“FOOTYSWAPZ” PROMOTION
TERMS AND CONDITIONS
1. Information on how to enter and prizes form part of these Terms and
Conditions. Participation in this promotion is deemed acceptance of these
Terms and Conditions.
2. Entry is only open to NSW and QLD residents. Employees (and their
immediate families) of the Promoter, participating retailers and agencies
associated with this promotion are ineligible to enter.
3. Promotion commences on 01/02/2011 and ends at 11:59pm AEST on
29/07/2011 (“Promotional Period’).
4. To be eligible to enter and receive a collector card with a unique code,
individuals must purchase a specially marked packet of CC’s, Samboy, Thins,
Cheezels, Chickadees or Original French Fries chips from any participating
store in NSW or QLD during the Promotional Period.
5. To enter, individuals must then visit
www.nrlswapz.com.au, follow the prompts
to the competition entry page, input the requested details including the unique
code found on the collectable card and submit the fully completed entry form
during the Promotional Period.
6. Each entrant will be notified instantly online in writing whether or not they are
an instant winner. All valid entries received from winners and non-winners of
an instant prize will be automatically entered into the major prize draw.
7. The Promoter reserves the right, at any time, to verify the validity of entries
and entrants (including an entrant’s identity, age and place of residence) and
to disqualify any entrant who submits an entry that is not in accordance with
these Terms and Conditions or who tampers with the entry process. Errors
and omissions may be accepted at the Promoter's discretion. Failure by the
Promoter to enforce any of its rights at any stage does not constitute a waiver
of those rights.
8. Incomplete, indecipherable or illegible entries will be deemed invalid.
9. Multiple entries permitted, subject to the following: (a) only one (1) entry
permitted per specified purchase requirement; and (b) each entry must be
submitted separately and in accordance with entry requirements.
10. The major prize draw will take place at Snack Brands, 24 Lexington Drive,
Bella Vista, NSW 2153 on 05/08/2011 at 12.00pm AEST. Major prize draw
winner will be notified in writing and their name will be published in The
Australian on 12/08/2011. The Promoter’s decision is final and no
correspondence will be entered into.
11. Instant Win Prizes: ten (10) x Nintendo Wii console with one (1) controller
valued at $299.00 each; sixty (60) x copies of the Wii Rugby League 3 game
valued at $99.95 each; two-hundred (200) x official NRL dressing gowns with
NRL logo (one size fits all) valued at $99.95 each; 1200 x official NRL
footballs valued at $39.99 each; and 550 x copies of Big League NRL

12. The first valid entry drawn in major prize draw will win the following:
a) One (1) x 55inch Samsung full HD LED LCD TV (Model No. FUA55C7000-
01) valued at $4,799;
b) One (1) x Danzig three (3) seater leather lounge and chaise valued at
$3,499;
c) Sixteen (16) x official NRL dressing gowns with NRL logo (one size fits
all) valued at $99.95;
d) One (1) x Creative Cooling 40L Barrel Fridge with the major prize
winner’s choice of any NRL team wrap design, subject to availability,
valued at $449;
e) One (1) x Nintendo Wii console with one (1) controller valued at $299;
f) One (1) x copy of the Wii Rugby League 3 game valued at $99.95; and
g) One (1) x Rugby League party valued at up to $500. Party includes
beverages, snacks and hired wait staff. The party is to be held at the
major prize winner’s place of residence or at a venue determined by
the major prize winner in agreement with the Promoter but in the event
that agreement cannot be reached, the Promoter reserves the right to
determine the venue. Any additional costs associated with holding the
party, including but not limited to the venue of the party, are not
included and are the responsibility of the major prize winner. The party
must be held within three (3) months of winner notification.
13. If the winner of the major prize is under the age of 18 years, the prize will be
awarded to the winner's nominated parent or guardian on the winner’s behalf.
14. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion,
reserves the right to substitute the prize (or that part of the prize) with a prize
to the equal value and/or specification, subject to any written directions from a
regulatory authority.
15. Total prize pool value is up to $90,932.65 Prizes, or any unused portion of a
prize, are not transferable or exchangeable and cannot be taken as cash.
16. A draw for any unclaimed prizes (excluding the football and magazine instant
win prizes) may take place on 07/11/2011 at the same time and place as the
original draw, subject to any directions from a regulatory authority. Winners, if
any, will be notified in writing and in the event the major prize is awarded, the
major prize winner will have their name published in The Australian on
21/11/2011.
17. Entrants consent to the Promoter using the entrant's name, likeness, image
and/or voice in the event they are a winner (including photograph, film and/or
recording of the same) in any media for an unlimited period without
remuneration for the purpose of promoting this competition (including any
outcome), and promoting any products manufactured, distributed and/or
supplied by the Promoter.
18. If this promotion is interfered with in any way or is not capable of being
conducted as reasonably anticipated due to any reason beyond the
reasonable control of the Promoter, the Promoter reserves the right, in its sole
discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or
(b) subject to any written directions from a regulatory authority, to modify,
suspend, terminate or cancel the promotion, as appropriate.
19. Any cost associated with accessing the promotional website is the entrant’s
responsibility and is dependent on the Internet service provider used. The use
of any automated entry software or any other mechanical or electronic means
that allows an entrant to automatically enter repeatedly is prohibited and will
render all entries submitted by that entrant invalid.
20. Printing and other quality control errors will not invalidate an otherwise valid
prize claim. Unless otherwise due to fraud or ineligibility under these Terms
and Conditions, all prize claims in excess of the advertised prize pool will be
honoured. Instant win game materials void if stolen, forged, mutilated or
tampered with in any way.
21. Except for any liability that cannot be excluded by law, the Promoter (including
its officers, employees and agents) excludes all liability (including negligence),
for any personal injury; or any loss or damage (including loss of opportunity);
whether direct, indirect, special or consequential, arising in any way out of the
promotion, including, but not limited to, where arising out of the following: (a)
any technical difficulties or equipment malfunction (whether or not under the
Promoter’s control); (b) any theft, unauthorised access or third party
interference; (c) any entry or prize claim that is late, lost, altered, damaged or
misdirected (whether or not after their receipt by the Promoter) due to any
reason beyond the reasonable control of the Promoter; (d) any variation in
prize value to that stated in these Terms and Conditions; (e) if the Rugby
League party event is cancelled for any reason beyond the reasonable control
of the Promoter; (f) any tax liability incurred by a winner or entrant; or (g) use
of a prize.
22. As a condition of accepting the major prize, the winner must sign any legal
documentation as and in the form required by the Promoter and/or prize
suppliers in their absolute discretion, including but not limited to a legal
release and indemnity form.
23. The Promoter collects personal information in order to conduct the promotion
and may, for this purpose, disclose such information to third parties, including
but not limited to agents, contractors, service providers, prize suppliers and,
as required, to Australian regulatory authorities. Entry is conditional on
providing this information. The Promoter may, for an indefinite period, unless
otherwise advised, use the information for promotional, marketing, publicity,
research and profiling purposes, including sending electronic messages or
telephoning the entrant. Entrants should direct any request to access, update
or correct information to the Promoter. All entries become the property of the
Promoter.
