Information on how to enter and the prize(s) form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
Promotion commences at 9:00am AEST on 01/08/11 and ends at 11:59pm AEST on 02/10/11 ("Promotional Period").
Entry and voting is only open to Australian residents. Entrants under 18 years old must have parental/guardian approval to enter and further, the parent/guardian of the entrant must read and consent to these Terms and Conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to the minor entering this promotion.
Employees (and their immediate families) of the Promoter, participating Woolworths Supermarkets and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
To be eligible to enter, entrants must, during the Promotional Period, purchase, a specially marked container of Inghams branded Turkey mince from any participating Woolworths supermarket; and use the Turkey mince purchased to create a Turkey burger.
To enter, entrants must then, during the Promotional Period, take a photo of their Turkey burger, visit
www.todaysturkey.com.au, follow the prompts to the promotion entry page, input the requested details including the recipe for the Turkey burger they have created as well as the photo they have taken and submit the fully completed entry form.
Once their entry is complete their image and recipe will be uploaded and featured in the gallery immediately, unless withheld by the Promoter, on the todaysturkey website where individuals (including other entrants) can vote on their favourite Turkey burger recipes.
Each person who submits a valid vote online at
www.turkeysuperburger.com.au/superburgeroff/ using the "vote" function will be awarded one (1) entry into the relevant weekly draw.
The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
The Promoter reserves the right, at any time, to invalidate any votes which it reasonably suspects have been submitted using false, incorrect, fraudulent or misleading information, including but not limited to personal details and contact information and/or votes that have been submitted through the use of multiple identities, email addresses or accounts.
Incomplete, indecipherable or illegible entries/votes will be deemed invalid.
Only one (1) entry permitted per person. Only one (1) vote permitted per person per week.
Entrants must retain a photocopy of their Woolworth's purchase receipt as proof of purchase. Failure to produce the proof of purchase when requested may, in the absolute discretion of the Promoter, result in invalidation of an entrant's entry and forfeiture of any right to a prize. Purchase receipt must clearly specify the store of purchase and that the purchase was made during the promotional period but prior to entry.
If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
There will be nine (9) weekly draws conducted for this promotion. Entries close for each weekly draw at 11:59pm AEST on the dates specified in the table below. All weekly draws will take place at 11:59am AEST at Inghams Enterprises Pty Limited, 203 Northumberland Street Liverpool NSW 2170 on the dates specified in the table below. Entries in each weekly draw will NOT be entered into any subsequent weekly draws.

Winners will be notified in writing within two (2) days of the draw (for weekly winners) and winner determination (for major winner).
The Promoter's decision is final and no correspondence will be entered into.
The first valid entry drawn in each weekly draw will each win a minor prize. The minor prize is a $100 Woolworth's WISH Gift Card. Woolworths Limited is the issuer of the WISH Gift Card but is not the Promoter and is therefore not responsible for the prizes, products, or services under the promotion or the fulfilment of these Terms and Conditions. Woolworths Limited is responsible for the fulfilment of the terms and conditions of the WISH Gift Card. WISH Gift Cards are redeemable at participating stores only. At the conclusion of the Promotional Period, all votes will be tallied. The top five (5) entries with the most votes will each be deemed a "finalist". In the event of a tie between two (2) or more entries for a position in the top five (5) the Promoter will appoint a food expert to judge each tied Turkey burger recipe and photo and determine the finalist based on creative merit.
The five (5) finalist entry recipes will be cooked and judged, by a panel of judges appointed by the Promoter, based on taste, creativity, marketability and culinary merit. The best entry from the finalists as determined by the judges will win the major prize. The major prize is a trip for four (4) adults to Los Angeles and San Francisco, USA valued at up to AU$45,798.56 depending on date and point of departure. Prize includes economy airfares for four (4) adults (including airfare taxes) from Perth, WA or Sydney, NSW to San Francisco, (if winner resides outside of either Perth, WA or Sydney, NSW, return economy airfares from the winner's nearest capital city to the closer of the two departing airports will be provided if necessary); airport to hotel transfers in San Francisco; three (3) nights twin share accommodation in two (2) rooms at Handlery Union Square Hotel in San Francisco, USA, a double decker sightseeing tour of San Francisco; a Yosemite day trip (to be taken by 31/01/12); economy domestic airfares from San Francisco to Los Angeles for four (4) adults; return airport to hotel transfers in Los Angeles; two (2) nights twin share accommodation in two (2) rooms (Premier Room) at the Disney Grand Californian in Los Angeles, USA; four (4) x three (3) day Disneyland Hopper Pass tickets; AUD$2,000 spending money; and economy airfares from Los Angeles to Sydney, NSW or Perth, WA (as required) for four (4) adults; and an Olympus TG310 Tough camera valued at AUD$270 to be used to document their trip. The winner must ensure a minimum of twenty (20) number of photographs are taken using the Olympus TG310 Tough camera and must provide copies of their photographs to the Promoter within two (2) weeks of completion of their holiday for the purpose of promoting this promotion in accordance with Clause 30. Additional spending money, additional meals, taxes (excluding airline and airport taxes), insurance, passports, visas, vaccinations, transport to and from departure point, transfers, items of a personal nature, in-room charges and all other ancillary costs are not included. Prize must be taken by 31/01/12 and is subject to booking and flight availability.
During the entire duration of the major prize, a nominated parent/guardian must accompany any person under 18 years of age.
Frequent flyer points will not form part of the prize. The major prize is subject to the standard terms and conditions of individual prize and service providers. The major prize winner may be required to present their credit card at time of accommodation check in.
If for any reason the winner of the major prize does not take the major prize (or an element of the major prize) at the time stipulated by the Promoter, then the major prize (or that element of the major prize) will be forfeited and will not be redeemable for cash.
In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion or suspend or modify a prize, subject to any written directions from a relevant regulatory authority.
If the winner of the major prize is under the age of 18 years, the prize will be awarded to the winner's nominated parent or guardian on the winner's behalf.
If a prize (or part of a prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
Total prize pool awarded by way of chance is $900. The total prize pool awarded by way of skill is values at up to $45,798.56. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash.
A draw for any unclaimed weekly prizes may take place on 04/01/2012 at the same time and place as the original draw, subject to any directions from a regulatory authority. Winners, if any, will be notified by email within two (2) days of the draw.
When an entrant submits any materials via the promotion including comments, recordings and images ("Content"), the entrant, unless the Promoter advises otherwise, licenses and grants the Promoter, its affiliates and sub-licensees a non-exclusive, royalty-free, perpetual, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish and display such Content for any purpose in any media, without compensation, restriction on use, attribution or liability. Entrants agree not to assert any moral rights in relation to such use and warrant that they have the full authority to grant these rights.
Entrants agree that they are fully responsible for the Content they submit. The Promoter shall not be liable in any way for such Content to the full extent permitted by law. The Promoter may remove any Content without notice for any reason whatsoever. Entrants warrant and agree that: (a) they will not submit any Content that is unlawful or fraudulent, or that the Promoter may deem in breach of any intellectual property, privacy, publicity or other rights, defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin or gender, not suitable for children aged under 15, or otherwise unsuitable for publication; (b) they will obtain prior consent from any person or property that appears in their Content; (c) they will obtain full prior consent from any person who has jointly created or has any rights in the Content, to the uses and terms herein; (d) their Content shall not contain viruses or cause injury or harm to any person or entity; and (e) they will comply with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and the access or use of others' computer or communication systems.
Without limiting any other terms herein, the entrant agrees to indemnify the Promoter for any breach of the above terms.
Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner, as well as the photographs taken using their Olympus TG310 Tough camera during the holiday prize in accordance with Clause 20 in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
Any cost associated with accessing the promotional website is the entrant's responsibility and is dependent on the Internet service provider used.
Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia ("Non-Excludable Guarantees"). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) if a tour is cancelled for any reason beyond the reasonable control of the Promoter; (f) any tax liability incurred by a winner or entrant; or (g) use of a prize.
As a condition of accepting the major prize, the winner (and his/her/their companion/s) must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to opt out, access, update or correct information to the Promoter. All entries become the property of the Promoter.
