COMPETITION (COMPETITION)
Terms and Conditions1. Information on how to enter and prize details form part of these terms and conditions. Entry into the Competition is taken to mean your acceptance of these terms and conditions.
2. The Competition commences at 12.01am Australian Eastern Standard Time (AEST) on 1 July 2011. Entries close last mail received at the address given in Item 6 below by 5.00pm Australian Eastern Daylight Saving Time (AEDST) on 14 October 2011 (Promotion Period).
3. The promoter is TRUenergy Pty Ltd (ABN 99 086 014 968) of Level 33, 385 Bourke Street, Melbourne VIC 3000 (Promoter).
4. Entry is open to residents of New South Wales, the Australian Capital Territory, Victoria or Queensland aged 4 - 12 years as at 20 October 2011. Children and charges of directors, management and employees of the Promoter or any agencies, firms or companies associated with the Competition are ineligible to enter.
5. To be eligible to win, entrants must obtain permission from their parent or legal guardian on the Competition entry form.
6. To enter, you must, during the Promotion Period, print out the entry form provided at
www.energyaustralia.com.au/smurfs, colour in one of three Smurfs characters, correctly complete your details (including your name, address, age category, parental permission and parent or guardian contact phone number) and mail to:

7. You will be entered in one of three (3) age categories as nominated on your entry form. The age categories are 4 - 6 years; 7 - 9 years and 10 - 12 years.
8. You may only enter once.
9. By providing parental consent on the Competition entry form, the entrants parent or legal guardian warrants that the entrants work is their own.
10. Competition judging will take place at Level 19, 321 Kent St, Sydney NSW 2000 at 2.00pm AEDST on 20 October 2011. The judging panel will be composed of at least two (2) Sales & Marketing representatives from TRUenergy or their nominees.
11. Entries will be judged based on artistic merit given the childs age. The judges decision is final. No correspondence will be entered into.
12. Fifteen (15) winners will be chosen from each category with a total of forty-five (45) prizes to be won. Each winner will receive an official The Smurfs 3D movie merchandise pack valued at RRP $70 containing:
* Ubisoft The Smurf game [Nintendo DS]
* Smurf lunch box
* Smurf water bottle
* Smurf moodlight
13. The winners parent / guardian will be notified by telephone and winners will also be notified by mail.
14. If any prize remains unclaimed after 20 January 2012, EnergyAustralia will award the prize to a runner up. Unclaimed prize winners will be notified by telephone and by mail. If there are fewer than fifteen (15) entrants in any one age category then leftover prizes will be evenly allocated amongst the other age categories giving preference to categories with the highest number of entrants.
15. The total maximum prize value for the Competition is RRP $3,150.00.
16. All other costs associated with taking and using the prize are the responsibility of the winner.
17. A prize is not negotiable, exchangeable or redeemable for cash.
18. The Promoter takes no responsibility for any variation in the value of a prize.
19. If the nominated prize is unavailable due to circumstances outside the control of the Promoter, the Promoter reserves the right to supply an alternative prize of similar monetary value, subject to any written direction from State and Territory lottery authorities.
20. The Promoter accepts no responsibility for late, lost or misdirected entries or for any technical difficulties including periods of unavailability of the entry documentation during the Promotion Period which are outside the Promoters control.
21. Entries which are incomplete, incorrect, offensive, non-serious or incomprehensible are not eligible to win.
22. No responsibility is accepted for entries not received by the Promoter. Entries will not be accepted if they are illegitimate, forged, manipulated or tampered with in any way. The Promoter reserves the right to disqualify any individual who is involved in any way in interfering or tampering with the conduct of this promotion.
23. The Promoter will not be held liable for any loss, damage or injury which results directly or indirectly from acceptance of the prize, except where such loss cannot be excluded by law or for wilful or negligent acts or omissions of the Promoter.
24. All entries become the property of the Promoter and entries will not be returned. Entrants consent to the Promoter modifying, adapting and/or publishing the entry in whole or in part without royalty, payment or other compensation to the entrant. The entrant unconditionally and irrevocably consents to any act or omission that would otherwise infringe any of the entrants moral rights in the Materials (as defined in Part IX of the Copyright Act 1968 (Cth)) and present and future rights of a similar nature conferred by statute anywhere in the world whether occurring before or after this consent is given (Moral Rights). The entrant waives all Moral Rights in the Materials that arise outside Australia.
25. By accepting the prize, winners agree to be contacted by the Promoter about the Competition and to participate in publicity activities as reasonably requested, including being interviewed and photographed by the Promoter for use by the Promoter in future marketing and promotional activities including future editions of EnergyWise, without requiring payment by the Promoter or further consent from the winner.
26. Details from entries will be collected and used for the purpose of conducting this Competition (including delivery of the prize), which may include disclosure to third parties (including Sony Pictures Releasing and TRUenergy contractors, suppliers or agents). By entering this Competition, entrants consent to the use of this information as described, and agree that the Promoter, may use this information for promotional, marketing and publicity purposes (including sending the EnergyWise newsletter electronically). Entrants should direct any request to access, update or correct information to the Promoter.
