory authority.

46.If this competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to, infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness or integrity or proper conduct of this competition, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any Eligible Entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the competition, as appropriate.

47.Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) and One Partners excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the competition.

48.Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees,  the Promoter (including its respective officers, employees and agents) and One Partners is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control), including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure; (b) any incorrect information either caused by the Eligible Entrant or for any of the equipment or programming associated with or utilised in this competition; (c) any theft, unauthorised access, alternation of entries or third party interference; (d) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (e) any variation in prize value to that stated in these Terms and Conditions; (f) any tax liability incurred by a winner or Eligible Entrant; or (g) use of a prize/participation in the stylist session.

49.Eligible Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

50.The Promoter collects personal information in order to conduct the competition and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. All opt-in entries will be entered into a database and the Promoter may use the Eligible Entrants’ names, addresses and telephone numbers for future promotional, marketing, research, profiling and publicity purposes (including sending electronic messages or telephoning the Eligible Entrants). By opting-in, Eligible Entrants confirm that they allow their details to be used for this purpose. If Eligible Entrants no longer consent to their details being used for future marketing purposes, the Eligible Entrant should contact the Promoter on their details set out below. Any request to opt out, access, update, modify, correct or delete the Eligible Entrant’s details should be directed to the Promoter. All entries become the property of The Promoter.

51.Any cost associated with accessing the competition website is the Eligible Entrant’s responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an Eligible Entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that Eligible Entrant invalid.
