TERMS AND CONDITIONS – Freebies RewardsTM Programme – Queensland
Applying for membership
1. Information on how to become a member of the Freebies RewardsTM Programme (the "Programme") and gifts form part of these Terms and Conditions. By applying for membership to the Programme, a participant is deemed to accept and agrees to be bound by these Terms and Conditions.
2. The Programme Administrator may revise these Terms and Conditions from time to time without notice to participants. Since participants are bound by the most current version of these Terms and Conditions, a participant should periodically check the Terms and Conditions. A participant's continued membership to the Programme following the posting of any changes to the Terms and Conditions constitutes acceptance of those changes.
3. Membership to the Programme is free and only open to Australian residents aged 18 years or older. The directors, management and employees (and their immediate families) of the Promoter, its related entities, printers, suppliers, providers and agencies associated with the Programme are permitted to apply for membership. The management and employees of participating retailers are eligible to apply for membership.
There are three (3) categories of membership; ‘Customer', ‘Centro Staff' (includes the directors, management and employees of the Promoter) and ‘Centre Staff' (includes the management and employees of participating retailers).
4. To apply for membership to the Programme, an eligible participant must attend a shopping centre participating in the Programme and visit a FREEBIES Machine ("Rewards Machine"). An eligible participant must then follow the instructions on the "Rewards Machine" to provide the required information. Eligible participants may also join Freebies RewardsTM through visiting the Programme's website at www.freebiesrewards.com.au, or through visiting one of the participating centre's websites and providing the required information (required information may include, but is not limited to, their full name, age, residential address, telephone number, current and valid email address).
5. The Programme Administrator may refuse any application for membership in their sole discretion. An eligible participant who completes the application process in the manner required and whose application is accepted will then be issued a temporary membership card, which can be used immediately until a permanent membership card is issued. A permanent membership card will be either mailed to the eligible participant at their nominated address or available for collection from Centre Management and/or Customer service desk within the participating shopping centre.
6. Incomplete, ineligible or incomprehensible applications will be deemed invalid. No responsibility will be taken for lost, late or misdirected applications.
7. Each eligible participant is limited to one membership of the Programme only in each shopping centre participating in the Programme. Any subsequent applications received from an eligible participant after their first membership application is received will be deemed invalid. Freebies RewardsTM Membership cards can only be scanned at the 'Freebies' Machine by the owner of that Membership Card. Any customer caught scanning a Membership Card which is not registered in their own name is engaging in fraudulent behaviour which may result in the termination of both customers' Memberships. Suspension and termination is at the discretion of the Programme Administrator.
8. Membership cards are not credit or charge cards, are not transferable or redeemable for cash, and remain the property of the Programme Administrator. A participant must immediately notify the Programme Administrator of a lost or stolen membership card. The Programme Administrator is not liable for any delay in replacing a membership card or for any unauthorised use of a membership card.
9. Participants can only apply for membership in their own name. The Programme Administrator and participating shopping centres reserve the right to request a participant produce (within the requested time) appropriate photo identification or other documentation (to the Programme Administrator or participant retailer's satisfaction, at their sole discretion) in order to confirm their identity, age, residential address, eligibility to apply for Programme membership, and any information submitted by the participant in applying for membership to the Programme, before issuing a membership card and admitting the participant into the Programme. If the documentation required by the Programme Administrator or participating shopping centre's is not received by the Programme Administrator or participating shopping centre or a participant's details have not been verified or validated to the Programme Administrator's or a participating shopping centre's satisfaction within the time requested, the participant will not be issued a membership card and will not be admitted to the Programme. Membership cards will only be issued following any participant validation and verification that the Programme Administrator or participating shopping centres require in their sole discretion.
10. The Programme Administrator and a participating shopping centre may terminate or suspend any persons membership of the Programme without in their sole discretion and without notice for any reason including, without limitation, if the participant: fails to comply with these Terms and Conditions; abuses any privilege accorded to the participant under the Programme; supplies any misleading information or makes any misrepresentations to the Programme Administrator or to any participating shopping centre in connection with the Programme; does not use his or her membership card for a period of 12 months; dies; or becomes bankrupt.
11. A participant may terminate his or her membership to the Programme at any time by giving written notice to the Programme Administrator at the address set out in Condition 36 or by following the instructions provided at the "Rewards Machine".
12. The Programme Administrator reserves the right to verify the validity of membership applications and reserves the right to disqualify any participant for tampering with the application process or for submitting an application which is not in accordance with these Terms and Conditions, or if the participant is engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the Programme. The Programme Administrator's legal rights to recover damages or other compensation from such an offender are reserved.
Earning membership points
13. A predetermined number of membership points (to be determined by the Programme Administrator in its sole discretion) will be awarded to a participant when they attend the participating shopping centre, visit the "Rewards Machine" and scan their membership card in the manner required. A participant will only earn membership points up to once per day, regardless of how many times on any given day they attend the participating shopping centre, visit the "Rewards Machine" and scan their membership card (unless otherwise expressly stated on a particular "Rewards Machine").
14. The number of membership points earned will be displayed on the "Rewards Machine" once the participant scans their membership card. Each participant may also be offered the ability to check the number of membership points earned by password protected access to a web based portal.
15. From time to time, bonus membership points may be issued in accordance with individual advertised offers, promotions or competitions at each participating shopping centre. Programme members who enter advertised promotions and competitions or otherwise take advantage of advertised offers, must do so in accordance with the applicable terms and conditions as stated on the "Rewards Machine" or any applicable web based portal.
16. Membership points and the rights they confer cannot be sold, transferred, assigned or otherwise dealt with except in accordance with these Terms and Conditions. Membership points have no cash or monetary value. The Programme Administrator may, in its sole discretion, determine to cancel a participant's membership points if such points have not been used or redeemed for a continuous period of 12 months.
17. In addition to deductions for gifts redeemed (as outlined below), the Programme Administrator will deduct from the membership points balance in a participant's account any membership points credited to the participant's account due to any error.
Redeeming gifts
18. Once a participant has accumulated a certain number of membership points, they will be entitled to redeem their membership points for various gifts from participating retailers at participating shopping centres. Each time a participant attends a participating shopping centre, visits the "Rewards Machine" and scans their membership card in the manner required, they will be notified on the "Rewards Machine" of what gift or gifts they may redeem based on the number of membership points in the participant's account at that time. To redeem a gift, a participant must follow the instructions on the "Rewards Machine" to select their requested gift/s. A voucher for gift redemption will then be immediately printed from the "Rewards Machine". The voucher will be issued in the participant's name. The number of membership points" required to redeem the selected gift will then be deducted from the membership points balance of the participant's Programme account.
19. To collect a gift, a participant must then take the issued voucher to the participating retailer or participating shopping centre customer service desk or centre management stated on the voucher and surrender the voucher to staff at the participating retailer, participating shopping centre customer service desk or centre management who will then issue the participant with the gift.
20. Vouchers are subject to prevailing terms and conditions of use (including expiry dates) and are not replaceable if lost or stolen. A voucher will be declared void if stolen, forged, mutilated or tampered with in any way.
21. A gift may be subject to additional terms and conditions of a participating retailer. All warranty claims in respect of any gift (if applicable) must be directed toward the applicable manufacturer and not the Programme Administrator or participating shopping centre.
22. The Programme Administrator has granted participating shopping centres the right to request a participant to produce appropriate photo identification and their Programme membership card in order to confirm that they are the person named on a voucher, before issuing a gift. If adequate identification is not received by the participating shopping centre or participating retailer to their satisfaction, the participant will not be issued the gift.
23. Gifts must be taken as offered and cannot be varied. Gifts are not transferable or exchangeable and cannot be taken as cash. The Programme Administrator or participating shopping centre accepts no responsibility for any tax implications that may arise from the receipt of gifts. Independent financial advice should be sought.
24. All gifts are subject to availability. If any gift or any element of a gift becomes unavailable for any reason beyond the Programme Administrator's, participating shopping centre's or a participating retailer's reasonable control, the Programme Administrator, participating shopping centre or participating retailer reserves the right to award a similar gift or gift element of equal or greater value in lieu.
25. Some gifts may be offered exclusively to one of the membership categories; ‘Customer', ‘Centre Staff' or ‘Centro Staff' and not be made available to all three membership categories at the discretion of the promoter. The "Rewards Machine" will only display the gifts available to each membership category.
General
25. The Programme Administrator's decision in relation to all aspects of the Programme is final and no correspondence will be entered into.
26. The Programme Administrator, participating shopping centres and the participating retailers and their associated agencies and companies shall not be liable for any loss (including, without limitation, indirect or consequential loss), damage, personal injury or death which is suffered or sustained (including but not limited to that arising from any person's negligence) in connection with their membership to the Programme or their use of a gift, except any liability that cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
27. Any tax, liability or duty arising from a participant's membership to or participation in the Programme is the responsibility of each participant.
28. Participating retailers do not have any authority, express or implied, to make any representation, warranty or statement on behalf of the Programme Administrator and the Programme Administrator accepts no liability in respect of such representations, warranties or statements.
29. Caution: any attempt to cause malicious damage or interference with the normal functioning of the "Rewards Machine", the Programme Administrator's or participating shopping centre's website or the information on the website, or to otherwise undermine the legitimate operation of the Programme may be a violation of criminal and civil laws and should such an attempt be made, whether successful or not, the Programme Administrator reserves the right to seek damages to the fullest extent permitted by law. If the Programme Administrator suffers loss or incurs any costs in connection with any breach of these Terms and Conditions or any other legal obligation by a participant, the participant agrees to indemnify the Programme Administrator for those losses, damages and costs.
30. The Programme Administrator or participating shopping centres are not responsible for any problems or technical malfunction of any telephone or network or lines, servers or providers, computer equipment, software, technical problems or traffic congestion on a mobile network, or any combination thereof, or any other technical failures including any damage to a participant's or any other person's mobile handset or computer related to, or resulting from, participation in the Programme or the downloading of any materials related to the Programme.
31. If for any reason the Programme is not capable of running as planned because of infection by computer virus, bugs, tampering, unauthorised intervention, technical failures or any other causes beyond the reasonable control of the Programme Administrator which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Programme, the Programme Administrator reserves the right in its sole discretion to cancel, terminate, modify or suspend the Programme.
32. The Programme Administrator reserves the right to suspend or terminate the Programme at any time without prior notice. The Programme Administrator will not be liable for the suspension or termination of the Programme on any account whatsoever including (without limitation) for any membership points balance in a participant's account at the time of suspension or termination.
33. The use of any automated software or any other mechanical or electronic means that allows a participant to automatically apply for Programme membership, obtain vouchers or claim gifts is prohibited.
34.The Programme Administrator will not be responsible for any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, the Programme, if the deficiency is occasioned by any cause outside the reasonable control of the Programme Administrator.
35. All membership applications and any copyright subsisting in the applications become and remain the property of the Programme Administrator. The Programme Administrator collects personal information about a participant to include a participant in the Programme and where appropriate award gifts. If the personal information requested is not provided, the participant may not participate in the Programme. By participating in the Programme, the participant also acknowledges that a further primary purpose for collection of a participant's personal information by the Programme Administrator is to enable the Programme Administrator to use the information to assist the Programme Administrator, participating retailers and participating shopping centres in improving goods and services and to contact the participant in the future with information on special offers or provide the participant with marketing materials via any medium including mail, telephone and commercial electronic messages (SMS (Short Message Service), MMS (Multimedia Message Service), IM (Instant Messaging) and email) or any other form of electronic, emerging, digital or conventional communications channel whether existing now or in the future. The Programme Administrator may share information with its Australian related companies or promotional partners (including participating shopping centres and participating retailers) who may contact the participant with special offers in this way. By participating in the Programme, the participant agrees that the Programme Administrator may use the participant's personal information in this manner. A participant may gain access to, update or correct any personal information by contacting the Programme Administrator at the address below. All personal information will be stored at the office of the Programme Administrator. A copy of the Programme Administrator's Privacy Policy in relation to the treatment of personal information collected is available by contacting the Programme Administrator

CONFDITIONS OF ENTRY

FREEBIES REWARDSTM PROGRAMME INSTANT WIN PROMOTION [Queensland]

1.Information on how to enter and prizes form part of these Conditions of Entry. Entry into this promotion is deemed acceptance of these Conditions of Entry by each entrant.
2.Entry into the promotion is free and only open to Australian residents aged 18 years or older who are existing members or become members of the Freebies RewardsTM Programme for a participating shopping centre (the "Programme") in the manner required during the Promotional Period and who have a current and valid temporary or permanent membership card for the Programme. All entries of entrants who are under the age of 18 years and enter the promotion without disclosing (or attempting to conceal) their age will be deemed invalid.
3.The promotion commences at 6:00 am (Local time) on 26/10/2010 and closes at midnight (Local time) on 27/10/2011 ("Promotional Period"). Each participating shopping centre will conduct its own internal promotion during the Promotional Period as stated on each participating shopping centre's Freebies machine ("Rewards Machine") from time to time. All winners will be randomly determined and notified immediately upon scanning their membership card in the manner outlined in Condition 4, and the name and locality of winners of prizes valued at over $250.00 will be notified in writing (SMS or email) within seven (7) days of the winner being notified that they are a winner. Winners of prizes valued at over $250.00 will also be published on each participating shopping centre's Rewards Machine screen interface for all Programme members to view on the day that the winners were randomly determined and notified of their win. Instant Win prize winners of prizes valued at over $250.00 will also be published in The Age on the 7th day after the day upon which the Instant Win prize winner(s) won their prize. All reasonable steps to notify winners of the results will be taken by the Promoter. The Promoter's decision in relation to all aspects of the promotion is final and no correspondence will be entered into.
4.To enter a promotion, eligible entrants must attend a participating shopping centre during the relevant Promotional Period for that shopping centre, visit the Rewards Machine and scan their Programme membership card in the manner required. The Promoter will have access to the details of the entrant's full name, residential address, current and valid email address and contact telephone number, as provided to the Promoter in the entrant's Programme membership application. Eligible entrants will then be immediately notified on the Rewards Machine if they have won an Instant Win prize and if so, what prize they have won.
5.There are three (3) categories of membership; ‘Customer', ‘Centro Staff' (includes the directors, management and employees of the Promoter but excludes the Rewards System software providers, developers and their employees) and ‘Centre Staff' (includes the management and employees of participating retailers). When the eligible entrant visits the participating shopping centre and registers to become a Freebies RewardsTM Member, the system requires them to choose between ‘Customer', ‘Centro Staff' or ‘Centre Staff'. The eligible entrant will be asked to confirm their job title. Each membership category will only have a chance to win prizes from their selected membership category. Some prizes may be offered exclusively to one of the membership categories; ‘Customer', ‘Centre Staff' or ‘Centro Staff' and not be made available to all three membership categories at the discretion of the promoter. The "Rewards Machine" will only display the gifts available to each membership category. Eligible entrants can change their membership category through contacting the participating Centro Centre's Centre Management Office or Customer Service Desk. The Rewards System software providers, developers and their employees are ineligible to enter the promotion.
6.Multiple entries into the promotion will be accepted, but generally limited to only one (1) entry per calendar day for each Programme member, unless otherwise advertised on the Rewards Machine and/or other media at the applicable participating shopping centre ("Visit"). Only one (1) entry accepted per Visit and each entry must be submitted separately and must independently comply with these Conditions of Entry. A member may only enter using their own membership card and may only redeem prizes, offers and vouchers won using their own membership card. Entries must be received during the Promotional Period for the applicable participating shopping centre. Rewards Machine entries will be deemed to be accepted at the time of receipt and not at the time of transmission.
7.Instant Win prize winners must follow the instructions on the Rewards Machine to select their requested Instant Win prize (if applicable). A voucher for the Instant Win prize will then be immediately printed from the Rewards Machine. The voucher will be issued in the eligible entrant's name and/or membership number only. Vouchers will not be available through any other means.
8.To collect an Instant Win prize, an eligible entrant must take the issued voucher to the participating retailer, customer service desk or centre management in the participating shopping centre (as stated on the voucher) and surrender the voucher to staff at the participating retailer, customer service desk or centre management, who will then issue the eligible entrant with their Instant Win prize. The voucher must be an original and photocopies or images of vouchers will not be accepted.
9.Vouchers for an Instant Win prize can only be redeemed once. Any attempt to subsequently use a voucher after the first valid redemption by an eligible entrant will be invalid. Vouchers are subject to prevailing terms and conditions of use (including expiry dates) and must be redeemed by the date stated on the voucher otherwise their prize will be forfeited. Vouchers are not replaceable if lost or stolen. The Promoter accepts no responsibility for late, lost or misdirected vouchers. All warranty claims in respect of prizes must be directed towards the applicable manufacturer or supplier and not the Promoter.
10.There will be up to nine (9) participating shopping centres across Queensland each awarding its own Instant Win prizes during the Promotional Period. Details and value of the Instant Win prizes for a given promotion will be advertised on the Rewards Machine during the Promotional Period at the applicable participating shopping centre. The Instant Win prizes for each participating shopping centre across Queensland during the Promotional Period will include a combination of one or more of the prize types particularised in detail in the table immediately below ("Instant Win prizes"):

11.The total maximum prize pool value for all Instant Win prizes awarded during the Promotional Period in each participating shopping centre is up to $319,450.00. The total maximum prize pool value in Queensland is up to $4,152,850.00. All prize values are Recommended Retail Price including GST.
12.The Instant Win prizes must be taken as offered and cannot be varied. An Instant Win prize or any unused portion of an Instant Win prize is not exchangeable or transferable and cannot be taken as cash. The Promoter accepts no responsibility for any variation in prize value. The Promoter accepts no responsibility for any tax implications that may arise from the receipt of an Instant Win prize. Independent financial advice should be sought.
13.If any Instant Win prize or any element of an Instant Win prize becomes unavailable for any reason beyond the Promoter's or a participating retailer's or centre management's (as applicable) reasonable control, the Promoter or participating retailer or centre management's (as applicable) reserves the right to award a similar Instant Win prize or Instant Win prize element of equal or greater value in lieu subject to any written directions made under applicable State legislation.
14.Entrants can only enter in their own name. The Promoter and participating retailers reserve the right to request an entrant produce (within the requested time) appropriate photo identification and Programme membership card and any other documentation (to the Promoter's satisfaction, at its sole discretion) in order to determine an entrant's identity, age, residential address and email address, eligibility to enter and claim a prize and any information submitted by the entrant in entering the promotion (including confirming consent of a winner's parent or legal guardian and the name, age and address of the parent or legal guardian that gave their consent, where a winner is under 18 years of age) before issuing a prize. If the documentation required by the Promoter is not received by the Promoter (or its nominated agent) or the entrant or entry has not been verified or validated to the Promoter's satisfaction within the time requested, that entry will be deemed invalid. All prizes will only be awarded following any validation and verification that the Promoter requires in its sole discretion, including confirmation that an entrant is a Rewards Programme member at the participating shopping centre.
15.In the event of any awarded Instant Win prize(s) being unclaimed by 11.59 pm (Local time) on 27/01/2012 from any participating shopping centre, the Promoter may conduct an unclaimed Instant Win prize draw(s) as are necessary at 6:00 pm (Local time) on the 02/02/2012 at 1 Taylors Road, Keilor Downs, Vic 3038 in order to distribute any Instant Win prize(s) awarded but unclaimed by that date subject to any written directions given under applicable State legislation. All winners in any unclaimed Instant Win prize draw will be notified in writing (SMS or email). Unclaimed Instant Win prize winners of prizes valued at over $250.00 will also be published in The Age on 07/02/2012.
16.Printing or any other quality control errors will not invalidate an otherwise valid Instant Win prize claim. Unless otherwise due to fraud or ineligibility under these Conditions of Entry all prize claims in excess of any advertised prize pool will be met. Instant Win prize game materials, including the vouchers, are void and ineligible to enter the promotion if stolen, forged, mutilated or tampered with in any way or if such materials fail the Promoter's validation tests in which case they will be deemed void.
17.Instant Win prizes will only be awarded where the Instant Win prize game material fulfil all of the requirements of the Promoter's verification tests and procedures. The verification tests and procedures shall be determined by the Promoter in its absolute discretion.
18.The Promoter, the participating shopping centre owners, the participating retailers and its and their associated agencies and companies shall not be liable for any loss (including, without limitation, indirect or consequential loss), damage, personal injury or death which is suffered or sustained (including but not limited to that arising from any person's negligence) in connection with taking or using any Instant Win prize, except any liability that cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
19.The Promoter reserves the right to verify the validity of entries and reserves the right to disqualify any entrant: (a) for tampering with the entry process; or (b) for submitting an entry which is not in accordance with these Conditions of Entry; or (c) if the entrant is engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
20.Caution: any attempt, deliberate or otherwise, to damage the Rewards Machine or the information on the Rewards Machine, to cause malicious damage or interference with the normal functioning of the Rewards Machine, or to otherwise undermine the legitimate operation of this promotion may be a violation of criminal and civil laws and should such an attempt be made, whether successful or not, the Promoter reserves the right to seek damages to the fullest extent permitted by law. If the Promoter suffers loss or incurs any costs in connection with any breach of these Conditions of Entry or any other legal obligation by an entrant, the entrant agrees to indemnify the promoter for those losses, damages and costs.
21.The Promoter is not responsible for any problems, delays or technical malfunction of any Rewards Machine, telephone or network or lines, servers or providers, computer and technical equipment, software, technical problems or traffic congestion on a network, or any combination thereof, or any other technical failures including any damage to entrant's or any other person's computer, telephone or mobile handset or peripherals related to, or resulting from, participation in this promotion.
22.If for any reason this promotion is not capable of running as planned because of infection by computer virus, bugs, tampering, unauthorised intervention, technical failures or any other causes beyond the reasonable control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to cancel, terminate, modify or suspend the promotion, subject to any written directions under State legislation.
23.The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
24.The Promoter will not be responsible for any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, this promotion if the deficiency is occasioned by any cause outside the reasonable control of the Promoter including without limitation technical malfunctions or failures.

FREEBIES REWARDSTM PROGRAMME – SPECIAL OFFERS

CONDITIONS OF ENTRY – Queensland

1. Information on how to participate in the Special Offers and the gifts comprising the Special Offers themselves form part of these Conditions of Entry. Participation in the Special Offers promotion is deemed acceptance of these Conditions of Entry by each claimant.

2. The Special Offers are only open to claimants who are Australian residents aged 18 years or older who are existing members of the Freebies RewardsTM Programme for a participating shopping centre ("Programme") and who have a current and valid temporary or permanent membership card for the Programme ("Participants").

3. Special Offers connected with the Programme may take any form or be of any nature (including goods, services, products, discounts, 2 for 1 offers, etc) and will be as stated from time to time on each participating shopping centre's Freebies machine(s) ("Rewards Machine") and/or upon any other media. Each Participant may also be offered the ability to check the available Special Offers and their expiry dates by password protected access to a web based portal.
4. Participation in the Special Offers by Participants who are under the age of 18 years is not permitted. The directors, management and employees (and their immediate families) of the Promoter, its related entities, printers, suppliers, providers and agencies associated with the Special Offers are eligible to claim the Special Offers. The management and employees of participating retailers are eligible to claim Special Offers. There are three (3) categories of membership; ‘Customer', ‘Centro Staff' (includes the directors, management and employees of the Promoter) and ‘Centre Staff' (includes the management and employees of participating retailers).
Some gifts may be offered exclusively to one of the membership categories; ‘Customer', ‘Centre Staff' or ‘Centro Staff' and not be made available to all three membership categories at the discretion of the promoter. The "Rewards Machine" will only display the gifts available to each membership category.

5. The Promoter's decision in relation to all aspects of Special Offers and the awarding of Special Offers is final and no correspondence will be entered into.

6. To participate in an advertised Special Offer, Participants must attend a participating shopping centre, visit the "Rewards Machine" and scan their Programme membership card in the manner required. The Promoter will have access to the details of the entrant's full name, residential address, current and valid email address and contact telephone number, as provided to the Promoter in the Participant's Programme membership application. Participants will then be immediately notified on the "Rewards Machine" if they have won qualified for a Special Offer and if so, what Special Offer they have been awarded.

7. The redemption of only one (1) Special Offer per Programme Participant per day is permitted unless otherwise stated on a participating shopping centre's "Rewards Machine".

8. Special Offer Participants must follow the instructions on the "Rewards Machine" to select their requested Special Offer (if applicable). A voucher for the Special Offer will then be immediately printed from the Machine. The voucher will be issued in the Participant's name.

9. To collect the Special Offer, Participants must then take the issued voucher to the participating retailer or participating shopping centre customer service desk stated on the voucher and surrender the voucher to staff at the participating retailer or customer service desk (as the case may be), who will then issue the eligible claimant with their Special Offer. The voucher must be an original and photocopies or images of vouchers will not be accepted.

10. Vouchers for a Special Offer can only be redeemed once. Any attempt to subsequently use a voucher after the first valid redemption by an eligible claimant will be invalid. Vouchers are subject to prevailing terms and conditions of use (including expiry dates) and must be redeemed by the date stated on the voucher. Special Offers may be subject to the terms and conditions of the relevant participating retailer or participating shopping centre. Vouchers are not replaceable if lost or stolen. All warranty claims in respect of Special Offers must be directed towards the applicable manufacturer and not the Promoter or participating shopping centre.

11. Each Special Offer must be taken as offered and cannot be varied. A Special Offer, or any unused portion of a Special Offer, is not exchangeable or transferable and cannot be taken as cash. The Promoter accepts no responsibility for any variation in a Special Offer value. The Promoter accepts no responsibility for any tax implications that may arise from the receipt or use of Special Offers. Independent financial advice should be sought.

12. Each Special Offer will be valued at up any stated value on the voucher (Recommended Retail Price including GST).

13. If any Special Offer or any element of an Special Offer becomes unavailable for any reason beyond the Promoter's or a participating retailer's reasonable control, the Promoter and/or participating retailer reserves the right to award a similar Special Offer or Special Offer element of equal or greater value in lieu.

14. Claimants can only enter and claim Special Offers in their own name. The Promoter, participating shopping centres and participating retailers reserve the right to request a claimant produce (within the requested time) appropriate photo identification and membership card and any other documentation (to the Promoter's / participating shopping centres / participating retailers satisfaction, at their sole discretion) in order to determine a claimant's identity, age, residential address and email address, eligibility to claim a Special Offer as a Participant and any information submitted by a claimant before issuing a Special Offer. If the documentation required is not received by the Promoter / participating shopping centre / participating retailer (or their nominated agent) or the Special Offer claim has not been verified or validated to their satisfaction within the time requested, that claimant's claim will become invalid. All Special Offers will only be awarded following any claimant validation and verification that the Promoter / participating shopping centre / participating retailer (or their nominated agent) requires in their sole discretion.

15. Special Offer materials, including the vouchers, are void if stolen, forged, mutilated or tampered with in any way or if such materials fail the Promoter's / participating shopping centre's / participating retailer's (or their nominated agent's) validation tests in which case they will be deemed void.

16. HOW TO ENTER


1.To be eligible to enter the 'Win a $1,000 Woolworths Grocery Card' at Centro Springwood (Promotion), entrants must, during the Promotional Period:
a.Visit a 'Freebies' Machine at Centro Springwood and:
i.IF ALREADY A FREEBIES REWARDS‚Ѣ MEMBER: Scan their Freebies Rewards‚Ѣ membership card to enter the Promotion; or
ii.IF NOT A FREEBIES REWARDS‚Ѣ MEMBER: Register their details on the 'Freebies' Machine to enter the Promotion and subsequently scan their Freebies Rewards‚Ѣ membership card to enter the Promotion
2.Multiple entries into the Promotion will be accepted, but limited to only one (1) entry per day, during the Promotional Period, for each Freebies Rewards programme member visit (Visit). Each entry must be submitted separately and must independently comply with these terms and conditions.

THE PROMOTER

5.The Promotion is promoted by CPM (QLD) Pty Ltd ABN 12 085 255 581 (Promoter) as manager of Centro Springwood, 34 Fitzgerald Avenue, Springwood QLD 4127.

DETAILS OF THE PRIZE AND VALUE

6.There is one prize available to be won in the Promotion totalling a prize pool value of $1,000:

a.One (1) x $1,000 Woolworths Grocery Card (Prize).
b.The Prize will be awarded as ten $100 Woolworths Grocery Only Cards to the total value of $1,000 from Woolworths at Centro Springwood.
c.The Prize will be available for collection from the Centre Management Office at Centro Springwood. The date will be specified by the Promoter and will be within twenty eight (28) days of the Winner being notified.
d.Unless otherwise agreed by the Promoters, the Prize must be collected from the relevant Centre Management Office within three (3) months of the end of the Promotion Period.
e.The Prize will be valid for twelve (12) months from the date of the draw which will be held at 10.00am Monday 9 May 2011.
f.The Prize is not transferrable, refundable, or exchangeable for cash or kind, must be taken as offered and is subject to terms and conditions.
g.Delivery, warranty and insurance are not included as part of the Prize. The warranty on the goods and services obtained as a result of this Promotion remains the sole responsibility of the manufacturer/supplier of the Prize.


HOW TO WIN

7.The draw will take place at 10.00am on Monday 9 May 2011 via a random electronic draw from the pool of all eligible entries received at The Competition Company located at Studio 2, 11 Carlisle Street, Tamarama NSW 2026, the first valid entry drawn will be deemed the winner (“Winner').
8.The winner does not need to be present at the draw and will be notified that they have won by phone, email and in writing thereafter.
9.If, despite every reasonable effort, the winner cannot be contacted within three (3) months of the Draw (being Monday 8 August 2011), that winner will no longer be entitled to the applicable Prize. In such circumstances, the Promoters will send a letter to the regulatory authorities setting out full details and steps taken to contact the winner and request that a redraw be conducted at 10.00am on Monday 29 August 2011 via a random electronic draw at The Competition Company located at Studio 2, 11 Carlisle Street, Tamarama 2026 (or at such other time, date and place determined by the Promoters). The first random electronically drawn valid entry drawn in the re-draw will be entitled to the applicable Prize (Replacement Winner). The Replacement Winner is then the winner of the Prize for the purposes of these Terms and Conditions. If the Promoter has not had return communication from any initial intended Winner (i.e. reasonable attempts to contact the Winner have met with failure) then that person shall be deemed to no longer be eligible for the Prize and the Promoter must announce a Replacement Winner.
10.The winner will receive their Prize within twenty eight (28) days of verification of their details.
11.Any decision made by the Promoter is final and no correspondence will be entered into.
12.Each eligible entrant must retain and may be required to present a proof of registration in order to claim the Prize. If an entrant is unable to provide proof of registration for all entries made, then all the gift claims of that entrant will be ineligible and deemed invalid. Proof of registration includes showing the original Freebies Rewards‚Ѣ Membership card used to make the entry.

CONDITIONS OF ENTRY

13.Entry is only open to persons 18 years or older who are existing members, or become members of the Freebies Rewards programme for Centro Springwood prior to entering the Promotion.
14.The Promotion is open to all persons except management, employees, contractors and agents of Centro Springwood and their immediate families; sponsors of the Promotion and their immediate families; employees of Centro Properties Group and their immediate families; tenants in Centro Springwood and their immediate families; the staff of tenants in the Centro Springwood and their immediate families; the contractors of tenants in Centro Springwood and their immediate families; and the proprietors and staff of companies involved in the production, publishing and administration of this Promotion and their immediate families. Immediate families mean parents, siblings, spouse, children and grandparents. Tenant means lessees, licensees and, in the case of a corporation, includes their directors.
15.Customers may enter the Promotion more than once subject to, and in accordance with, these Terms and Conditions.
16.Customers must also comply with the general terms and conditions of the Freebies Rewards programme for Centro Springwood available at the Freebies Machine.
17.Prize claims will not be accepted via mail. Entrants must follow the procedure in clause 1.
18.Freebies Rewards‚Ѣ Membership Cards scanned after the Promotion Period will not be accepted as entry into the Promotion.
19.No responsibility will be accepted for late, lost, misdirected, or forged entries. Entries which contain incorrect contact details shall be deemed invalid.
20.Freebies Rewards‚Ѣ Membership cards must be original and photocopies or images will not be accepted. Entries forged. Illegal, mutilated, copied or tampered with in any way will not be eligible for prize redemption.
21.Freebies Rewards‚Ѣ Membership Cards are void and ineligible to enter the Promotion if stolen, forged, mutilated or tampered with in any way or if the Freebies Rewards‚Ѣ Membership Card fails the Promoters' validation tests.
22.Entrants can only enter in their own name. The Promoter reserves the right to request the Winners to produce (within the requested time) appropriate photo identification or other documentation (to the Promoter's satisfaction, at its sole discretion) in order to confirm each Winner's identity, age, residential or email address, eligibility to enter and claim a Prize and any information submitted by each Winner in entering the Promotion. Before issuing the Prize, if the documentation required by the Promoter (or its nominated agent) or the winning entry has not been verified or validated or the Promoter's satisfaction within the time requested, that Winner's entry will become invalid.
23.The Promoter reserve the right, at any time and in their sole discretion, to verify the validity of entries and entrants (including an entrant's identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions, who tampers with the entry process, or engages in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the Promotion. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
24.If the Prize (or part of any Prize) is unavailable, the Promoters reserve the right to substitute the Prize (or that part of the Prize) with a prize to the equal value and/or specification, subject to any directions from a regulatory authority and any applicable statutory requirements.
25.The Promoters and their associated agencies take no responsibility for any Prize damaged or lost in transit.
26.By entering the Promotion, the entrants hereby give the Participating Centro Shopping Centres authority to publicly announce their name (should they be a winner) at the time of the Draw and at any stage thereafter.
27.It is a condition of accepting the prize that the Winners may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.
28. The name of the winner will be published on Centro Springwood's website Monday 16 May 2011.
29. If a redraw is conducted pursuant to clause 9 above, the name of the Replacement Winner will be published on Centro Springwood's website on Monday 5 September 2011.



30.The winner acknowledges and agrees that the Promoter may publish or cause to be published the winner's name and locality in any media as required under the relevant lottery legislation.
31. All entries and any copyright subsisting in the entries become and remain the property of the Promoter.

32.By entering the promotion, each entrant consents to the disclosure of personal information they have submitted in entering the promotion to Centro Properties Limited and its related entities. Any personal information disclosed to Centro Properties Limited or its related entities can be added to and used for databases and future mail outs or emails of a promotional nature only. All entries and any copyright subsisting in the entries become and remain the property of the Promoter. The Promoter collects personal information about entrants to include entrants in the promotion and where appropriate award prizes. If the personal information requested is not provided, the entrant may not participate in the promotion.
