1. Information on how to enter and prizes form part of these Terms and Conditions. Participation in any promotion run under these Terms and Conditions is deemed acceptance of these Terms and Conditions.

2. Entry is only open to residents of Australia and New Zealand aged 18 years or older.

3. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

4. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

5. Incomplete, indecipherable or illegible entries will be deemed invalid.

6. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

7. Each promotion starts and finishes on the times and dates advertised on the relevant promotional material. To be eligible, entrants must follow the entry instructions set out on the relevant promotional material (by the closing date/time indicated).

8. Any applicable entry requirements or limitations will be specified in the relevant promotional material (with the details on how to enter). In the event that multiple entries are permitted, each entry must be submitted separately and in accordance with entry requirements.

9. If a draw is to take place, the draw will take place at the Promoter’s office on the date and time advertised in the relevant promotional material (unless otherwise advertised).

10. All winners will be notified in writing within 2 days of the draw and any winners of prizes valued at over $250 will be published in The Australian on the date advertised in the relevant promotional material.

11. The Promoter’s decision is final and no correspondence will be entered into.

12. The number of prizes available and their individual value will be advertised in the relevant promotional material.

13. If for any reason a winner does not take the prize by the time stipulated by the Promoter, then the prize will be forfeited.

14. If any prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification.

15. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash.

16. Any cash prizes will be awarded in the form of a cheque or by electronic funds transfer to the winner's nominated bank account (in the local currency of the winner).

17. In the event that a draw takes place, if necessary, a draw for any unclaimed prizes will then take place no earlier than three months after the original draw. Any winners of prizes valued at over $250 will be published in The Australian within two weeks of the draw.

18. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting the promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

19. If a promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.

20. If entry is via an online mechanic, the website address will be specified in the promotional material. Any cost associated with accessing the promotional website is the entrant’s responsibility and will be dependent on the Internet service provider used.

21. If entry is via a premium SMS mechanic, the SMS number will be specified in the promotional material. The cost of the SMS will be 55c. Entrants must have premium service access. Details of the SMS helpline number will also be included with the promotional material. SMS entries via the Internet will be ineligible.

22. If entry is via phone, the phone number will be specified in the promotional material. Call cost from landline phones will not exceed 55c, however, calls from mobile and pay phones may attract a higher rate.

23. All entries are deemed to be received at the time of receipt into the promotion database and NOT at the time of transmission by the entrant.

24. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter a promotion repeatedly is prohibited and will render all entries submitted by that entrant invalid.

25. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

27. The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.

28. The Promoter is Reader’s Digest (Australia) Pty Ltd, (ABN 81 000 565 471), 80 Bay Street, Ultimo, NSW Australia. (www.readersdigest.com.au) (www.readersdigest.co.nz). Ph: Aust 1300300162 - NZ 0800540048.
