TERMS AND CONDITIONS
1. Information on how to enter and prizes form part of these Terms and Conditions. Entry into this promotion is deemed acceptance of these Terms and Conditions by each Entrant (defined below).
2. Entry is limited to current Optus consumer residential customers aged 18 years and over within Australia (“Entrants”). Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter.
3. Promotion commences at 12:01am (AEST) on 25/07/2011 and closes at 11:59pm (AEST) on 31/08/2011 (“Promotional Period”).
4. To be eligible to enter, Entrants must be registered with Optus Movie Rewards during the Promotional Period. To register with Optus Movie Rewards, Entrants must visit
www.optusrewards.com.au, follow the prompts to the registration page, input the requested details and submit the fully completed registration form. To enter, Entrants who are new and existing Optus Movie Reward members must visit

5. The Promoter reserves the right, at any time, to verify the validity of entries and Entrants (including an Entrant’s identity, age and place of residence) and to disqualify any Entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions will be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
6. Incomplete or indecipherable entries will be deemed invalid. An Entrant must be a current Optus consumer residential customer aged 18 or over at the time of the draw to be eligible to win.
7. If there is a dispute as to the identity of an Entrant, the Entrant will be deemed to be the person in whose name the mobile phone account is held.
8. Entries are deemed to be received at the time of receipt into the promotional database and NOT at the time of transmission by the Entrant
9. All valid entries received during the Promotional Period will be entered into the draw to be held on Thursday 01/09/2011 at 15:00 (AEST) at Optus Centre Sydney, 1 Lyonpark Road, Macquarie Park, NSW 2113. The Promoter reserves the right to draw additional reserve entries and record them in case an invalid entry or ineligible Entrant is drawn.
10. The first valid entry drawn will win a trip to Hokitika, New Zealand valued at up to AUD$9,000 depending on date and point of departure. Prize includes two (2) x return economy airfares from Australia (winner’s nearest capital city) to Hokitika, New Zealand, four (4) nights’ twin share accommodation at a 4 star Hotel in Hokitika, New Zealand. Prize also includes entry for two (2) into Cowboy Paradise including dress up and a clay shooting experience plus $250 spending money.
11. The winner may be required to present their credit card at time of accommodation check in. Travel arrangements to and from the winner’s nearest capital city airport do not form part of the prize and are the responsibility of the winner and their travelling companion. The winner must travel on the same flights and itinerary as their travelling companions. The travel prize cannot be used as part payment for another airfare package. Frequent flyer miles cannot be accrued on this prize. Flights and accommodation are subject to availability at the time of booking and cannot be exchanged for other destinations.
12. Prize must be taken within twelve (12) months of draw date. Travel dates exclude 15/12/2011 – 02/01/2012 and public holidays. All offers, events, tickets, age ranges, services, attractions and entertainment may be seasonal and are subject to change without notice.
13. Additional spending money, additional meals, taxes (excluding airline and airport taxes), insurance, transport to and from departure point, additional transfers, items of a personal nature, in-room charges and all other ancillary costs are the responsibility of the winner.
14. Prize is subject to booking and flight availability at time of booking. The Promoter accepts no responsibility for the cancellation or rescheduling of any flight. Frequent flyer points will not form part of the prize. Prize is subject to the standard terms and conditions of individual prize and service providers.
15. Car hire prize is subject to standard rental conditions. Petrol and insurance is not included.
16. The next twenty (20) valid entries drawn will each win a double movie pass (2 movie tickets for 2 adults) to see Cowboys and Aliens at any cinema showing the film (rrp $34 each), a limited edition Cowboys and Aliens hooded top (rrp $65 each) and a limited edition Cowboys and Aliens clock (rrp$50 each). Any costs associated with attending the movie including travel to and from the cinema is the responsibility of the winner. Any ancillary costs associated with redeeming the movie pass are not included. Any unused balance of the movie pass will not be awarded as cash. Redemption of the movie pass is subject to any terms and conditions of the issuer including those specified on the movie pass. Total second place prize pool is AUD$2,980.
17. If for any reason a winner does not take a prize or an element of the prize by the time stipulated by the Promoter, then the prize or that element of the prize will be forfeited.
18. Winners will be notified in writing by e-mail and also by telephone within two (2) days of the draw and the major prize winners’ name will be published in The Australian on Friday 09/09/2011. The Promoter’s decision is final and no correspondence will be entered into.
19. Total prize pool value is up to AUD$11,980. Prizes, or any unused portion, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
20. A draw for any unclaimed prizes may take place on 05/12/ at the same time and place as the original draw, subject to any directions from a regulatory authority. In the case of a runner up prize being awarded, an alternative prize to the Cowboys & Aliens double movie pass will be supplied. Winner/s if any, will be notified in writing by e-mail and also by telephone within two (2) day of the draw and the name of the major prize winner, if any, will be published in The Australian on 17/12/11.
21. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
22. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any Entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
23. Any cost associated with accessing the promotional website is the Entrant’s responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an Entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that Entrant invalid.
24. The Promoter is not responsible for any incorrect or inaccurate information, either caused by promotional website users or by any of the equipment or programming associated with or utilised in this promotion, or by any technical error that may occur in the course of the administration of this promotion. The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to or alteration of entries.
25. If for any reason this promotion is not capable of running as planned due to any reason, including but not limited to infection by computer virus, bugs tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to disqualify any Entrant who tampers with the entry process, and to cancel, terminate, modify or suspend the promotion, subject to any written directions from a regulatory authority.
26. Winners agree to participate in any news and media/PR activities surrounding the promotion. The Promoter reserves the right to use each winner’s name, voice, image and likeness for advertising and publicity purposes in any media in perpetuity worldwide without additional compensation.
27. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
28. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or Entrant; or (f) use of a prize.
29. All entries become the property of the Promoter. The Promoter requires Entrant’s personal information in order to conduct the promotion. If Entrant’s do not provide the mandatory personal information requested then they will not be able to take part in the Promotion. By entering this promotion, each Entrant is taken to consent to the Promoter using the Entrant’s personal information to administer the promotion, announce the winners and disclosing the Entrant’s personal information to organisations that assist the Promoter with administering the promotion and announcing the winner, and to third parties as required by law (including authorities that regulate this promotion).
