Terms and Conditions

1. Instructions on how to enter form part of these Conditions of Entry. Participation in this Promotion is deemed acceptance of these Conditions of Entry.
2. The competitions are open to all residents of Australia and New Zealand that are over the age of 18 years and are members of Kidspot Social, except employees of the Promoter and members of their immediate families and agencies associated with this promotion.
3. Promotion commences at 4pm on Tuesday, 28th June, 2011 (AEST) and closes at midnight on Tuesday, 2nd August, 2011 (AEST) [“Promotional Period”].
4. To enter into the Kidspot Social competitions, members must login or create a Kidspot Social account.

5. To enter the KIDSPOT My Little Pony Adventures Photo Competition, entrants must:
--- a) Upload a photo of their child out on a ‘My Little Pony Adventure’ with their My Little Pony toy or with one of the approved My Little Pony colouring-in cutouts (CLICK HERE to choose from the approved cutouts for entry) and provide a 25 words or less caption describing the adventure. Photo and caption are to be uploaded into the Friendship Is Magic group photo album at the following link:

--- a) Only the seven provided printable cutouts are approved to be used as part of entry into this competition. CLICK HERE to access the approved printables.
--- b) Other pony images or cutouts will be deemed ineligible entries.
7. Multiple entries are permitted in each promotion, subject to the following:
--- a) each entry must be substantially unique; and
--- b) each entry must be submitted separately and in accordance with entry requirements.
8. Incomplete, illegible and inappropriate entries will be deemed invalid and will not be included in the judging.
9. If the entry is deemed inappropriate or offensive, it will be removed by Kidspot administrators at their discretion.
10. The winners’ entry photo, Kidspot Social profile photo and details may be posted to the Kidspot Facebook page as well as across various Kidspot communication channels.
11. Entrants are encouraged to share their entry photo URL with their friends via email, Facebook, Twitter and other online platforms, to seek Votes on their entry photo.
--- a) Votes will not form the full basis for judging the winners of the My Little Pony Friendship Is Magic competitions, however the Kidspot judges will take into consideration the photo entries with the most Votes when considering the winners.
12. One weekly minor prize winner will be chosen from the current entries throughout the 5 week promotion. At the end of the 5 week promotion period, a panel of judges appointed by the Promoters will choose one major winner from the pool of all photos entered into the KIDSPOT My Little Pony Adventures competition topic over the duration of the competition. Judging will take place at Kidspot, Level 5, 14 Queens Road, Melbourne Victoria 3004. The winners will be announced in the Kidspot Social Friendship Is Magic group and notified by email by July 27th, 2011. Each entry will be individually judged based on originality, creative merit and alignment with the ‘My Little Pony Adventures’ theme.
13. The major prize winner of the KIDSPOT My Little Pony Adventures photo competition will win $2000 cash, plus a HASBRO My Little Pony toy and merchandise pack, valued at $500 (RRP).
14. The five minor weekly winners of the Kidspot My Little Pony Adventures photo competition will each win $100 cash, plus a HASBRO My Little Pony gift-pack, which includes four toy packs from the new My Little Pony: Friendship is Magic range.
15. All Kidspot Social competition winners must:
--- a) Agree to have their entry featured on the Kidspot Social homepage
--- b) Be agreeable to the usage of their profile photo and details within Kidspot onsite creative, editorial features and email communication
--- c) Provide all necessary contact details to allow for prize delivery and communication with Kidspot in relation to the KIDSPOT My Little Pony Adventures competition.
--- d) Be agreeable to their contact details being provided to Kidspot (Promoter) and HASBRO (Prize provider) for the purposes of prize fulfilment.
16. The judges’ decision in relation to all aspects of this promotion is final and binding on all who enter and no correspondence will be entered into.
17. The KIDSPOT My Little Pony Adventures competition is a game of skill and chance plays no part in determining the winners.
18. The Entrant’s entry must be original and must not infringe on any third party’s intellectual property rights. The Promoter reserves the right to seek a declaration from any entrant that their entry complies with this clause.
19. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Conditions of Entry or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
20. If for any reason this promotion is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this competition, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the competition.
21. In the event that for any reason whatsoever a prize winner does not take an element of the prize at the time stipulated by the Promoter, then that element of the prize will be forfeited by the prize winner. If the prize is forfeited within twenty four business hours of the notification taking place, a re-judging will occur immediately.
22. Any costs associated with accessing the Kidspot website are the responsibility of the person seeking access and are dependent on the internet service provider used.
23. All entries are deemed to be received at the time of receipt by the Promoter, not time of transmission by the entrant. The Promoter accepts no responsibility for late, lost or misdirected entries.
24. All entries submitted become the property of the Promoter.
25. Except for any liability that cannot be excluded by law, the Promoter (and their respective officers, employees and agents) exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter.s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Conditions of Entry; (f) any tax liability incurred by a winner or entrant; (g) the prize and/ or (h) participation in the promotion.
